동물보호법에 대한 개념과 견해

동물보호법상의 문제점과 해결방안동물은 오래전부터 인간과 밀접한 관계를 형성해왔다. 사회가 점차 근대화 되면서부터 동물을 학대하거나 남용하는 사례가 증가하였으나 이와 더불어 반려동물을 보호해야 한다는 의견이 점차 늘어났다. 그런 계기로 인해 19세기 미국에서 동물보호법이 제정되었고 법이 엄격하게 시행되고 있다. 반면에 우리나라의 경우 각종 세계 동물보호단체의 비난을 못 이기고 1991년 동물보호법이 제정되었으나 여전히 제대로 지켜지고 있지 않다. 그로 인해 우리나라에서는 동물 학대가 여전히 빈번하게 발생하고 있다. 동물은 하나의 생명체로서 태어난 이상 보호받을 권리가 있다. 따라서 우리나라는 동물보호법을 보다 강화하고 엄격하게 실행해야 할 필요성이 있다.우리나라의 동물보호법은 동물을 학대하는 경우에만 규정이 있고 조항 위반에 대한 아무런 벌칙이 존재하지 않는다. 즉, 동물보호법의 실효성이 계속 문제가 제기됐다. 또한 동물 보호법이 개정되어 동물 학대시 1년 이하의 징역 또는 1000만원 이하의 벌금형을 받는다는 것을 알면서도 이런 행위에 대해 강력히 처벌한 사례가 단 한차례도 없어서 여전한 동물 학대가 이루어지고 있는 현실이다.이런 허울뿐인 법을 강화하기 위해서는 규정의 상세화와 강화가 필요하다고 생각한다. 우선 동물 학대라는 개념의 정의가 필요하다. 동물 학대라는 것은 추상적인 개념으로 사람에 따라 판단하는 기준이 다를 수 있다. 따라서 법 규정상 동물 학대라는 개념을 우선 명확하게 언급한 뒤 넘어가야 법이 보다 타당성을 가지게 될 것이다. 또한 학대 유형을 다양한 사례를 고려해 언급하는 것도 필요하다고 본다.또한 보호대상동물 범위의 확대가 필요하다. 대게 사람들은 동물 학대를 떠올릴 경우 반려견이나 소, 말, 돼지 등을 떠올린다. 그러나 동물의 범위는 매우 넓은 편이며 모두 하나의 생명체이기 때문에 보호할 필요성이 있다. 그렇기 때문에 대부분의 선진국처럼 동물보호법에 의해 보호받는 동물의 범위를 확대해야 할 필요성이 있다.동물보호법을 강화하기 위한 다른 방법으로는 전담 부서를 신설하거나 확대하는 것이다. 동물 복지 문제에 대해 사람들의 관심이 점차 늘어나고 있는 추세이기도 하고 선진국들의 예를 살펴보면 담당 부서를 확장해야 할 필요성을 느낀다. 전문 인력을 대량 확보하고 동물 보호법의 사각지대에서 고통 받는 동물들이 없도록 해야 한다. 또한 전문가와 동물보호단체의 협력을 통해 개별법을 제정하는 등 동물 보호에 발 벗고 나서야한다.

Abolition of Death PenaltySevere crimes which cause social disorders are increasing all around the world. People are terrified and their life are also threatened by those kinds of crimes. For that reason, there are controversy going around whether we should regenerate death penalty or not. Movie which I chose, 12 angry men, proceed the story based on death penalty. A boy who are arrested as murdering his father might face electric chair if convicted. Only one of 12 jurors think that boy should not be sentenced to death. He contemplates about the issue while other people simply think that the boy should be faced electric chair. Also, he does not ignore possibility of the boy’s innocence. Like the one man in the movie, in my opinion, I think we should contemplate about sentencing death penalty. Declaring death penalty is not a simple problem. It is like taking one’s right to live. Life cannot be deprived of and have right to be protected. Therefore, I have doubts why we should revive dea should be banned. There are three reasons why I agree with abolition of death penalty.First, there is a chance of misjudgment. Humans are not perfect. Even though technologies are developed and scientific that can minimize mistakes, we have a chance of misjudgment in trials. Also, wrong testimony and evidence can blind the truth. But if innocent person is executed, nothing can be done to undo the execution because that person is already dead. Boy in the movie can also be innocent because evidences are not clear enough. One testimony that the knife which the boy bought and used for murdering is only one was proved to be false because the man were trying to persuade the others also owned that knife. Another testimony made by old man proved to be wrong by simulation. That man who tries to persuade others mentions that people can be wrong and everything cannot be exact science and everyone agrees with it. Penalty exist to educate and lead criminal to the right way. But death penalty does re is less chance of misjudgment because trial system has developed. But human can be affected by prejudice, wrong proofs and various evidence that can blind the truth. As long as trial is run by human, there is a chance of misjudgment.Second, death penalty disregard criminal and executor’s human rights. Basically, death penalty deprives dignity and value of life. As a country to protect citizens and as a same human, we cannot deny that depriving one person’s life and dignity is wrong. In The Universal Declaration of Human Rights, article 3 mentions that “Everyone has the right to life, liberty and security of person”. Also, according to constitutional law in Korea, article 10 states “All citizens shall be assured of their human worth and dignity and shall have the right to pursue happiness. It shall be the duty of the State to confirm and guarantee thefundamental and inviolable human rights of individuals.”. Most states guarantee human rights as non-aggressive right in any circumstancights but also infringe on executor’s human rights. Executors can suffer from sense of guilty because they have contributed to criminal’s death even though it is indirect. Although at least 3 executors are arranged to reduce these kinds of guilt, it does not mean that they are totally out of chance to feel sense of guilt.In the movie, 11 of 12 jurors think that the boy who is suspected of murdering his father should be executed to death because he killed his father. Like 11 men in the movie, opponents who disagree with abolishing death penalty claims that death penalty is a punitive justice to a criminal. As the proverb says, “What goes around, comes around”. But opponents are overlooking the chance of reformation. Criminals can be reformed by education. Also, they might repent on their sin in prison. Penalty is put into practice to compensate for crime and make criminal be socialized. But death penalty denies the purpose of penalty. Death penalty is an extreme way of penalty and deprican be some difficulties to make criminal become socialized. But if we think about the chance of socialization of criminal, life sentence will be more suitable rather than death penalty. While imprisoned, criminal can compensate for his crime and can also become socialized by hard training. Therefore if we assume that life sentence and parole exist, they can be a alternative way of penalty instead of death penalty.It is hard to say exactly whether if death penalty is right or wrong. But according to what I have mentioned, I think that opportunity cost of abolishing death penalty is larger than enforcing it. In the past, human rights were invaded by many kinds of reasons such as racial discrimination and war. But we are now living in a modern society where human rights and life are the most respectful part of living. Life cannot be invaded by any kinds of reason. So as to follow flow of modern society, I think that we should abolish death penalty system.Universal Declaration of Human Rirea
