『하멜보고서』의 법 민속사적 검토 (A Study of the Legal Folklore of Koreans from Hamel's report)

초록

본고는『하멜보고서』에서 나타난 법속을 민속사적 측면에서 검토해 보기위해 작성하였다. 사실 규명을 위해 여러 법률서와『조선왕조실록』의 사례들을 활용하였다.
2장 ‘하멜의 조선법 이해’ 부분에서는 하멜이 파악한 조선법의 정도를 가늠해 보았다. 하멜은 같은 범죄라 하더라도 가해자와 피해자의 관계에 따라 다른 형량이 부과됨을 알고 있었다. 그가 제시한 사례의 타당성을 규명하기 위해 『대명률』의 구타 살인죄, 강간죄, 절도죄의 조문 등을 비교 검토하였다.
3장 ‘형벌에 대한 기록을 검토’한 부분에서는 형벌과 형구가 지니고 있는 의미와 그 사실성을 검증해 보았다. 법 이외의 형구들이 사용되고 있었고, 남형(濫刑) 또한 상존했음을 알 수 있다. 아울러, 사실적인 행형 실태를 통해 조선시대 감추어진 형벌의 이면을 들여다볼 수 있었다.
4장에서는 유교식 혼·상례와 전통의 풍속이 함께 공존하고 있음을 알게 되었다. 17세기 시집살이가 백성들 사이에 행해지고 있었고, 유교식 상례와 무·불식 상례가 더불어 행해지고 있음을 알게 되었다. 한편, 그의 기록들이 대부분 사실에 부합하는 것으로 드러났다.
『하멜보고서』는 하멜이 머문 13년 28일간의 기록이다. 그에게는 고통이었지만 조선의 법민속을 규명하는데 귀중한 자료가 되고 있다.

영어초록

This study examined the legal folklore of Koreansfrom Hamel's report through complete series of law and diverse materials. Hamel understood the legal systems of the Chosun dynasty and discriminating orders of Confucianism well in his own way. Also, his documents became more valuable in use because he wrote the writing time of the recording documents. Even he interpreted the culture and social system of Chosun from his viewpoint, his understanding level for the law of the Chosun times was very high.
In the chapter 2, ‘the Hamel’s understanding for the law of the Chosun times’, this study examined the level of Hamel’s understanding for the law of the Chosun times. Hamel understood the different application of punishment based onthe relationship between assailant and sufferer even those were same crime. This study comparatively researched the provisions of Demyungryul(大明律) for assault murder,criminal assault, larceny in order to study cased which he presented in his report.
In the chapter 3, ‘the documentary study for punishment’, this study verified the meanings and actual facts of punishment and implements of punishment. In the Chosun times, implements of punishment were used for punishment as well as law. Also, there were provisions for prohibition of abusing in punishment. This study could research the hided side of punishment through the actual executions of sentences in the Chosun times.
In the chapter 4, this study researched that wedding ceremony and funeral rites based on the ways of Confucianism were coexisted in Chosun times. The Chinyungre(親迎禮), the rite that the bridegroom go bride’ house to get married to bride, came to stay in the society of normal people in the 17 centuries. Also, funeral rites based on the ways of Confucianism were coexisted with the ways of shamanist custom and Buddhist ritual. From this study, Hamel’s report was coincided with facts in the Chosun times.
Hamel’s report was the documental recoding from his staying periods for 13 years and 28days. Even his staying periods might be hard for him, his report was became precious documental materials for legal folklore of the Chosun times.
