자치경찰제 도입에 관한 비교연구 (A Comparative Study on the Devolution Policy of Nation Police System)

초록

1995년 지방자치제 실시 이후, 치안행정의 지방자치와 민주적･분권적인 경찰제도의 개혁으로자치경찰제도에 대한 논의가 이루어지고 있다. 정부수립 이후 지금까지 자치경찰제에 대한 논의 및 입법화가 지속적으로 시도되어 왔고 그 과정에서 매 정권마다 다양한 도입 법안이 도출되었다. 그러나 자치경찰제 추진과정에 주요 쟁점 사항들에 대한 다양한 이해관계자들의 이견으로 현재까지도 자치경찰제도의 시행이 이루어지지 않고 있다.
이에 본 연구는 자치경찰제도의 주요 도입 법안에 관한 비교 분석을 통해 한국적 상황에 적합한 자치경찰제 모형을 고찰하고자 하였다. 주요 도입 법안의 비교 분석을 위해 이론적 논의와 선행연구를 통해 분석기준으로는 민주성, 능률성, 정치적 중립성, 지휘체계의 효율성, 국가치안력 확보, 재정부담 최소화, 사기앙양과 책임감 부여, 국가 및 자치경찰간 관계 등을 기준으로 도출하였다. 또한 자치경찰제의 도입범위, 조직형태, 기관형태, 인사권, 사무와 권한, 국가경찰과의 관계, 지방자치단체장의 관여범위, 자치경찰의 예산 등을 자치경찰제도 추진과정에서나타날 수 있는 쟁점으로 분류하였고, 이를 분석기준과 연계하여 검토하였다.
분석결과 세 가지 도입 법안을 종합하여 볼 때 바람직한 자치경찰제 도입 모형으로는 능률성, 정치적 중립성, 지휘체계의 효율성 등을 확보하기 위해 바람직하다고 판단된 광역단위 도입안을 제시하였다. 이를 통해 지방행정과 치안행정의 연계성을 확보하고, 지방자치 시대에 걸맞는 지역적 특성의 반영과 경찰재정의 안정성 확보를 통해 지방 실정에 적합한 자치경찰제를도입함과 동시에 국가전체의 치안행정과 지방자치단체의 치안행정 상호간 효율성을 제고할 수있다고 본다.

영어초록

After the enforcement of 'Deme' in 1995 in Korea, the self-government police system are discussed more positively than ever to innovate the police system as local self-government administrators of public peace for the democratical decentralization. Since the establishment of Korean government, the debate over the self-government police system and its legalization has been continued and various introduction bills were deduced from that discourse. However, due to the different views of various interest groups about the main issues of the self-government police system, the seemingly promising self-government police system has not been introduced yet.
This study tried to find the suitable self-government police system for Korean circumstances through the comparative analysis of the main introduction bills made by the government officials until now. For the comparative analysis among the introduction bills, standard variables set from the theoretical discussions and previous studies are 'the degree of democracy', 'the efficiency', 'the political neutrality', 'the efficiency of command system', 'the acquisition of national security power', 'the finance burden minimization', 'the morale elevation', 'the sense of responsibility' and 'the relationship between the nation and the self-government police system'. In addition, I sorted the variables such as 'local administrator's participation extent', 'self-government police's budget'to point out the issues possibly raised over the process of installation of the self-government police system and related these variables with standard variables.
Results of the analysis shows that it is desirable to enforce the integrated self-government police system on the wide area basis so as to protect the essential values for the self-government police system such as 'the efficiency','the neutrality of the political power', and 'the efficiency of command system'. The widely integrated self-government police system can confirm the links between the local administrators and the national security administrators so that their efficiency levels increase. Simultaneously, this integrated system will make the local police systems reflect their local characteristics which is appropriate to the present self-government era.
