「전통무예진흥법」 개정에 대한 검토 (Review of the revision of the 「Traditional Martial Arts Promotion Act」)

초록

이 연구의 목적은 「전통무예진흥법」 개정을 위한 법률적 내용을 검토하는 것이다. 이에 대한 결론은 다음과 같다.
첫째, 「전통무예진흥법」은 2008년 3월 28일 법률 제9006호로 제정되었다. 조문의 순서는 제1조 목적, 제2조 정의, 제3조 전통무예진흥의 기본계획 수립 등, 제4조 국가 및 지방자치단체의 책무, 제5조 전통무예단체의 육성, 제5조 2 유네스코 국제무예센터의 설립, 제6조 전통무예지도자의 육성, 제7조 권한의 위탁 등이다.
둘째, 「전통무예진흥법 시행령」은 2009년 3월 25일 대통령령 제31138호로 제정되었다. 조문의 순서는 제1조 목적, 제2조 전통무예진흥의 기본계획, 제3조 전통무예지도자 등급 등, 제4조 전통무예지도자의 자격검정 등과 부칙 등이다.
셋째, 「전통무예진흥법」의 주요 부분 개정은 6차례 이루어졌다. ①2015년 3월 27일(법률 제13248호) 제2조 정의가 개정, ②2017년 11월 28일(법률 제15063호) 제5조 2 유네스코 국제무예센터의 설립 신설, ③2020년 6월 9일(법률 제17416호) 제5조 전통무예 단체의 육성 및 제7조 권한의 위탁 개정, ④2020년 12월 22일(법률 제17718호) 제3조 7항 방역사항 추가 내용 삽입 및 제3조 8항 신설, ⑤2021년 4월 13일(법률 제18014호) 제3조 전통무예진흥의 기본계획 수립 등 개정, ⑥2023년 8월 8일(법률 제19588) 제2조 정의 내 타법 개정 등이다.
넷째, 「전통무예진흥법」 개정을 위한 비교는 ①「전통무예진흥법(법률 19588호)」, ② 임오경의원 대표발의의 「전통무예진흥 법률 전부개정안」(2022), ③성문정 박사의 「전통무예진흥 법제 개선 연구」(2023)을 대상으로 삼았다.
다섯째, 법률적 조문의 차이를 살펴보면, 기존 「전통무예진흥법」 은 7개 조문과 부칙 3조로 구성되었으며, 임오경의원 대표발의의 「전통무예진흥 법률 전부개정안」(2022)은 제13조와 부칙으로 이루어져 있다. 성문정 박사의 「전통무예진흥 법제 개선 연구」(2023)은 제21조로 구성되어 있다. 이를 통해 기존 「전통무예진흥법」 조문에 비해 임오경의원의 전부개정안은 6개 조문이 추가되었고, 성문정 박사의 법제 개선 연구는 14개의 조문이 추가되었다.
여섯째, 임오경의원의 전부개정안과 성문정 박사의 법제 개선 연구 비교를 통해 장점 3가지와 단점 4가지를 찾을 수 있었다. 이상과 같이 「전통무예진흥법」 개정에 대한 내용을 종합적으로 검토한 결과 「전통무예진흥법」은 제2조 정의부터 시작하여 전체적으로 새롭게 개정할 필요성이 있음을 파악할 수 있었다.

영어초록

The purpose of this study is to examine the legal contents for the revision of the 「Traditional Martial Arts Promotion Act」. The conclusions to this are as follows.
First, the 「Traditional Martial Arts Promotion Act」 was enacted as Act No. 9006 on March 28, 2008. The order of provisions is Article 1, the purpose, Article 2 ,the definition, Article 3, the establishment of a basic plan for the promotion of traditional martial arts, etc., Article 4, the responsibility of the national and local governments, Article 5, the promotion of traditional martial arts organizations, Article 5-2, the establishment of the UNESCO International Martial Arts Center, the establishment of the UNESCO International Martial Arts Center, Article 6, the development of traditional martial arts leaders, and Article 7, the entrustment of the authority.
Second, the 「Enforcement Decree of the Traditional Martial Arts Promotion Act」 was enacted as Presidential Decree No. 313138 on March 25, 2009. The order of provisions is Article 1, purpose, Article 2, basic plan for the promotion of traditional martial arts, Article 3, grade of traditional martial arts leaders, etc., Article 4, qualification test for traditional martial arts leaders, etc. and supplementary provisions.
Third, major revisions to the 「Traditional Martial Arts Promotion Act」 has been enacted for six times. ①Revision of Article 2, the definition on March 27, 2015 (Act No. 13248) ②Article 5-2, The UNESCO International Martial Arts Center was established on November 28, 2017 (Act No. 15063). ③Article 5 (Act No. 17416) Fostering Traditional Martial Arts Organizations and Article 7, Revising the Entrustment of Authority on June 9, 2020. ④On December 22, 2020 (Act No. 17718), Article 3-7 Additional contents of quarantine matters were inserted, and Article 3-8 was newly established. ⑤Article 3 (Act No. 18014) ,the establishment and revision of a basic plan for the promotion of traditional martial arts etc. on April 13, 2021. ⑥Revision of other laws within the definition of Article 2 on August 8, 2023 (Act Article 19588).
Fourth, the comparison for the revision of the Traditional Martial Arts Promotion was targeted through ①「Traditional Martial Arts Promotion Act」 Act No. 19588), ②「The entire amendment to the Traditional Martial Arts Promotion Act」 (2022) proposed by Representative Lim Oh-kyung, and ③Dr. Sung Moon-jung's 「Study on Improving Traditional Martial Arts Promotion Legislation」 (2023) Fifth, Examining at the difference in legal provisions, the existing 「Traditional Martial Arts Promotion Act」 consists of 7 provisions and 3 supplementary provisions, and the 「The entire amendment to the Traditional Martial Arts Promotion Act」 (2022)by Rep. Lim Oh-kyung, consists of 13 provisions and supplementary provisions. Dr. Sung Moon-jung's 「Study on Improving Traditional Martial Arts Promotion Legislation」 (2023) consists of 21 provisions. Through this, compared to the existing 「Traditional Martial Arts Promotion Act」 six provisions were added to the Lim Oh-kyung’s entire amendment, and 14 provisions were added to Dr. Sung Moon-jung's research on legal improvement. Sixth, three advantages and four disadvantages were found through the comparison of the entire amendment of Rep. Lim Oh-kyung and Dr.Sung Moon-jung's legal improvement plan. As described above, as a result of a comprehensive review of the contents of the revision of the 「Traditional Martial Arts Promotion Act」, it is found that the 「Traditional Martial Arts Promotion Act」 needs to be revised starting with Article 2 ,the definition as a whole.
