합리적인 자치경찰법안에 관한 연구 (The Study On The Rational Bill Of Municipal Police System)

초록

본 논문의 연구 목적은 이명박 정부 이전에 논의되어 온 자치경찰제도 도입에 따른 주요 쟁점사항들 중 노무현정부의 「자치경찰법안」의 내용과 현재 시행중인 제주자치경찰 실태를 고찰함으로써 향후 자치경찰제를 실시할 때 예상 문제점을 도출하여 합리적인 자치경찰제 시행 방안을 강구시 고려해야 할 사항들을 검토하였다. 검토 결과 첫째, 자치경찰조직이 정당공천을 받는 기초자치단체장산하의 직속기관으로 설치되고 독임형 감독형태를 띠는 형태 하에서는 경찰의 정치적 이용 및 공정한 법집행상의 문제점이 야기될 수 있다. 둘째, 기초 자치단체 단위의 자치경찰제는 광역적인 치안행정수요에 효과적 대응이 곤란한 점이 많다. 셋째, 장기간 동안 근무하는 자치경찰공무원과 지역유력인사등과의 유착으로 인한 폐해, 국가경찰과 자치경찰간의 인사교류상의 문제, 적은 규모의 자치경찰대 운영으로 자치경찰공무원의 승진 적체 등이 예상된다.
자치단체별로 재정자립도의 편차가 크기 때문에 자치경찰제의 선택적 실시시 재정자립도가 취약하여 자치경찰제가 시행되지 않는 지역주민들의 상대적 박탈감이 심화될 수 있다. 위와 같은 미시적 차원에서의 문제점 외에 현재의 지방자치제도의 정착상태, 사회적 민주화의 정도, 우리의 정치 수준, 경찰.검찰 등의 형사 사법체계의 권한분배 및 균형정도, 자치단체장들의 능력과 청렴성 정도 등 자치경찰제 실시에 영향을 미치고 있는 환경적 요인들을 진지하게 검토하여 향후 적실성이 있는 자치경찰 시행 법안이 마련되어야 할 것이다.

영어초록

This research aims to compare the major issues regarding the implementation of the municipal police system, which has been announced previous to the Lee Government, with the ‘to-be-legislated’<Self-Governed Police System Law>, find the problems that may arise when this new system is implemented, and examine the points the be considered in order to practice the system rationally. As a result, first, as long as the municipalpolice force is under the command of the head of the basic local self-governing body, who becomes publicly nominated by the political manipulation of the independently supervised, issues such as the political manipulation of the police force, and the impartial enforcement of the law may rise. Thus, it would be crucial to formulate measures to prevent the political parties from publicly nominating the local self-governing body' heads, reinforce the democratic restriction of the local residents, and to enable efficient supervision and management of the national police. Secondly, the municipalpolice system based on local self-governing bodies has many difficulties in following up with the large scale of public security demand, and the residents mat get confused due to the discordance between the residential units and administrative districts. Thirdly, problems such as abuses due to the conglutination of the municipal police force and local potentates, personnel exchange problems between the national and municipal police, and the delay of local government officials due to the small scale of the municipalpolice force can be predicted.
Since the financial independence of each local government widely differ, the sense of comparative deprivation of residents the local communities where the municipal police system cannot be implemented due to financial deficiencies may deepen, if this new system is to be selectively implemented based on each local government's finance. Along with the microscopic problems mentioned above, environmental factors that influence the implementation of the municipal police system, such as the local self-governing body system's stare of settlement, the degree of social democracy, our political level, the power distribution and balance of law enforcement systems such as the police and the prosecution, the ability and cleanness of the heads of local governments must be thoroughly examined to formulate a proper and practicable system.
