4차 산업혁명과 경제법의 동향 (The Fourth Industrial Revolution and Competition Law)

초록

종래 1차, 2차, 3차 산업혁명이 사람의 손과 발을 기계가 대체하여 자동화를 이루고, 연결성을 강화하여온 과정이었다면, 4차 산업혁명은 이에 더하여 인공지능의 출현으로 사람의 두뇌를 대체하는 시대의 도래를 의미한다. 이는 경제적으로나 사회적으로 심각한 변화를 가져오는 전환점이 될 것으로 전망되어 많은 기대와 우려를 낳고 있다.
우리나라는 4차 산업혁명이 가져오는 여러 변화와 관련하여 정부 차원에서 여러 대책 마련을 서두르고 있는데, 경제법 분야와 관련하여 공정거래위원회는 2019년 업무추진방향에 있어서 5대 기업정책 관련 역점과제중 하나로서 “혁신경쟁이 촉진되는 산업생태계 구축 뒷받침”을 내세워 4차 산업혁명에 대비한 정책 마련에 고심하고 있다.
한편, 경제법은 4차 산업혁명 시대를 맞아 전통적인 경제법 분석의 원칙과 틀을 그대로 유지할 것인지, 아니면 다른 법률 분야로부터 추가적인 요소를 도입할 것인가의 기로에 서 있는데, 최근 들어 전 세계적으로 디지털 경제(digital economy)가 기존의 경제질서에 대한 새로운 위협으로 작용할 수 있는 요소는 무엇이며, 입법적으로 해결할 수 있는 부분은 어떤 것인지에 대한 활발한 논의와 연구가 본격적으로 전개되고 있다.
이러한 흐름 속에서 우리나라 공정거래위원회는 2018년 11월, 「독점규제 및 공정거래에 관한 법률」 전부개정안을 마련하면서 4차 산업혁명에 따른 경제법 현대화 방안을 모색하고, 혁신생태계 구축 및 신산업 분야 집행 역량 제고를 위한 내용을 개정안에 반영한 바 있으며, 잇따라 여러 의원안들이 제출되고 있다. 정부제출안을 비롯한 변경된 기업결합 심사기준 등은 이러한 사전검토와 준비과정을 거쳐서 마련된 첫 변화의 움직임이라는 점에서 의의를 찾을 수 있으며, 4차 산업혁명으로 새롭게 나타나는 경쟁제한 행위유형 및 수단을 분석하고 공정거래법 개선안을 마련하는 것은 신산업에 대한 이해를 바탕으로 적절한 사후규제를 펼치기 위한 준비작업이라고 볼 수 있다. 이와 같은 입법적인 노력뿐만 아니라 선제적인 혁신시장 분석과 경쟁촉진의 노력이 지속되어야 자유롭고 공정한 경쟁을 통하여 후속 혁신을 장려하려는 경제법의 궁극적인 목표가 달성되고, 새로운 시장의 작동이 원활해지는 선순환이 이루어질 수 있을 것이다.

영어초록

The previous three industrial revolutions are perceived as the process of replacing human labor with machines, namely the automation. By contrast, the incoming fourth industrial revolution is the advent of the time replacing human brains with artificial intelligence. The fourth industrial revolution is expected to be a turning point that brings about significant socio-economic changes, resulting in variety of optimistic anticipations and pessimistic concerns.
Regarding the various changes brought by the fourth industrial revolution, Korea, at the government level, is in a hurry to prepare numerous measures, policies, and plans. In competition law area, the Korea Fair Trade Commission(KFTC) is striving to formulate policies for the fourth industrial revolution by emphasizing “the establishment of an industrial ecosystem that promotes innovative competition.” This is one of the five major corporate policy priorities in the KFTC’s work directions in 2019.
In the era of the fourth industrial revolution, competition law stands at the crossroads of whether to keep the principles and frameworks of traditional competition law analysis in place, or to adopt additional elements from other legal areas. Recently, around the world, discussions and research have been actively underway on what factors can pose new threats to an existing economic regime and what legislative solutions can be suggested.
Against this backdrop, the KFTC introduced the revised bill in November 2018, seeking to modernize the competition law in the adequate context of the fourth industrial revolution. The revised bill establishes an innovative ecosystem and enhances the ability to promote new industries. In addition, a number of bills proposed by lawmakers have been submitted. The revised standards for the review of business combinations, including the government submission, are meaningful in that they are the first movement prepared through a pre-review and preparatory process. In the wake of the fourth industrial revolution, new types and means of restricting competition emerged. Analyzing this phenomenon and coming up with a plan to improve the Fair Trade Act can be seen as a preparation to implement adequate follow-up regulations based on the understanding of new industries emerging in the fourth industrial revolution. Such legislative efforts, as well as preemptive innovative market analysis and efforts to promote competition, should continue. As a result, it can be anticipated that the ultimate goal of competition law, namely encouraging subsequent innovation through free and fair competition, can be achieved, and a virtuous cycle of smooth operation of new markets can be accomplished.
