헌법의 기본원리, 기본질서 및 제도의 관계에 관한 일고찰 (A Study on the Relationship between the Basic Principle, Basic Order and Institutions of the Constitution)

초록

헌법의 기본원리는 헌법을 전체적으로 지배하는 지도원리로서, 첫째, 헌법의 각 조항과 모든 법령의 해석기준이 되며, 둘째, 입법권의 한계와 국가의 정책결정의 방향을 제시하며, 셋째, 국가와 국민이 존중하고 준수해야 하는 최고의 가치규범이며, 넷째, 헌법개정의 금지대상이 된다. 헌법의 기본원리로는 국민주권주의, 권력분립주의, 자유민주주의원리, 사회국가원리, 문화국가원리, 법치국가원리 및 평화국가원리 등이다. 헌법의 기본원리는 헌법현실에서 헌법질서와 헌법상의 제도에 의하여 구체화되고 적용된다. 특히 자유민주주의원리, 사회국가원리 및 평화국가원리 등은 규범내용의 추상성의 문제로 인하여 헌법의 기본질서와 헌법상의 제도에 의하여 구체화하고 명확히 하여 적용하게 된다.
자유민주주의원리는 헌법상에 직접 규정을 두고 있는 정치적 영역에서의 기본질서로서의 민주적 기본질서에 의하여 구체화되고 기본질서는 또한 주권자인 국민의 정치생활에 직접 영향을 미치는 정당제도에 의하여 더욱 구체화된다. 자유민주주의원리, 민주적 기본질서 및 정당제도는 그 적용과 구체적 실현에 있어서 3가지의 연결된 틀로 구성되어 상호 호환적이고 보완적이게 되어 보다 완결된 형태의 규범실현을 이루게 된다.
사회적 약자의 배려와 사회적 정의의 국가적 실현을 목적으로 하는 헌법의 기본원리로서의 사회국가원리는 경제적 영역에서의 기본질서인 사회적 시장경제질서에 의하여 그 이념적 성격을 탈피하여 보다 구체적인 형태로 실현되며, 경제민주화의 근거가 되는 사회적 시장경제질서가 재산권보장 등의 헌법규정에 모순이 없도록 하는 재산제도에 의하여 기본권자인 국민의 자유와 권리를 보장하게 된다. 즉 경제의 민주화는 헌법상에 보장된 사유재산제를 넘어서는 방식으로 적용되어서는 안 되는 것이다.
평화실현의 의지를 구현하고자 하는 평화국가원리는 한 나라를 넘어 국제관계에서의 작용되는 것이므로 이에 대한 국제적 영역에서의 헌법의 기본질서가 바로 평화주의적 국제질서이다. 평화는 궁극적으로 국가안전보장과 국토의 방위를 통하여 이루어진다는 점에서 군사제도에 의할 수밖에 없다. 헌법에 군사제도를 두는 것은 국가안전보장과 국토의 방위의 목적을 이루기 위한 것이다. 군사제도는 평화주의적 국제질서를 유지하기 위한 것이고 이를 통하여 국가의 평화국가원리의 실현이 가능한 것이다. 헌법의 기본원리는 헌법의 기본질서와 연계하여 더 구체화되는 것이고, 헌법의 기본질서를 다시 헌법상의 제도를 통하여 보다 구체화되어 적용되는 것이라는 점에서 원리-질서-제도의 연결구도 속에서 규범내용을 규명하는 것은 중요한 것이다.

영어초록

The basic principle of the constitution as a guiding principle governing the constitution as a whole, firstly becomes interpretation standard of each clause and all legislations of the constitution, secondly, suggests limitation of legislative power and direction of national policy decision, thirdly, is the highest values and norms nation and the people respect and keep, and fourthly, is the object of prohibition of an amendment of the constitution. As the basic principle of the constitution, the sovereignty of people, the separation of power, the principle of liberal democracy, the principle of social state, the principle of cultural state, the principle of constitutional state, and the principle of peaceful state, and etc., can be mentioned. Especially, the principle of liberal democracy, the principle of social state, and the principle of peaceful state are to be specified and clarified by the basic order of the constitution and institutions on the constitution and then are applied due to the issue of abstractness of the content of norms.
The principle of liberal democracy is specified by the democratic basic order as the basic order in political areas directly defined in the constitution and the basic principle is also further specified by the political party system which directly impacts on a political life of the people, the sovereigns. The principle of liberal democracy, the democratic basic order, and the political party system achieve realization of norms in a much complete form as they become mutually compatible and complementary by being composed with three connecting structures in their application and specific realization.
The principle of social state as the basic principle of the constitution aiming at considering the socially marginalized and national realization of social justice is actualized in a specific form by escaping from the ideological character by the social market economic order which is the basic order in economic areas and guarantees freedom and rights of the people who are the ones holding basic human rights by the property system which does not make conflict against constitutional regulations such as the social market economic order and etc., which are the ground of economic democracy. Namely, democracy in economy must not be applied in a way of going beyond the private property system which is guaranteed by the constitution.
Since the principle of peaceful nation which actualizes the will of realization of peace works in international relationships which go beyond one nation, the basic order of the constitution in international areas concerning this is a pacificistic international order. Peace is done by the military system in that peace can be ultimately achieved through national security and defense of the land. Putting the military system in the constitution is to achieve for the sake of national security and defense of the land. The military system is to maintain the pacificistic international order and the realization of the principle of peaceful state in nation can be possible through it. The basic principle of the constitution is further specified in link to the basic order of the constitution and it is important to define the content of norms in the connecting structure of principle-order-institution in that the basic order of the constitution is much specified again and then it is applied through institutions on the constitution.
