국가정보원 진실위원회 활동에 대한 평가 (An Evaluation on the Activities of NIS Development Committee for Clarifying the Past)

초록

이 글은 학술적인 논문이라기보다 오히려 국가정보원 진실위원회 활동을 끝내면서 발간한 종합보고서 「과거와 대화 미래의 성찰」의 소개와 개괄적 평가를 하고 있는 일종의 보고서이다. 국가기관 스스로 과거의 잘못을 반성적 차원에서 청산하고자 하는 취지에서 출범한 국정원 진실위는 지난 2004년 11월 시작하여 2007년 10월 그 활동을 마감하였다. 진실위에 민주법연 회원의 한 사람으로서 참여한 필자는 국가기관 특히 최고의 권력기관인 정보기관에서 자기고백식의 과거청산을 한다는 것 자체가 의미가 있는 일이지만, 그 활동과정이 그렇게 순탄한 것은 아니었음을 먼저 밝혀 둔다.
이 글의 내용은 우선 진실위의 성립과정과 활동상황의 개요를 살펴보고, 다음으로 진실위가 1차적으로 다루었던 7개 중요사건들의 조사결과를 요약하였다. 7개 중요사건은 부일장학회 및 경향신문 강제 매각 사건, 인혁당 및 민청학련 사건, 동백림 사건, 김대중 납치 사건, 김형욱 실종 사건, KAL858기 폭파 사건, 남조선노동당 사건 등이다. 1차 조사 결과 그래도 중요한 의미를 가진 것은 인혁당 사건의 조사 결과가 재심을 이끌어내는 계기가 되었고, 재심의 결과 무죄 판결을 받고 또한 상당한 액수의 국가배상을 받아내게 하였다는 점일 것이다.
1차 개별사건의 진실규명의 한계를 인식한 진실위는 2차 조사에서는 개별사건의 한계를 뛰어 넘어 과거 중앙정보부 또는 국가안전기획부가 한국사회의 모든 분야에 대한 통제와 개입을 하여 왔다는 사실을 전제로, 시간과 인력의 한계상 6개 분야를 설정하여 그 구체적인 탄압사례들과 통제방식, 그리고 나아가 통제기제에 이르기까지 포괄적이긴 하지만 체계적인 진상 규명을 하고자 노력하였다. 6개 분야는 정치, 사법, 언론, 노동, 학원, 그리고 간첩 분야이다.
이 글의 상당 부분은 이상과 같은 조사활동의 결과에 대한 평가로 이루어졌다. 진실위 활동 자체가 가지는 역사적 의의, 진실위 활동 결과에 대한 긍정적인 부분과 문제점들에 대한 지적, 그리고 마지막으로 국가기관의 과거청산 활동 자체의 어려움에 대한 지적과 정보기관에 대한 민주적 통제의 필요성을 지적하고 있다.

영어초록

This article is not a dissertation, but an abstractive report on the activities of ‘National Information Service(NIS) Development Committee for Clarifying the Past’(referred to as “the NIS Truth Committee” or “the Committee”). The Committee started functioning in November, 2004 and closed in October, 2007, the mission of which was to clarify the past affairs that the former NIS[Korea Central Information Agency(KCIA) and Agency for National Security Planning(ANSP)] had done: the oppression of the people and abuse of the state power. After 3 years’ activities, the Committee published six-volume final report entitled ‘A Dialogue with the Past and Reflections on the Future’ containing the results of the Committee’s activities. These activities were carried out as one of the liquidations of the past in Korea.
In the first round of investigation, the Committee carried out fact-finding investigations concerning seven major dubious cases handled by NIS’s predecessors(i. e. KCIA and ANSP), which include: donation of the Booil Scholarship Foundation and forced disposal of the Kyunghyang Shinmun; the People’s Revolutionary Party and the Nationwide Democratic Students’ Association; the alleged espionage case involving Korean students in East Berlin; the kidnapping of Kim Dae-jung; the disappearance of ex-KCIA Director Kim Hyung-Wook; the case of KAL858 explosion; and the case of the South Korean Workers’ Party. In the second round of investigation, the Committee also carried out investigations concerning human rights violations committed(perpetrated) by NIS and its predecessors in six areas that include politics, law-enforcement, mass media, labor unions, universities and espionage.
The Committee had difficulties in carrying out those investigations. There were not sufficient evidential materials related to those cases that occurred many years ago. Conflicts in viewpoint among its members made the operation of the Committee even more difficult. Since the Committee was voluntarily launched by the NIS to find facts about its dark past, however, it could have a relatively easy access, though in a limited extent, to relevant materials kept by the NIS.
It is remarkable that the investigation into the Reconstruction Committee for the People’s Revolutionary Party case which had been called ‘a judicial murder’, could disclose the fabrication of facts by torture and made the Court have a retrial. The retrial court adjudicated that the former defendants were not guilty and ordered the State to compensate the victims for the past sufferings, based on the facts ascertained by the Committee. It can be said to be the most significant achievement of the Committee’s investigations.
However, there still remain a great many other victims whose losses and deprived honors were yet to be compensated and restored. Many cases were not fully investigated, and some were not even touched upon at all, because of the limits of the Committee. The Committee was confronted with limitations both in the number of investigators and the legal deadline set for its investigations. Moreover, the Committee was not authorized to enforce the investigations concerned. In addition, it was another serious problem that the NIS itself did not keep in custody many important documents related to the major dubious cases.
In conclusion, though the term of the Committee expired, the effort to find the truth of the past dubious cases by NIS and its predecessors must be continued by all means. To avoid and prevent any type of state-terrorism by intelligence agencies in the future, the democratic control over NIS by the people should be strengthened more and more.
