인구감소지역 초․중등교육 규제 개선의 과제와 방향 (Challenges and Directions for the Improvement of Primary and Secondary Education Regulations in Population-declining Areas)

초록

이 연구는 인구감소지역 초·중등교육 규제 개선의 과제와 방향을 탐색하기 위해 인구감소지역 초·중등교육 규제의개념과 범위를 검토하고, 그 동안 인구감소지역의 교육 개선 방안으로 제시되었던 여러 정책 방안들을 수집하여규제 개선이 필요한 과제들을 선별하였다. 나아가 교육규제에 관한 개념적 논의와 규제 개선 과제 도출의 성과에기초하여 인구감소지역 초·중등교육 규제 개선의 방향을 제시하였다. 일반적인 의미에서 교육규제는 국가나 지방자치단체가 교육행정의 목적을 실현하기 위해 국민의 권리를 제한하거나 의무를 부과하는 것으로 이해되지만, 교육관련법상임무를 부여받은 ‘교직원’이나 ‘교육기관’이 규제의 객체에 포함되는지에 대해서는 논란이 있다. 인구감소지역의교육현장에서 체감되는 실제 규제를 포착하기 위해서는 교육규제를 ‘교육행정기관이 개인 및 교육기관의 활동을제약하는 것’으로 보다 폭넓게 규정할 필요가 있다. 이러한 교육규제의 관점에서 보았을 때, 인구감소지역을 위해제안되었던 정책 방안들은 대부분 교육규제의 개선을 필요로 한다. 학교 설립 및 운영, 교직원, 교육과정, 교육 행·재정운용, 새로운 인구구조 대응 등 여러 영역의 정책 방안들이 인구감소지역에서 원활하게 추진되기 위해서는 교육규제의개선이 필요하다. 인구감소에 접어든 국가적 상황 속에서 인구감소지역의 초․중등교육을 위한 교육규제 개선은 ‘패러다임전환’과도 같은 혁신적인 것이어야 한다. 본 연구에서는 인구감소기 관점에서의 초․중등교육 규제 검토, 인구감소지역의현실을 고려한 규제의 신설 혹은 강화, 다양한 정책적 시도를 가능하게 하는 네거티브 규제 방식 도입 검토 등을인구감소지역 초·중등교육 규제 개선의 방향으로 제시하였다.

영어초록

This study examined the concept and scope of elementary and secondary education regulations in depopulated areas to explore the challenges and directions for improving these regulations. It also identified tasks requiring regulatory improvement among various policy measures that have been proposed as educational improvement measures in depopulated areas. Furthermore, based on the results of identifying tasks requiring regulatory improvement, the study proposed directions for improving elementary and secondary education regulations. In a general sense, education regulation is understood as the state or local government restricting the rights of citizens or imposing obligations in order to realize the purpose of educational administration. However, there is controversy over whether ‘teachers’or ‘educational institutions’assigned duties under education-related laws should be included in the scope of regulation. In order to capture the actual regulations experienced in the educational field in population-declining areas, education regulation needs to be defined more broadly as ‘educational administrative agencies restricting the activities of individuals and educational institutions.’ From this broader perspective, most policy measures proposed for education in depopulated areas require improvements to education regulations. In order for various policy measures—such as school establishment and operation, faculty and staff, curriculum, education administration and finance management, and new population structure response—to be smoothly implemented in areas with declining population, improvement of education regulations is necessary. In a national situation where population is decreasing, the improvement of education regulations must be innovative, akin to a ‘paradigm shift.’ This study suggests the following directions for improving regulations on elementary and secondary education in depopulated areas: a review of elementary and secondary education regulations from the perspective of population decline, the establishment or strengthening of regulations that reflect the realities of these depopulated areas, and consideration of the introducing negative regulations that enable various policy attempts.
