중고상품 온라인 직거래의 법적 정비 방안 (Legal Improvement on the Online Direct Transactions of Used Commodity)

초록

온라인 중고상품 직거래란 컴퓨터ㆍ휴대폰ㆍ모바일 기기 등 다양한 인터넷 접속 장치를 이용하여 사이버 공간에서 개인 혹은 업자들이 직접적으로 행하는 중고상품의 매매ㆍ교환 등 여러 형태의 거래를 말한다. 인터넷 거래의 발달과 함께 온라인 중고상품 직거래는 그 규모가 크게 늘어났는데, 이와 함께 구매자와 판매자 사이에 분쟁이 자주 발생하고 있다. 또한 판매자의 직거래 사기로 인한 구매자의 피해 건수가 늘어나고 있으며, 매년 그 피해액도 크게 증가하고 있다. 이에 따라 온라인 중고상품의 직거래 관련 분쟁의 해결과 직거래 사기로 인한 피해의 구제가 사회문제로 나타나고 있다.
온라인 중고상품의 직거래는 개인 판매자와 구매자 사이의 일반 계약의 범주에 속하는 거래라는 특성으로 파악된다. 온라인 중고상품 직거래를 규율하는 개별 법규정을 두지 아니하고 일반법인 민사ㆍ형사상의 계약 일반에 따른 손해배상 그리고 사기죄의 범주에서 처리되고 있다. 그러나 민법이나 형법 일반에서의 손해배상이나 형사처벌은 소송의 제기나 고소ㆍ고발 혹은 진정 등 그 법적 절차가 복잡하다. 또한 실제로 구제가 이루어지기까지 오랜 시간이 걸리며, 가해자의 무자력 등으로 피해보상이나 배상이 제대로 이루어지지 못하는 경우가 허다하다.
온라인 거래이므로 「전자상거래 등에서의 소비자보호에 관한 법률」(이하 「전자상거래소비자보호법」이라 함)상 거래 안전에 관련된 제도의 적용을 고려해 볼 수 있지만, 「전자상거래소비자보호법」은 통신판매업자나 통신판매중개자의 의무일 뿐 중고상품을 온라인 직거래 형식으로 판매한 개인 판매자에게 적용되지 아니한다. 온라인 중고상품 직거래의 거래 건수의 증가나 거래액 증가에 따른 사기피해액의 규모로 볼 때에, 동 거래를 더 이상 개인 사이의 자율적 계약 규율에 맡겨 놓는 것은 바람직하지 않다. 정상적으로 온라인 중고상품 직거래가 이루어지도록 하기 위해, 직거래 분쟁을 조정하며 직거래 사기 시에 피해자를 보호할 수 있도록 하기 위한 법규와 제도를 정비할 필요가 있다.
이에 본 논문에서는 온라인 중고상품 직거래 분쟁 또는 사기를 예방하거나 규제와 관련하여 아래와 같은 내용의 입법과 법제도의 정비를 행할 것을 제안한다. 즉 온라인 중고상품 직거래의 경우, (1) 「전자상거래소비자보호법」상 통신판매업자나 통신판매중개자에 부과되고 있는 거래정보 제공의무나 구매안전서비스 제공 등의 의무를 인터넷 장터나 게시판 운영자에게도 부과하도록 하고, (2) 「전기통신금융사기 피해 방지와 피해금 환급에 관한 특별법」상 보이스피싱에 적용되도록 하는 지급정지 제도를 온라인 중고상품 직거래 사기에도 적용하도록 하며 또한 (3) 종래 전자문서및전자거래분쟁조정위원회 혹은 소비자분쟁조정위원회 그리고 경찰 또는 법원 및 피해공유사이트 등 흩어져 있는 온라인 중고상품 직거래 사기나 분쟁 해결을 위한 기관을 일원화하여 신속하고 정확하게 대응 구제받도록 할 것과 (4) 온라인 중고상품 직거래 사기에 대한 처벌을 강화하고 형벌을 신설하고, (5) 직거래 피해에 대한 신속하고 충분한 손해배상이 이루어지도록 배상명령 신청 제도를 온라인 중고상품 직거래 사기의 경우에도 적용하도록 하며, (6) 온라인 중고상품 직거래 사기 가해자 정보의 공시 및 열람 요청제도를 마련하여 사전에 정보제공을 통해 직거래 피해자가 사기 거래의 가능성 여부를 판단할 수 있도록 하는 제도를 입법화할 것을 제안한다.

The On-line direct transactions of Used Commodity refers to various forms of used commodities traded by individuals or vendors directly in cyberspace using various Internet access devices. With the development of Internet transactions, the size of direct online commodity direct transactions has greatly increased. In addition, disputes frequently arise between buyers and sellers. Also, the number of buyers' damage caused by direct dealing fraud of sellers is increasing. The amount of damage is also increasing every year. As a result, the settlement of disputes related to direct transactions of used commodity online merchandise and the relief of damage caused by direct deal fraud are emerging as social problems.
Direct transactions of online used commodities are characterized by transactions that fall under the general contract category between the individual seller and the buyer. There is no individual law regulation governing direct online commodity direct transactions. The Compensation for damages is based on general contracts in civil law, and this is a fraud in criminal law. However, the compensation of damages and criminal penalties in civil and criminal law are complicated. It also takes a long time to actually get relief.
There are many cases in which damage compensation or compensation can not be properly performed due to the unauthorized use of the perpetrator. There are many cases in which damage compensation can not be properly performed due to the no-capital of the perpetrator.
Since it is an online transaction, it is possible to consider the application of the system related to transaction safety in the "E-Commerce Consumer Protection Act". But the "Electronic Commerce Consumer Protection Act" is a duty of a telecommunications distributor or intermediary. But not to individual sellers who sell used goods in online direct transactions. In view of the amount of fraud damage caused by an increase in the number of transactions or the increase in the amount of transactions in direct online used commodity, it is not desirable to leave the transaction to autonomous contract rules between individuals. It is necessary to regulate laws and systems to ensure that direct online commodities are directly traded, direct deal disputes are coordinated, and victims are protected in direct deal fraud.
In view of the amount of fraud damage caused by an increase in the number of transactions or the increase in the amount of transactions in direct online used merchandise, it is not desirable to leave the transaction to autonomous contract rules between individuals. In order to ensure that direct online purchase of used goods is done normally, it is necessary to adjust regulations and systems to coordinate direct deal disputes and protect victims in direct deal fraud.
In this paper, we propose to improve legislation and legal system as follows. (1) Impose obligations such as provision of transaction information or provision of purchase safety service (ESCROW) to the internet marketplace or bulletin board operator. (2) The payment suspension system should also be applied to the online used goods direct dealing. (3) Must be unify several institutions for online fraud or direct transaction fraud or dispute resolution. (4) It must strengthen punishment for online used goods direct deal fraud, establish punishment legulation. (5) The compensation order application system should also be applied to the case of online used goods direct deal fraud. (6) It is proposed that legislation should be enacted so that the direct victims can determine the possibility of fraudulent transactions by providing information in advance on the disclosure of online fraudulent goods and online fraudulent information.
