북한 지적재산권법에 대한 연구 - 북한에도 특허청이 있을까? - (A Study on Intellectual Property Laws in North Korea - Is there a patent office in North Korea, too? -)

초록

북한에도 남한의 특허법, 상표법, 디자인보호법, 저작권법 같은 지적재산권 관련법률이 존재하고 있고, 남한의 특허청과 같은 지적재산권 관련 출원 및 등록기관도존재하고 있다. 다만 북한 지적재산권법은 북한의 사회주의적 정치체제를 반영하고있다는 점에서 남한의 지적재산권법과 상당한 부분에서 차이점이 있다. 즉 북한지적재산권법은 사회주의 국가의 법률로서 국가의 역할을 강조하고 있다는 점에서큰 특징을 보이고 있다. 따라서 북한 각 지적재산권법의 제1장의 기본편은 지적재산권관련 신청, 심의, 보호, 사업 등에서 국가의 역할을 명시하고 있다. 또한 북한 지적재산권 법은 지적재산권의 사용 및 수익측면에서 국가의 관리를 중요시한다는 점에서남한의 지적재산권 법과 다른 특색을 가지고 있다. 즉 북한 지적재산권법은 당사자가사적 자치의 원칙에 근거하여 지적재산권의 양도 및 사용에 대하여 자유롭게 거래할수 없고, 국가가 당사자 사이에 개입하여 이에 대한 가격책정을 하도록 규정하고있다. 현재 남한과 북한의 경제협력의 분위기가 무르익고 있다. 이에 남한과 북한은지적재산권법과 제도에 대하여 서로 협력함으로써, 경제발전의 기회로 삼아야 할것이다. 이를 위해서는 점진적인 접근방법이 필요한데, 과거 서독과 동독이 통일하면서 채택하였던 지적재산권 통일방안과 최근 유럽연합에서 이루어지고 있는 유럽단일특허제도의 도입과정과 통합 특허법원의 설립과정을 참고한다면 도움이 될것이다.

영어초록

There are intellectual property laws such as South Korea's patent law, trademark law, design protection Law and copyright Law in North Korea. Also, there are intellectual property-related applications and registration agencies such as South Korea's Patent Office in North Korea. But, there are considerable differences between South and North Korea's intellectual property laws in that North Korea's intellectual property laws reflects the its socialist political system. In other words, North Korea's intellectual property laws is characterized by its emphasis on the country's role as a socialist country's law. In addition, North Korea's intellectual property laws have different characteristics from South Korea's laws in that North Korea's laws places importance on the management of the country in terms of the use and profits of intellectual properties. Especially North Korea's intellectual property laws would not approve that companies can freely trade the transfer and use of their intellectual properties on the basis of the principle of private autonomy.
At present, the atmosphere of economic cooperation between South and North Korea is ripe. Therefore, they should work together on intellectual property laws and systems to take advantage of them as an opportunity for economic development.
A gradual approach is needed to do this, with reference to the plans for the unification of intellectual property laws adopted by West and East Germany as well as the recent introduction of a single European patent system and the establishment of an integrated patent court in the European Union.
