자율주행자동차 시대 개인정보 보호의 공법적 과제 (Public Law Perspectives on Personal Information Protection in the Era of Automated Vehicle)

초록

4차 산업혁명 시대의 자율주행자동차는 과거 하드웨어 중심의 자동차 개념에서 소프트웨어 중심의 디지털 정보를 광범위하게 처리하는 이동식 컴퓨터의 개념으로 바뀌어가고 있다. 이는 일면적으로는 과학기술을 통한 혁신(innovation)이지만, 다른 한편으로는 이러한 기술적ㆍ산업적 변화에 따라 인간의 삶이 어떻게 변해갈 것인가에 대한 인문학적ㆍ철학적ㆍ법적 문제를 동시에 제기하는 것이다. 과학기술의 발전에 따라 도래하고 있는 ‘인공지능’과 ‘포스트휴먼’(posthuman)의 시대는, 그동안 ‘인간’(human) 존재의 본질로 여겨졌던 이성과 신체능력의 상당 부분을 과학기술과 컴퓨터 시스템이 대신하게 됨으로 인해 생기게 되는 인간 개념에 대한 재해석과 함께 인간에 대한 새로운 위험의 문제를 제기하게 된다.
자율주행자동차를 긍정적으로 이해하는 논자들은, 인간에게 더 나은 안전과 편의를 제공한다는 점을 내세운다. 물론 이러한 논변이 전적으로 틀렸다고 볼 수는 없고, 궁극적으로는 이러한 이상에 도달되기를 필자도 소망한다. 그러나 원자력 등 다른 신기술의 도입과정 등을 통해서도 알 수 있듯이, 과연 자율주행자동차가 과연 종전의 자동차보다 편리하고 좋기만 한 것인지, 신기술이 가져오는 새로운 위험이나 간과하고 있는 위험의 요소는 없는지에 대해서 고민하는 것은 매우 중요하고, 만약 예상되는 위험이 있다면 우선 기술적으로 이를 방지할 수 있는 대책을 강구해야 하며, 기술 및 산업이 자율적으로 고려하지 않는 부분에 대해서는 법제도와 정책을 통해서 위험을 줄이는 방향으로 유도·강제하는 방안을 모색해야 한다.
오늘날 논의되는 자율주행자동차는 그 자체로서는 중립적이고 단지 생활에 편리한 도구(device)에 불과해보일 수도 있지만, 자율주행자동차는 각각 수많은 디지털 정보를 입력하여 이를 처리하면서 작동되는 시스템이고, 이것이 사물인터넷과 통신으로 서로 연결되면(connected) 이는 곧 엄청난 개인정보의 수집ㆍ저장ㆍ유통기능을 담당하게 되기 때문에, 개인정보 보호와 사생활 보호의 관점에서 종전과는 다른 새로운 위험이 발생하게 된다고 볼 수 있다. 이러한 배경에는 근대 이후로 개인의 자유가 보장되면서도 한편으로는 그러한 개인의 권리를 충실히 보호하고 복지를 확대한다는 이유로 공리주의적 사회통제가 강화되어온 감시사회라는 모순적 현실이 자리잡고 있다. 특히 고도화된 정보화시대에 개인정보는 더 많이 노출, 유통되고, 디지털화된 정보에 대한 수집, 감시는 더욱 용이해지고 있는데, 자율주행자동차 시스템도 디지털화된 수많은 개인정보, 특히 위치정보와 영상정보, 통신정보 등으로 운영되기 때문에 이들에 대한 노출과 침해의 위험성에서 자유로울 수 없다. 그리고 이들에 대한 침해는 곧 사생활의 비밀과 자유는 물론 인격권에 대한 침해로 이어질 수 있고, 나아가서는 자유민주적 기본질서에 대한 침해로까지 이어질 수 있기 때문에, 미국과 유럽의 법제 등을 참고하여 사전에 개인정보 보호와 관련한 공법적 규제의 틀을 면밀하게 마련해놓을 필요가 있다고 생각한다.
디지털 시대에도 여전히 주권자이기 위해서는 깨어있어야 한다. 개인정보에 대한 권리와 주권을 지키는 문제에 있어서도 우리는 개별적으로 또 집단적으로 사전에 단단히 감시등을 켜두어야 자율주행자동차의 새로운 시대가 도래할 경우 편의를 누리는 동시에 기술이 초래할 위험을 방지할 수 있을 것이다.

영어초록

Concept of Automated Vehicle in the era of the fourth industrial revolution is transforming from the ‘vehicle’ that had its focal point in the hardware to the ‘portable computer’ that has its focus in the software that processes broad range of digital information. The phenomenon in one aspect is innovation through scientific technology. However on the other hand, it is raising humanistic, philosophical and legal questions about how human life will change according to the technological and industrial transition. Age of ‘Artificial Intelligence’ and ‘Posthuman’ emerging through the development of technology is creating new concept of human and bringing forward the issue of new danger that is occurring when reason and physical abilities thought as the essence of ‘human’ is being substituted by scientific technology and computer.
The advocates of automated vehicle assert that it provides more safety and convenience to human. Such argument cannot be completely be false, and I wish to reach the same conclusion eventually. However, as other process of introducing new technology like nuclear energy tell us, to consider whether automated vehicle is more convenient and better than the previous vehicle system and whether there are no new danger that new technology is bringing about or overlooked elements of danger is severely important. Therefore, if certain danger is expected, technological prevention should be devised as a first step, and for the sections where technology and industry is not self-regulating, it is legislations and policies' role to lead and force to a human-friendly direction.
Automated vehicle that is being discussed nowadays can be neutral itself and seem to be no more than a convenient device. However, since each automated vehicle is activated by entering massive amount of digital information and since it collects, stores, and distributes a welter of personal information when connected to Internet of Things(IoT), whole new danger from the previous era is created in terms of personal information and privacy.
The ironic reality of surveillance society since the modern times that has assured freedom of an individual on the one hand and has reinforced utilitarian society control on the grounds of fully protecting one's right and expanding welfare on the other lies beneath this near future. Especially, personal information is more being exposed and distributed and collection and surveillance of digital information is becoming easier in the information age. Automated vehicle system cannot be free from such exposure and danger of violating since it is operated with geolocation, video, and communication information as well. Moreover, since violation of personal information can lead to violation of privacy and human dignity, and damage the basic order of liberal democracy, arranging the frame of public regulation relating to personal information protection by researching U.S. and European Union legislation and seems more than necessary.
Being awake is what sovereign needs in the digital era. Likewise, to secure right to personal information, we should remember to turn the monitoring lamp on in advance not only as an individual, but also as a group in order to obtain convenience and prevent danger of new era of automated vehicle.
