중국 쇼트폼 인터넷정보전파권 침해에 관한 연구 (Research on the Identification of Short Video Infringing the Right of Information Network Dissemination in China)

초록

지난 십년 간 인터넷과 스마트폰의 대중화와 함께 쇼트폼이라는 미디어 산업이 중국에서 주목을 받으면서 가파른 속도로 성장해왔다. 중국인터넷정보관리 당국의 데이터에 의하면 쇼트폼 저작권과 관련된 총 분쟁 건수는 급속히증가하고 있고 이에 따라 소송으로 이어질 가능성이 있는 쇼트폼 저작권 관련분쟁이 증가하고 있다. 이 글에서는 베이징 인터넷법원이 공개한 대표적인 판례 4건을 선정하여 사실관계와 판시 내용을 분석하고 그 중 존재하는 문제점을논한다. 제2부분에서는 먼저 쇼트폼 및 정보인터넷전파권 침해에 관한 개념과법률을 서술하고, 작품, 저작권 및 쇼트폼 저작권 침해행위의 유형을 설명한다. 제3부분은 판촉 쇼트폼, 편집 쇼트폼, 가요 작품의 무단 이용, 비즈니스 모델과 인터넷제공자의 책임 등 4건의 판례로 나누어 판시 내용과 판결의 법적근거 그리고 판결의 장단점을 분석하고 문제점을 제시한다. 제4부분은 유사 작품의 구별, 합리적 이용, 쇼트폼의 2차 제작, 인터넷 제공자의 과실, 인터넷 저작권정보의 공개, 손해배상액 및 징벌적 배상 등 개선방안을 논한다. 마지막제5부분에서는 논문 전체를 요약하여 정리한다. 정보인터넷전파권 침해행위는쇼트폼의 급증에 따라 많이 발생하고 있으며 쇼트폼의 장기적 발전에도 영향을 미치고 있다. 현실에서는 법원의 재판이 이러한 행위를 적극적으로 억제하는 역할을 할 수 있다. 중국 사법기관은 이러한 행위를 억제하고 근원적으로정보인터넷전권 침해행위를 줄이기 위해 노력할 필요가 있다.

With the popularization of the Internet and smartphones, the media form of short video has become popular in China in recent years and has grown exponentially. According to data from the Cyberspace Administration of China, the total number of disputes involving short video copyright is large, and related disputes have the potential to enter litigation, resulting in a gradual increase in the number of cases involving short video copyright.
This article selects four typical cases released by the Beijing Internet Court, analyzes the factual relationship and the judge's judgment and reasoning, and discusses the problems existing in the trial of short video infringement on the right to disseminate online. The second part of the article first describes the legal provisions and legal principles related to short videos and infringement of information network communication rights, and respectively explains works, copyrights and short video copyrights, information networks, information network communication rights, infringement of information network communication rights, and network copyright information. Disclosure, reasonable use of copyright, right of reproduction and right of information network dissemination, jurisdiction; Part III categorization describes original video with goods, video clips, unauthorized uploading of songs for users to make short videos, business model and network service provision This paper analyzes the legal basis, advantage and disadvantage of the judgment, and analyzes the legal basis, advantages and disadvantages of the judgment.
Part IV proposes the identification of similar works, fair use, the identification of secondary creation of short videos, and the current situation of short video development and China's trial status. Six improvement opinions, including fault identification of network service providers, disclosure of online copyright information, compensation amount and punitive damages; Part V summarizes the full text. The proliferation of short videos infringing the right to disseminate information on the Internet not only damages the legal rights of copyright owners, but also affects the long-term development of the short video industry. We should actively suppress and stop this kind of behavior in trial practice and strive to reduce infringement from the source. The occurrence of behaviors promotes the healthy and orderly development of the short video industry.
