한국에서의 회복적 사법 ‘피해자-가해자대화모임’시범운영 사례 (A Trial Operation Case of the‘Victim-Offender Dialogue’)

초록

2006년~2008년 평화여성회 갈등해결센터는 한국형사정책연구원과 함께 회복적 사법이라는 새로운 소년사법 대응모델을 기반으로 학교폭력 문제를 비롯, 청소년 범죄 해결의 한국적 모델로써 ‘가족회합(Family Group Conferencing)’의 절차매뉴얼을 개발하고, 그 현실적 적용가능성과 타당성을 평가하기 위한 실험연구를 진행하였다. 회복적 실천모델로 채택한 가족회합(FC)모델은 기본적으로 피해자 및 가해자 가족성원을 포함하여 조정(mediation) 방법을 이용하는 접근법으로서, 범죄로 인한 정신적․물질적 피해를 배상하기 위하여 피해자와 가해자를 능동적으로 참여시킨 ‘회복적 갈등해결과정’을 제시하여 피해자와 가해자에게 위반 사안을 논의하고, 자신들의 의문점에 해답을 얻게 하며, 자신의 감정과 느낌을 표출하고, 나아가 사건의 종결감을 얻을 수 있는 기회를 제공하는 것, 죄로 인해 야기된 피해를 다루기 위한 상호수용 가능한 계획을 발전시킬 수 있는 기회를 피해자와 가해자에게 제공한다는 점에 그 목적이 있다.
2007년 경찰단계에서 대화모임 시범실시는 기간 중 총 6건이 진행되었는데, 6건 모두 당사자간 합의를 이루었다. 대화모임 참여자들은 전반적으로 긍정적으로 평가하고 있으며 대화모임이 피해자의 신체적, 정신적 손상을 회복하는 데 장점을 가지며, 학교 폭력 및 청소년 범죄를 다루는 새로운 대안으로서 가치가 있음이 입증되었다고 판단된다.
2008년 법원단계 실험연구에서는 사건발생 후 상당한 기간이 경과한 후에 실행되었다는 점에서 회복적 사법 실천모델 개발에서 미처 예상하거나 고려하지 못한 많은 현실적 문제점과 쟁점들이 제기되었다. 특히 문제해결과정에서 양측 간 불신이 증대하면서 이제 소년들의 감정보다는 보호자들의 감정과 이해관계의 해소가 더 중요한 쟁점이 되었다. 보호자들이 분쟁해결 과정에서 주도권을 가지면서 소년들이 아닌 서로 상대 보호자를 갈등 또는 협의의 대상으로 보게 되면, 가해소년의 책임인지와 행위개선을 이끌어 내는 목표를 상대적으로 소홀하게 취급할 가능성이 발생할 수 있으므로, 소년단위 및 보호자단위 소모임을 예비조정 및 본 대화모임과정에서도 단계적으로 실행해나가는 다중적 접근방법이 필요하다. 또한 법원단계에서는 피해배상에 대한 관심이 높아지므로 피해자-가해자 당사자간에 자율적으로 배상과 관련한 문제해결을 도모하고, 사건 종결이후에 가해자와 피해자 당사자들이 겪게 되는 경제적인 어려움을 방치함으로써 발생할 수 있는 잠재적 갈등과 분쟁을 방지하기 위해, 합의를 위한 소액대출 또는 범죄피해 공적부조제도의 마련이 필요하다고 판단된다.
뿐만 아니라 합의 내용의 이행보장을 위한 사후절차와 모니터링제도가 구체적으로 마련되어야 있어야 하며, 가능한 대안적 처우선택지들을 미리 준비하는 것도 필요할 것으로 보인다. 또한 교육과 훈련을 통한 전문 조정인력의 양성은 제도의 현실화에 필수적인 조건이며, 진행과정에 있어서의 제도적 개선방안과 더불어 회복적 사법제도가 지속가능하게 발전하고 실천되기 위해서는 지역사회의 관심과 지지 그리고 참여가 이루어져야 한다.

영어초록

From 2006 to 2008, Women of Peace Dispute Resolution Center worked with Korean Institute of Criminology on Restorative Justice, carrying out a study on evaluating the applicability and validity of the Family Group Conferencing procedure manual which was developed as means to resolve juvenile delinquency in a Korean way including the school-based crimes, based on a new juvenile justice system called Restorative Justice. The so-called FC model which was selected as the model of restorative action practice, basically utilizes the scheme of mediation that includes the victim and the family of the offender. It proposes the “Restorative Dispute Resolution Process” in which the victim and the offender proactively participate for the reimbursement of mental and material damages, by having discussions of violations, receiving answer to questions each parties may have to the other, projecting emotions and feelings, and eventually having the opportunity to come to a closure on the case concerned. It also offers the chance to process on plans which can be acknowledged by both the parties regarding issues surrounding the damages caused by the crime.
6 cases were carried out during the test phase of the victime-offender dialogue at the police level, and in all of the 6 cases the parties had succeeded in reaching an agreement. Participants in the dialogue meeting evaluated it a positive measure, has an upside in recovering the mental and physical damages, and has confirmed that it could rise as the new alternative in settling school-based crime and juvenile delinquency.
From the 2008 study carried out at a court level, several issues and problems were raised which were unexpected or were not in consideration at the development stage of the Restorative Justice. In particular, as the distrust between the parties grew during the settlement process, the emotions of the guardian and serving the guardians’ interest became more of an issue rather than those of the adolescents. There needs to be a multiple step procedure that could process meetings step by step in small groups comprised of only guardians and small groups of adolescents during the pre-mediation and actual dialogue meetings, since the goal of reaching awareness of liability and improvement of actions from adolescents could be set aside if the guardians view the opponent party’s guardian as the sole target of mediation and dispute.
In addition, promoting the settlement of dispute surrounding the compensation agreement between victim and the offender is needed as there is a growing interest of reimbursement at the court level, as well as arranging of small loans and public funding for victims of crime in order to prevent the economic hardships the victim and offender could go through after the closing of the case.
Moreover, monitoring system and post-procedure for the guarantee of the agreement execution must be set out specifically, and alternative options should be prepared if possible. Also, cultivating professional mediator human resource through education and training is an essential factor, as well as the interest, participation, and the support of the community needed in order for the improvement of the system along with the restorative justice to continuously grow and put into action.
