체포·구속 시의 권리고지와 미란다원칙 (Notice of Rights When Arrested or Detained and Miranda Rule)

초록

형사소송법은 체포, 구속을 하는 때에 체포, 구속의 사유와 변호인 선임권 등을 고지하도록 규정하고 있고, 진술거부권은 피의자나 피고인을 신문하는 때에 고지하도록 규정하고 있다. 그럼에도 불구하고 우리나라에서는 피의자와 피고인을 체포하거나 구속하는 상황에서 하는 권리고지가 미란다원칙의 구현이라고 이해하는 견해가 보편화되어 있다. 이 논문은 권리고지와 미란다원칙이 전혀 다른 제도라는 점을 논증하고자 하였다.
권리고지는 미란다원칙의 핵심인 진술거부권을 그 내용으로 하고 있지 않고, 변호인의 조력을 받을 권리를 보장하는 기능도 거의 수행하지 않으므로 미란다원칙을 구현하였다고 볼 수 없다.
권리고지는 피체포·구속자에게 체포·구속의 사유를 알려줌으로써 인간의 존엄성을 지킬 수 있도록 도와주고 불필요한 마찰을 피할 수 있게 하며, 부당한 체포·구속이 행해지는 것을 방지할 뿐만 아니라 체포·구속되는 자로 하여금 방어를 준비할 수 있도록 하는 등의 기능을 하게 된다.
따라서 권리고지는 진술의 임의성을 확보하기 위한 미란다원칙과는 전혀 다른 제도이다. 그렇기 때문에 권리고지를 미란다원칙의 실천으로 이해하는 현재의 판례와 학설은 변경되어야 한다. 임의성 없는 진술이 행해지지 않도록 방지하는 기능은 권리고지가 아니라 진술거부권 등을 알려줌으로써 수행하여야 한다.
수사기관이 피의자를 체포·구속하는 때에는 체포·구속하는 범죄사실의 요지와 그 사유를 알려주고, 수사기관 자신의 신분과 권한을 밝혀야 한다. 수사기관이 신분을 밝히기 위해서는 신분증을 제시하면서 소속과 성명을 알리고, 권한을 밝히기 위해서는 영장이 발부되었다거나 현행범인 체포나 긴급체포의 요건이 구비되었다는 사실을 고지하면 될 것이다.

영어초록

The Criminal Procedure Act provides that the reasons for arrest and detention and the right to counsel must be notified at the time of arrest or detention, and the right to silence must be notified when the suspect or defendant is interrogated. Nevertheless, in Korea, there is a widespread view that notice of rights given in situations of arrest or detention of suspects and defendants is an implementation of the Miranda rule. This paper attempted to argue that the Notice of Rights and Miranda rule are completely different systems.
The notice of rights does not include the right to remain silent, which is the core of the Miranda ruel, and does barely fulfill the function of guaranteeing the right to counsel, so it cannot be considered as implementing the Miranda rule.
A notice of rights helps protect human dignity and avoid unnecessary friction by informing the arrested or detained person of the reasons for the arrest or detention. It not only prevents unfair arrest and detention, but also protects the person from being unfairly arrested and detained. It has functions such as allowing one to prepare for defense.
Therefore, the notice of rights is a completely different system from the Miranda rule, which aims to ensure statements to be voluntary. Therefore, the current precedents and theories that understand the notice of rights as a practice of the Miranda rule must be changed. The function of preventing non-voluntary statements from being made should be done not by giving notice of rights, but by informing people of the right to silence.
When an investigative agency arrests or detains a suspect, it must inform the suspect of the facts and reasons for the crime being arrested or detained, and disclose the identity and authority of the investigative agency itself. In order for an investigative agency to reveal one's identity, it can present an identification card and announce its affiliation and name. In order to reveal its authority, it can announce that a warrant has been issued or that the requirements for an active criminal arrest or emergency arrest have been met.
