초록

『방송통신위원회의 설치 및 운영에 관한 법률』에 따라 설치된 기관인 방송통신심의위원회는 방송의 공적 책임과 방송의 공공성·공정성을 담보하기 위하여 방송 내용에 대한 사후 심의와 각종 제재조치를 심의·의결할 수 있는 권한을 가진다. 2022년 대선으로 여야 간 정권교체가 이루어진 이후 지난 2년 동안 구 여권 추천 위원을 해촉하고 빈자리를 현 여권 추천 위원으로 위촉하는 등의 인위적인 변화가 방송통신심의위원회에 휘몰아쳤고 여권 우위 구조로 변동된 방송통신심의위원회가 정권에 비우호적이거나 비판적인 방송매체의 방송 내용에 대하여 집중적으로 사후 심의를 하고 제재조치를 남발함으로써 정치편향적 권한 행사라는 비판과 함께 해당 방송매체의 방송의 자유를 심각히 제약한다는 비판이 계속 제기되었다. 이와 같은 일련의 사태가 발생할 수 있는 요인으로는 심의위원 자격요건의 불완전성, 해촉의 실체적·절차적 요건의 미비, 정치적 후견주의에 입각한 방송통신심의위원회 구성방식 등을 들 수 있다. 방송통신심의위원회가 방송의 공적 책임과 방송의 공공성 및 공정성을 담보한다는 본연의 기능을 넘어 방송의 자유를 제약하고 정권의 방송 장악에 앞장서는 도구로 전락하는 것을 방지하기 위해서는 심의위원의 자격요건을 강화하고 심의위원 해촉의 실체적·절차적 요건을 신설하는 법 개정 작업이 요구된다. 보다 근원적으로는 정치적 후견주의에 입각하여 정치적 국가기관인 대통령과 국회에 방송통신심의위원회 구성을 전적으로 맡기는 현행 지배구조 체계를 개편할 필요가 있다. 방송통신심의위원회의 지배구조 개선 방안으로는 현행 헌법이 정치적 중립성과 독립성 확보를 위해 헌법재판소와 중앙선거관리위원회 구성에서 사용하는 방식인 대통령-국회-대법원장의 3면 협력관계를 통해 방송통신심의위원회를 구성하는 방안이 방송통신심의위원회의 정치적 중립성과 독립성 확보를 위해 적절하다고 판단된다.

영어초록

The Korea Communications Standards Commission(KCSC), an organization established under the Act on the Establishment and Operation of the Korea Communications Commission, has the authority to review the contents of broadcasting and impose various sanctions to ensure public responsibility and publicity and fairness of broadcasting. Since the 2022 presidential election, the government change between the ruling and opposition parties has led to artificial changes in the past two years, such as dismissing the former ruling party's recommended member and appointing the vacancy as the current ruling party's recommended member, and the KCSC, which changed due to the ruling party's advantage, has been criticized for seriously restricting the freedom of the broadcasting media, along with intensive follow-up deliberations on the broadcasting contents of broadcasting media that are unfriendly or critical to the regime and overuse sanctions. Factors that could cause such a situation include incompleteness of the qualification requirements for deliberation members, lack of substantive and procedural requirements for dismissal, and the formation of the KSCS based on political guardianship. To prevent the KCSC from becoming a tool to restrict freedom of broadcasting and take the lead in the regime's control of broadcasting beyond its original function of ensuring public responsibility and publicity and fairness of broadcasting, it is necessary to revise the law to strengthen the qualifications of deliberators and establish substantive and procedural requirements for dismissal of deliberators. Fundamentally, it is necessary to reform the current governance system, which is based on political guardianship and entrusts the composition of the KCSC entirely to the President and the National Assembly, which are political state institutions. As a way to improve the governance of the KCSC, it is considered appropriate to organize the KCSC through a three-way partnership of the President, the National Assembly, and the Chief Justice of the Supreme Court, which is the method used by the current Constitution to organize the Constitutional Court and the National Election Commission to ensure political neutrality and independence.
