중요무형문화재 “택견”의 보호와 육성을 위한 법정책적 소고 (A study on the protection and development of Taekgyeon, National Important Intangible Cultural Heritage)

초록

중요무형문화재 제76호 “택견”은 1983년 무예 종목으로는 유일무이(唯一無二)하게 국가중요무형문화재로 지정되었으며, 2011년에는 UNESCO로부터 전통무예 최초로 세계인류무형유산으로 선정되었다. 이처럼 “택견”은 국내외적으로 문화적 가치를 인정받고 있기에 앞으로는 국내 보급 단계에서 탈피하여 세계인의 전통무예로 거듭나야 할 것이다. 현행 문화재보호법상의 원형유지 원칙 및 중점보호주의는 유형문화재 중심의 체계에서 이루어지는 것이므로, 무형문화재로서의 특성을 유지하는 것을 전제로 적극적인 보호 및 육성 방안을 새롭게 모색하여야 한다. 특히 인류 공동의 문화유산으로서 보존하고 전승할 가치가 있는 “택견”은 문화적 가치뿐만 아니라 전통스포츠로서의 가치 또한 크다는 점에서 체계적인 보호 및 육성 정책이 필요하다.
2008년 제정된 전통무예진흥법은 문화적 가치가 있는 전통무예를 지정하여 육성하는 것을 목적으로 함에도 법률 자체의 미비와 문화체육관광부 등 관계 기관의 역량 부족, 전통무예인 및 전통무예단체 간 이해관계의 대립으로 본래의 역할을 하지 못하고 있다. 이에 전통무예진흥법과 시행령의 개정을 통해 새로운 변화를 시도하고 있다. 그러나 전통무예육성종목 및 전통무예단체 지정 기준과 절차에 대해서 많은 논란이 제기되고 있어 법률 개정 및 기본계획 수립에 어려움이 예상된다. 이러한 차제에 중요무형문화재 “택견”이 인류무형유산으로 선정됨을 도약의 기회로 삼아 택견을 전통무예육성 종목으로 지정하고 육성하는 노력이 필요하다.
먼저 중요무형문화재 택견 보유자, 전수교육조교, 보유단체 내의 수련생의 안전사고의 위험성을 배제하기 위해 보험가입을 의무화하고 보험료를 국가가 지원하는 방안을 검토하였다. 아울러 전국의 택견 수련생들과 공식 경기의 참가자들이 보험의 보호를 받으며 수련하고 시합에 참여할 수 있도록 정책적인 지원이 필요함을 주장하였다. 중요무형문화재 “택견”의 문화적 가치를 보호ㆍ유지하는 정책에서 더 나아가 택견의 스포츠 및 문화적 특성을 고려한 스포츠 경기화 추진, 공연 문화화 전략, 대학 과정 중심의 전수교육 체계의 정비 등을 제언하였다. 이러한 택견 육성책은 국제화와 맞닿아 있는 것이므로 국내외 무예단체ㆍ문화단체ㆍ대학 상호 간의 교류 등 적극적인 문화 공유가 전제되어야 하며, 이를 위한 법제도의 정비와 정책 추진이 수반되어야 한다. 따라서 중요무형문화재 택견의 보호와 육성을 위해서는 문화재보호법과 전통무예진흥법의 개정이 필요하다. 또한 무형문화유산 보전 및 진흥에 관한 법률안의 신속한 제정을 통해 무형문화유산만을 위한 독자적인 법률체계를 구축하여야 한다.

영어초록

Taekgyeon was designated as National Important Intangible Cultural Heritage No. 76 for the first time in Korea in the field of the martial arts and also was selected by UNESCO in 2011 as the Masterpieces of the Oral and Intangible Heritage of Humanity for the first time as the world traditional martial art. Taekgyeon, which is recognized as its cultural value here in Korea and abroad shall now get out of the national boundary to enter the world market to become a martial art which the people around the world can enjoy. As the framework of current Cultural Heritage Protection Act is focusing on the policy of keeping and protecting the traditional cultures as they are, now is the time to break away from that exclusive policy and shall take the active measure to make it a world marital arts while respecting its original form and characters. Especially as Taekgyeon is valuable not only in the perspective of the cultural heritage but also in the perspective of traditional sports which all people around the world have to make efforts to keep it, it is required to support it and help it to develop it further in a systematic way.
The Promotion of Traditional Martial Arts Act of 2008 aims to designate the traditional martial arts which have the cultural value and help them to develop. However, due to the lack of the legal shortcomings and lack of capability of the related authorities including Ministry of Culture, Sports and Tourism, as well as the conflict of interest between traditional martial artists and groups, the act have not played its roles in accomplishing its original purposes. So, the new changes have been tried through the significant revision of Promotion of Traditional Martial Arts Act and its Enforcement Decree. However, as there are a lot of conflicts or differences in opinions in establishing the criteria and procedure for designation and support of traditional martial arts between the traditional martial arts groups, a lot of difficulty is expected in establishing the draft for revision of acts and establishment of basic plan. As the Taekgyeon has been designated as one of Masterpieces of the Oral and Intangible Heritage of Humanity, it is necessary that it shall be designated as the cultural heritage for support and the active measure shall be implemented to help it.
First of all, the following have been reviewed; the plan that the purchasing of insurance becomes mandatory for experts, trainers and trainees of Taekgyeon to protect them from accident and the premium shall be subsidized by Government. Also, it is recommended that the trainees of Taekgyeon are to be covered by the insurances during their participation in the exercise and competitions according to the systematic support. Further, as a way to protect and keep the cultural value of Taekgyeon, and considering the characteristics of traditional sports and cultural features, the making it a commercial game, performance event, and college subject for systematic education have been proposed. These supports for Taekgyeon shall be accompanied by the cultural exchanges with other domestic and international martial arts group, cultural groups and colleges and universities. Accordingly, the preparation of proper legal system and policies shall be made for them. Accordingly, for the protection and support of Taekgyeon, which is the important intangible cultural heritage, the revision of Intangible Cultural Heritage Act and Promotion of Traditional Martial Arts Act shall be revised. In addition, the independent legal system for the intangible cultural heritage only should be established through the rapid promulgation of act on the Protection and Promotion of Intangible Cultural Heritage.
