수사구조 개혁을 위한 국가수사청 도입의 필요성 (Proposal of the National Investigative Agency for Structural Reform of Criminal Investigation)

2022. 7. 22. 여야 합의로 구성하기로 한 “형사사법체계개혁특별위원회”의 논의사항으로제안되는 ‘중대범죄수사청’은 경찰의 수사인력에 대한 변화 없이 검찰의 수사인력만을 분리하여 만들어지는 기구인데, 이른바 ‘한국형 FBI’로 지칭되고 있다. 한편, 종래 검찰과 법무부를 중심으로 경찰의 수사인력과 검찰의 수사인력을 합친 국가수사청 도입이 논의되어왔다. 이 국가수사청은 미국의 FBI처럼 법무부 소속이므로 이 역시 ‘한국형 FBI’라고 불린다.
구체적인 제도 구상을 살펴보면, ‘한국형 FBI’라는 말 속에는 각 기관의 욕망이 투영되어있다. 경찰 입장에서는 기존 경찰의 수사권을 희생하지 않는 별도의 수사기구라는 취지로, 법무부나 검찰은 경찰에 의존하지 않아도 되는 독자적인 수사기구라는 의미로 각각 받아들이고 있다.
이 글에서는 수사구조 개혁의 관점에서 경찰과 검찰의 이해관계를 벗어나 수사를 전담하는 제3의 조직으로서 국가수사청의 신설을 제안한다. 이는 경찰과 검찰로부터 분리되고검찰ㆍ경찰의 상호 견제하는 국무총리실 소속의 수사기구로서, 정치적 중립성과 독립성을 위해 국가수사위원회의 실질적 감독을 받는다. 국가수사청은 ‘수사-기소 분리’와 ‘사법경찰과 행정경찰의 분리’의 실현을 위해 필요하다. 그런 의미에서 국가수사청은 수사구조 개혁의 완성을 위한 핵심적 기구라고 할 수 있다. 물론 이를 국가단위의 단일기구로 이해하여 거대 수사기구의 출현이라며 권력기관화를 우려하는 견해가 없는 것은 아니다. 그러나 자치경찰에 인력과 권한을 이양하여 적정한 규모로 조직을 설계하고 중앙수사청과 지역수사청으로 나누어 권한을 분할한다면 국가수사청은 수사의 전문성과 책임성을 높이면서도 정치적 중립성과 독립성을 유지하는 수사기구로 구성될 수 있을 것이다.

영어초록

The newly proposed ‘Serious Crime Investigation Agency’ (hereinafter the “SCIA”) is scheduled to be a matter for discussion in the “Special Committee on Criminal Justice System Reform” of the National Assembly. Establishing this Special Committee is agreed upon between the ruling and opposition parties on July 22, 2022. The SCIA referred to as the “Korean FBI” in this agreement, is supposed to be made up of the investigative personnel in the Prosecution. On the other hand, the introduction of the National Investigative Agency (hereinafter the “NIA”), which combines the investigation personnel of the Police and the Prosecution, centered on the Prosecution and the Ministry of Justice, has been discussed. According to this, since the NIA is affiliated with the Ministry of Justice like the FBI in the United States, it is also called the “Korean FBI.” Likewise, while the Prosecution (and the Ministry of Justice) wants an investigative body separate from the Police and attached to the Ministry of Justice, the Police also prefer a separate investigative organization that would not reduce its present authority and personnel. In short, the term “Korean FBI” reflects the intent of the Police and the Prosecution respectively.
This article proposes introducing the NIA as an organization only for investigations, independent of both the Police and the Prosecution, so that checks and balances may work among them. The suggestion is that the NIA be established under the Prime Minister’s Office and supervised by the National Investigation Committee. There is a concern that the NIA will be a large investigative body with strong powers. However, if an appropriate scale of an organization should be designed through the reasonable distribution of powers with its branches as well as the Municipal Police, it would be much less likely for the NIA to become such an organization. The introduction of the NIA will enhance investigative expertise and lead to more accountable investigations. In this respect, the NIA will be a milestone in the structural reform of criminal investigations.
