초록

국민은 국가권력구조의 개편을 위한 헌법개정보다는 사회적 논란이 야기되고 있는 현행헌법의 문제점을 개선하고 재정립하여 불필요한 사회적 갈등을 해소하는 헌법개정을 원하고 있다. 헌법개정을 하려면 국민들의 다양한 의견과 요구를 수렴하고 국민의 의사가 개헌안에 반영되어야 한다. 그리고 개헌이 정당화되기 위해서는 먼저 개헌의 필요성에 관한 국민적 합의가 전제되어야 한다. 그 국민적 합의가 도출되지 않은 상황에서 정치권에서 개헌안을 발의하는 것은 정당화되기 어렵다. 그래서 개헌논의의 공론화를 통한 국민적 합의의 도출을 위해서는 정당, 학계, 언론기관 그리고 시민단체들이 여론조사와 공청회 그리고 토론회를 개최하여 공론화 과정에 능동적으로 참여해야 한다. 헌법개정의 민주적 정당성을 확보하기 위해서는 국회가 주도하여 개헌안의 발의가 이루어져야 할 것이지만, 그 과정에 국민의 활발한 참여가 보장되어야 하는 것이 중요하다.
필자는 정보기본권과 저항권, 정부형태 그리고 대통령의 임기에 관하여 헌법개정을 해야 한다고 생각한다. 구체적으로 말하면 정보기본권은 정보이용자의 보호를 위해 고려될 수 있는 기본적 권리이고 새로운 기본권이다. 정보이용자들은 문화적 참여권 등의 문화적 기본권을 누리게 되기 때문에 정보이용자들은 적극적으로 국가에 대해 문화적 기본수요에 대한 충족을 요구할 수 있는 근거를 보유하고 있다. 그리고 필자는 정보기본권이 헌법상의 권리로 규정되어야 한다고 생각한다.
또한 필자는 헌법 제1조 제3항을 신설하여 국가권력이 헌정질서를 위협할 정도로 침해가 있고 침해받은 2인 이상의 국민이 있는 경우에 모든 국민은 다른 구제수단이 불가능할 때에는 국가권력에 저항할 권리를 가진다 라고 저항권을 규정하는 것이 타당하다고 생각한다.
현행헌법의 제일 큰 문제점은 대통령제 정부형태를 취하고 있으면서도 대통령제의 장점을 발휘할 수 없게 되어 있다는 점이다. 그리고 대통령 단임제는 과거와 같은 1인 장기집권의 폐해를 방지하는 면에서는 순기능적이지만 조기 레임덕 현상으로 안정적인 국정수행이 어렵게 된다. 또한 국정의 연속성 및 유기적 운영 그리고 책임정치의 구현이라는 측면에서도 재임의 가능성을 열어놓아야 한다. 특히 집권여당이 국회의 소수당일 때 대통령단임제의 권력행사가 얼마나 제한되며 소모적이 될 수 있는지는 우리가 잘 경험한 바이다. 현재 우리나라의 대통령의 임기를 규정한 헌법 제70조는 대통령의 임기는 5년으로 하며, 중임할 수 없다. 라고 규정되어 있는데, 필자는 이러한 대통령의 단임제는 국정의 연속성, 책임정치의 구현을 실현하기가 어렵기 때문에 대통령의 단임제의 채택여부에 관해서 강력히 문제를 제기하는 바이다. 필자는 대통령의 임기를 5년 단임제에서 4년 중임제로 개헌하는 것이 고려되어야 한다고 생각한다.
만약 우리나라가 헌법개정이 필요하다면 지금까지 나온 헌법개정안을 분석하고 새로운 외국법을 참조하여 앞으로의 국가발전을 위하여 국회는 헌법연구를 해야 한다. 그리고 헌법개정을 해야 한다면 국회가 중심이 되는 헌법을 만들어야 할 것이요, 제4차 산업혁명에 적합한 헌법을 개정해야 할 것이다.

What people want is not the revision which solve the problem of the constitution in force which causes social controversy, resolving unnecessary social conflict in order to amend the Constitution.
However, what people want is not the revision of the Constitution for restructuring state power system, but the revision which solve the problem of the Constitution in force which causes social controversy, resolving unnecessary social conflict. In order to amend the Constitution, various opinions and demands of the people should be collected and the will of the people should be reflected in the constitution. In order for the amendment to be justified, a national consensus on the necessity of amendment should be premised. It is difficult to justify the proposal for a constitutional amendment in the political circle in the absence of national consensus. Therefore, political parties, academics, media organizations, and civic groups should hold public opinion surveys, public hearings and debates to actively participate in the process of public debate in order to draw public consensus through the public discussion of the constitutional debate. In order to secure the democratic legitimacy of the amendment of the Constitution, the National Assembly should initiate the initiative of the constitutional amendment proposal, but it is important that active participation of the people is guaranteed in the process.
Writer thinks that the Constitution should be revised with respect to the fundamental right of information, right of resistance, a form of government and presidential term. To put it concretely the fundamental right of information is a fundamental right that can be considered for the protection of information users and it is a new fundamental right. Since information users enjoy cultural fundamental rights such as cultural participation rights, information users have a basis for actively demanding the fulfillment of basic cultural needs of the nation. And writer thinks that the fundamental right of information should be defined as constitutional rights.
In addition writer thinks that if there are two or more people whose powers are violated and whose two or more people are violated by the establishment of Article 1 paragraph 3 of the Constitution, all people have the right to resist state authority when it is impossible.
The main problem of the current Constitution is that it can not take advantage of the presidential system while taking the form of the presidential system. And the president's single - term system is purely functional in terms of preventing the abolition of long - term power such as the past, but it is difficult to carry out stable government due to premature lame duck phenomenon. In addition, the possibility of reappointment should be opened in terms of continuity of state affairs, organic operation, and implementation of responsible politics. In particular, we have experienced how limited and unnecessary the exercise of the power of the unilateral presidency can be when the ruling party is a minority party of the National Assembly. Article 70 of the Constitution, which prescribes the term of the President of the Republic of Korea, stipulates that the term of the President shall be five years and that it can not be redeemed . It is difficult to do so, and it poses a serious problem.
Writer thinks the reform of the president 's term from a five - year term to a four - year term should be considered. In addition, the current lawmakers' right to unblock is recognized, but if the case is bound by the consent of the National Assembly and is bound by the court, the authority shall be suspended until a final judgment is reached.
If Korea needs to revise the Constitution, the Constitutional amendment should be analyzed and the Constitutional Law should be studied by the National Assembly for the future development of the nation by referring to the new foreign law. And a constitutional amendment is to be made, the Constitution should be made central to the National Assembly, and the Constitution suitable for the fourth industrial revolution should be revised.
