유사수신과 다단계식 기망행위 범죄예방 대책 (A Study on the Prevention of Fund-Rasing Business Crime and Multi-level Marketing Fraud)

초록

범정부차원의 지속적인 단속과 처벌에도 불구하고 불특정 다수를 대상으로 한 유사수신범죄와 불법다단계는 서민경제를 위협하며 그 피해규모 또한 상상을 초월한다. 대부분의 불법유사수신업체는 금융감독의 감독을 받지 않으며 고수익을 미끼로 금융기관보다 높은 확정금리 또는 확정배당 지급을 약속한다. 하지만, 수익원이 전혀 없고 신규투자자의 투자금으로 기존투자자의 수익을 보존하는 ‘폰지책략’에 불과하다. 신규회원 모집의 방식에 있어 다단계 방식을 이용하며 회원모집시 성과급명목으로 수익을 보장하는 피라미드방식의 형태를 띠고 있다. 대법원에서는 유사수신행위에 대하여 양형기준을 설정하였으나 주범을 제외한 대부분의 경우 집행유예 판결을 하여 솜방망이 처벌이라는 논란을 야기했다. 유사수신범죄는 범죄환경에 맞게 진화하고 발전하여 피해인원 몇십만명, 피해규모 몇조원에 이를 정도의 대형화 한다. 지역경제를 뒤흔든 ‘조희팔 유사수신’사건이 대표적이다. 유사수신범죄는 경제불황 속에서 고수익을 미끼로 투기 심리를 파고들어 건전한 금융질서를 파괴한다. 특히, 피해가 노인층, 주부, 대학생 등에게 빈번하다는 점에서 비난가능성이 크다. 이 연구는 문헌연구를 통해 선행연구를 검토하고 고수익에 현혹되는 유사수신행위 및 다단계식 투자를 통한 기망행위를 이론적 검토와 함께 실증적 연구를 통해 실태를 고찰한다. 또한, 유사수신범죄의 심각성에 근거하여 다양한 형태의 범죄유형을 최신경향을 분석한다. 합리적 선택을 이론적 근거로 제시한다.

Economic crimes, along with economic development, are beyond imagination and be targeted the unspecified majority. A major crime is Fund-Rasing Business Crime. In spite of government punishment, the crimes threatening people’s livelihood has been increasing and this tendency have made low-income economy classes collapsed. The most of Illegal fund-rasing business company is unsupervised on the Superintendent of Financial Institution, but it is promised to pay a Fixed interest rate and a fixed dividend higher than that of financial institutions that is high profit as bait. There is not a return on investment in fund-rasing business company. It is nothing more than a “Ponzi Ponzi scheme” that preserves the profits of existing investors with the investment of new investors. Fund-Rasing Business are not authorized or licensed. also, Multi-level investment fraud, such as paying referral allowances when introducing sub-investors, is a typical pattern of Fund-Rasing Business Crime. The court set the sentencing standards for Fund-Rasing Business Crime, but it is causing controversy over the narrow punishment that gave a suspended sentence. Fund-Rasing Business Crime evolve and develop according to the criminal environment. It is large enough to reach thousands of victims and several trillions of damages. A representative example is the case of 'Cho Hee-Pal's that shook the local economy. In the economic downturn, Fund-Rasing Business Crime digs into investor sentiment with high returns as a bait. It destroys the financial order. In particular, the possibility of criticism is high that the victims are the elderly, housewives, and college students. This study examines previous studies through empirical research with theoretical review deceptive acts and practices received through Fund-Rasing Business Crime and Multi-level investment fraud by the high profits. also, Based on the severity of Fund-Rasing Business Crime, we analyze the latest trends in crime types such as cryptocurrency, financial company fraud.
We present the severity of punishment in the deterrence theory for crime prevention and the rationality of the rational choice theory as theoretical grounds. As a measure to prevent damage, We propose an upward adjustment of criminal punishment, Punitive damages Compensation, Special Judicial Police Officers as a damage prevention measure.
