성범죄자 신상정보등록·공개제도의 문제점과 개선방안 (Problems and Improvement Measures of the Sex Offender Registration and Disclosure System)

초록

헌법재판소는 2014헌마340·672, 2015헌마99(병합) 결정에서 성폭력 범죄로 판결이 확정된 자에 대해 일률적으로 20년간 신상정보등록 대상자가 되도록 규정한 성폭력범죄의처벌등에대한특례법 조항에 대해 개인정보자기결정권 침해를 이유로 헌법불합치 결정을 하였다. 이 결정은 개별 범죄 유형, 사안의 중대성, 재범의 위험성 등이 다를 수 있음에도 일률적 보안처분을 부과한 규정에 대해 입법 개선을 명한 것이다. 위 결정 이후 관련 조항에 대한 일부 개정을 하였으나 여전히 성범죄자에 대한 신상정보 등록·공개제도는 많은 문제점이 있다. 즉, 신상정보 등록·공개제도 자체에 개인정보자기결정권 침해 문제, 공개대상 범위 설정에 있어서 평등원칙 위반 문제, 공개로 인한 범죄자 가족 등에 대한 정신적, 물질적 피해 문제 등이 지적되고 있다. 비교법적으로, 미국은 성범죄자 신상정보를 관리함에 있어 성범죄자에 대한 철저한 감시와 감독에 초점을 맞추고 있으며, 영국과 프랑스 등 유럽국가들은 신상정보 등록은 최대한 상세하게 하지만, 공개에 있어서는 아동이나 청소년 대상 기관의 운영자 등의 필요한 범위에서 최소한도로 공개함으로써 범죄자와 그 가족의 프라이버시를 보호하고자 한다. 이에 우리나라도 신상정보의 등록과 공개에 있어서 그 대상 설정에 보다 다양하고 세밀한 요소를 고려하여 등록과 공개대상 범위를 보다 세분화 할 필요가 있으며, 프랑스에서 시행되고 있는 신상정보공개와 치료명령제도 등과의 연계를 통한 범죄자의 재사회복귀 프로그램 마련도 적극 고려해 볼 만하다. 한편, 관할의 불일치로 인한 비효율성 문제도 조속히 개선될 필요가 있는바, 현재 일반 성범죄자는 법무부가, 아동·청소년 관련 성범죄자는 여성가족부가 관할하고 있는데, 양 법률 모두 성범죄자를 그 대상으로 하고 있는 만큼 형사사법 전담부처인 법무부에서 이를 통합 관할함이 상당하다.

영어초록

The Constitutional Court has personally responded to the provisions of the Special Act on Punishment of Sexual Violence, etc., which stipulates to be subject to registration of personal information for 20 years for those who have been convicted of sexual assault in the 2014 Hunma 340·672 and 2015 Hunma 99 (combined) decisions. Constitutional inconsistency was decided on the grounds of infringement of the right to self-determination of information. The decision ordered legislative improvements to regulations that imposed uniform security measures, even though individual crime types, the seriousness of the matter, and the risk of recidivism may vary. After the above decision, related provisions were revised, but there are still various problems in the registration and disclosure of personal information about sex offenders. In other words, the personal information self-determination right infringement problem in the personal information registration and disclosure system itself, the violation of the equality principle in setting the scope of disclosure, and the mental and material damage problems to the family of criminals due to disclosure are pointed out. Comparatively, the United States focuses on the thorough monitoring and supervision of sex offenders in managing sex offender information, while European countries such as the United Kingdom and France have registered as much detail as possible, but when it comes to disclosure, organizations targeting children or youth We intend to protect the privacy of criminals and their families by releasing them to the minimum extent necessary for the operators, etc. In this regard, in Korea, it is necessary to further refine the scope of registration and disclosure targets in consideration of various factors in setting targets for the registration and disclosure of personal information, and to link the personal information disclosure and treatment order system in France. It is also worth considering the provision of a program to return to the society through criminals. On the other hand, inefficiencies due to inconsistencies in jurisdictions also need to be improved promptly. While the current sex offender jurisdiction is under jurisdiction, children and youth-related sex offenders are under the jurisdiction of the Ministry of Gender Equality and Family, and both laws target sex offenders, so the Ministry of Justice, the exclusive department of criminal justice, has considerable jurisdiction.
