초록

한반도 DMZ는 네 가지의 특징적 조건이 공존하고 있다. 첫째, 세계에서 가장 넓은 중무장된 지역이라는 점이다. 둘째, DMZ는 생태·환경의 보고이다. 셋째, DMZ 일원은 깊고 다양한 인문학적 콘텐츠를 품고 있는 지역이다. 넷째, DMZ는 세계의 비무장지대 중 평화적 상징성이 큰 ‘장소성(Placeness)’을 지니고 있다. DMZ는 국제적 유산으로서 의의를 지닌다. 한국전쟁 중 직접 전투에 참여한 나라는 16개 국가에 달하며, 전쟁으로 인한 군경 전사자는 14만 1,030명, 유엔군 3만 7,902명에 이른다. 여기에 실종자와 부상자, 그리고 민간인 피해자까지 합치면 그 수는 헤아리기 힘들 정도로 더 늘어난다. 한국전쟁은 냉전시기 가장 치열했던 국제전의 성격을 지닌다. 이러한 점에서, DMZ는 세계 냉전사의 중요한 유산인 것이다. DMZ·접경지역은 ‘다중심성(Polycentricity)’을 지니고 있다. DMZ·접경지역 관련 행위자는 국내, 남북, 국제적 층위로 구성되며, 정부와 민간영역으로 구분된다. 또한 행위 유형에 따라 전문가와 활동가로 구분할 수 있으며, DMZ·접경지역이 지닌 환경·생태(Eco), 기억(Memorials), 평화(Peace)의 이슈 내지 가치에 따라 편재된다. DMZ·접경지역에 착종된 다양한 가치와 행위자들의 질서 있는 ‘협력’을 촉진하기 위해서는 ‘DMZ네트워크’의 수립이 요구된다. 이를 위해서는 다중심성과 협력을 전제하는 가운데 민주성, 지속가능성, 현실성의 원칙이 지켜져야 한다. 협력 거버넌스로서 ‘DMZ네트워크’의 구상안은 다음과 같다. 첫째, 4자 거버넌스의 수립은 다음과 같다. 중앙정부-광역 지방정부-기초 지방정부-시민단체의 대표가 독립적 행위자로 구성하는 거버넌스 체제이다. 이 방안은 국민의 참여 폭이 넓어 민주적 원리를 충실히 반영하는 장점이 있으나, 광역·기초정부 간 중복 문제를 지니고 있다. 둘째, 3자 거버넌스의 수립이다. 중앙정부-광역 지방정부-기초 지방정부-시민단체 간 거버넌스이다. 즉, 지방정부는 각각의 광역 지방정부가 중심이 되고, 산하 기초 지방정부와의 협의체를 이뤄 행위자로 참여한다. 한편 거번넌스 발전을 위해 정부는 접경지역에 대한 관점 전환과 제도적으로 보장할 장치를 마련해야 한다. 즉 민북지역 및 접경지역을 규율하는 ‘군사기지 및 군사시설보호법’, ‘접경지역지원특별법’을 넘어 ‘평화지역의 설치 및 육성을 위한 기본법’(가칭) 및 관련 조례를 제정해야 한다. 이를 통해 이 지역의 생태·환경, 기억, 평화의 가치를 제도화 해 나가야 할 것이다.

영어초록

There are four characteristic conditions that co-exist in the DMZ located in the Korean Peninsula. First, it is the largest heavily armed zone in the world. Second, it is an ecological and environmental repository. Third, the entire DMZ area is an area with various in-depth liberal contents. Fourth, the DMZ has a symbolic placeness with peace among demilitarized zones in the world. The DMZ has its significance as an international heritage. The number of countries that directly participated in battles during the Korean War was almost 16 countries, and the number of death due to the war was 141,030 soldiers and policemen in the Korean Army and 37,902 soldiers in the UN forces. It would be difficult to count the total number of casualties by considering those listed as missing, injured, and civilian victims. The Korean War has a nature of the most heated international war during the Cold War. In this regard, the DMZ is an important heritage in the world history of the Cold War. The DMZ·border area has a polycentricity.
The key performers regarding the DMZ·border area consist of domestic, south and north, and international levels and it is divided into the government area and the private area. The key performers can also be classified into experts and activists according to the action type, and these performers are omnipresent based on the issues or values of environment and ecology(eco), memorials, and peace possessed by the DMZ border area. The establishment of the ‘DMZ network’ is required in order to promote various values entangled in the DMZ border area and an orderly cooperation of the performers. For such purpose, the principle of democracy, sustainability, and reality on the premise of multi-centricity and cooperation should be observed. The ‘DMZ network’ plans as a cooperative governance are as follow. The first plan is to establish a quadripartite governance. This governance system is organized by the representatives of the central government, regional local governments, basic local government, and non-governmental organizations as an independent key performer. This plan has an advantage that it faithfully applies the principle of democracy because the range of participation by people is wide. However, there are redundancy issues between regional and basic local governments. The second plan is to establish a tripartite governance. This is a governance between the central government, regional local governments, basic local governments, and non-government organizations. In other word, each regional local government becomes the center, forms a consultative group with affiliated basic local governments and participates as a performer.
Meanwhile, the government should prepare a system for changing the viewpoint on the border area and the institutional guarantee for the development of governance. That is, it is necessary to enact the ‘Framework Act for the Installation and Cultivation of Peace Zone’ as (tentative) and relevant ordinances for regulating the Civilian Control Line and the border area in addition to ‘Protection of Military Bases and Installations Act’ and ‘Special Act on Support for Border Area.’ It is also needed to institutionalize the values of environment and ecology (eco), memorials, and peace possessed by this area through such acts and ordinances.
