해외파견 북한 노동자 인권 침해와 개선방안: 국제인권규약 위반을 중심으로 (Infringement upon Human Rights of North Korean Workers Sent Abroad and Some Options for Its Improvement: Focused on Violations of Two International Covenants on Human Rights of 1966)

초록

해외파견 북한 노동자들은 ‘북한 밖의 북한’으로 불릴 만큼 매우 열악한 환경에서 활동하고 있다. 여기에는 다양한 형태의 인권침해가 존재하기 때문이다. 북한 노동자들이 해외에서 받고 있는 인권침해는 ① 직업선택의 자유 및 평등권 침해, ② 자신이 제공하는 노동과 관련된 알 권리, 정보의 자유 침해, ③ 거주․이동의 자유 침해, ④ 과중한 노동의 부과 및 휴식의 권리 침해, ⑤ 임금 갈취와 재산권 침해, ⑥ 인신․사생활 및 통신의 자유 침해: 감금․감시 및 검열의 일상화, ⑦ 사상․양심의 자유 침해, ⑧ 표현의 자유, 간섭 없이 의견을 가질 자유 침해, ⑨ 먹을 권리, 피복권 및 건강권 침해, ⑩ 강제노동을 당하지 않을 권리, ⑪ 자의적 구금 및 처벌을 당하지 않을 권리로 대별된다. 한마디로 해외파견 북한 노동자들은 지금 ‘노예노동’을 강요받고 있거나 ‘현대판 노예’처럼 취급되고 있다고 볼 수 있다. 그와 같은 인권침해를 2개의 국제인권규약에 비추어 법적으로 평가하는 일은 매우 중요하다. 그러한 분석․평가 작업의 결과는 자유권규약 및 사회권규약에 대한 인권침해를 각각 다루는 자유권위원회(Human Rights Committee) 및 사회권위원회(Committee on Economic, Social and Cultural Rights)에서 심사를 받을 때 중요한 기초자료가 될 수 있기 때문이다. 또한 유엔인권이사회가 매 4년 6개월마다 실시하는 ‘북한인권 UPR’에서도 활용될 수 있다. 나아가 국제사회의 해외파견 북한 노동자들의 인권 개선정책의 방향을 설정하는 데 중요한 시사점을 줄 수 있다. 앞으로 국제사회는 해외파견 북한 노동자들이 받고 있는 인권 침해에 주목해서 이를 공론화하고 실질적인 개선을 모색해 나가야 한다.

영어초록

North Korean workers sent abroad are working in very harsh conditions, which is even called 'North Korea outside of North Korea'. This is because there are various types of human rights infringement. Such human rights violations from which North Korean workers have suffered abroad are classified into the followings: ① infringement on the right to freedom of occupational choice and right to equality, ② infringement on the right to know and freedom of information regarding the labor they provide, ③ infringement on the freedom of residence and movement, ④ imposition of heavy labor and violation of the right to rest, ⑤ exploitation of wages and violation of the right to property, ⑥ infringement on the right to personal liberty, right to privacy, and inviolability of correspondence, ⑦ violation of the freedom of thought and conscience, ⑧ violation of the freedom of expression and right to hold opinion without interference, ⑨ infringement on the right to food, clothing, and health, ⑩ infringement on the right to freedom from forced labor, ⑪ infringement on the freedom from arbitrary detention and punishment. In short, they are treated as ‘contemporary slaves’ in that a kind of ‘slave labour’ is enforced upon them. It is very significant to legally evaluate such human rights violations in light of the two International Covenants on Human Rights of 1966. It is because the result of analyses and evaluations can be an important basic material when reviewed by ‘Human Rights Committee’ and ‘Committee on Economic, Social, and Cultural Rights', which deals with human rights violations under the International Covenant on Civil and Political Rights (ICCPR) and International Covenant on Economic, Social, and Cultural Rights (ICESCR) respectively. Additionally, the legal findings can be utilized in the process of the 'Universal Periodic Review (UPR) on North Korean human rights', which is conducted under the authority of UN Human Rights Council (UNHRC) every four and a half years. Furthermore, it can provide a right policy direction to the international community for improving human rights situation facing North Korean overseas workers. Now the international community should pay sincere attention to human rights of North Korean workers sent abroad, publicize those issues, and seek for substantial options to resolve the matter.
