중대재해처벌법 도입결정과정 분석과 법정책적 시사점 (Analysis of the decision-making process for Serious Accident Punishment Act and Legal Policy Implications)

초록

이 연구는 Kingdon의 다중흐름모형 분석 모형에 따라 중대재해처벌법 제정 과정에서 비합리적인 의사결정 과정을 분석하고 그로부터 정책적 시사점을 얻는 것이다. 분석결과, 우선 중대재해처벌법 제정에 필요한 세 가지 흐름이 형성되었다. ①중대재해발생의 객관적 지표 및 초점사건이 정부대책으로 이어지는 정책문제의 흐름(stream of problem)을 형성했다. ②정책대안의 흐름(stream of policy)도 지속되었다. ③NGO와 노동계가 중심이 되어 정치의 흐름(stream of politics)을 주도했다. 다음 이 법 도입 성공요소인 정책선도가(policy entrepreneurs)는 단식으로 법 제정을 촉구한 김미숙 대표와 정부･여당에 법 제정 동력을 부여한 문재인 대통령으로 분석된다. 마지막으로 정책흐름과 정책선도가의 기능이 단기간 내에 순간적으로 결합(coupling)하여 정책의 창(policy window)을 통과하게 된 것은 법을 주도한 당시 여당에게 유리했던 제21대 국회의 구조와 정부의 신속한 후속 조치로 분석될 수 있다.
한편 중대재해처벌법 제정과정의 비합리적 의사결정 과정 분석은 국내 정책도입에 필요한 시사점을 준다. ①이 법에 대한 찬반양론이 극명하게 대립함에도 정책의 흐름과 정책선도가 등의 부재로 법개정을 위한 정책의 창은 열리기 어렵다. ②여론에 반응하는 정치적 결정으로 이루어진 중대재해처벌법은 경영책임자 처벌 법리나 재해 예방 목적 등과 관련한 합리적이고 전문적인 공론과정을 충분히 거쳤다고 보기 어렵다. 이 때문에 법시행에서의 정책리스크를 배제할 수도 없으므로 시행과정에서 충분한 보완 노력이 필요하다.

영어초록

This study is to examine the irrational decision-making process for Serious Accidents Punishment Act through Kingdon's multiple stream framework, and to obtain policy implications from it. As a result of the analysis, three streams necessary for the enactment of Serious Accidents Punishment Act were formed. First of all, objective indicators and focal events of the serious accidents formed the stream of problem leading to government measures. Secondly, the stream of policy also continued. Thirdly, the influence of NGOs and the labor unions led the stream of politics.
It is analyzed in sequence that the policy entrepreneurs, a factor in the success of the introduction of this Act, is Kim Mi-sook, NGO leader, who urged the enactment of the Act by fasting, and President Moon Jae-in, who gave the government and the ruling party the crucial power to enact the Act.
Lastly, it can be analyzed as the 21st National Assembly, which was advantageous to the ruling party, and the rapid follow-up measures of the government led the policy outputs by momentary coupling three policy streams and the role of policy entrepreneurs within a short period of time.
On the other hand, the analysis of the irrational decision-making process of the enactment of the Serious Accidents Punishment Act gives the necessary implications for the introduction of domestic policies.
Firstly, although the pros and cons of this law are sharply opposed, it will be difficult to open a policy window for law revision due to the lack of policy streams and policy entrepreneurs. Also, it is hard to say that the Serious Accidents Punishment Act has gone through reasonable and professional public discussion process related to the punishment of business managers and the purpose of preventing disasters since it was led by political decisions that responded to public opinion. For this reason, policy risks cannot be excluded from the enforcement of the law, therefore, sufficient complementary efforts will be required during it’s execution.
