디지털 증거의 압수·수색의 문제점과 개선방안 (Improvement of the Issues in Search and Confiscation of Digital Evidence)

초록

디지털 증거의 압수수색과 증거분석은 디지털 범죄 수사에서 핵심절차에 속한다. 디지털 증거에 대한 압수수색은 통상의 압수수색과는 달리 독특한 특성으로 압수수색과 증거분석에 전문성이 요구된다. 형사소송법 제106조 제3항에 디지털 증거의 압수수색과 관련한 규정이 명문으로 규정되었지만 압수수색 대상물의 특정과 그 범위의 모호함으로 야기되는 문제점들을 해결해 주지 못하고 있다. 수사기관은 정보저장매체의 압수를 원칙으로 하고 복제물 또는 출력물의 압수를 예외로 하여 수사의 효율성을 강조하려는 경향이 짙다.
디지털 증거의 압수수색의 문제점은 압수수색 대상물의 특정과 그 범위의 모호함으로 인하여 과잉 압수수색이 실시되고 이 때문에 개인정보의 자기결정권이 과도하게 침해될 수 있다는데 있다. 디지털 증거의 압수수색의 개선하기 위해서는 수사기관의 디지털 증거의 압수수색에 대한 올바른 이해와 압수수색 절차에서 비례성․상당성 준수하는 것이 필요하고 증거의 무결성을 유지하기 위한 진지한 노력도 병행되어야 한다. 그리고 디지털 전문수사관의 체계적 양성과 전문교육 강화, 디지털 증거의 압수수색과 분석의 매뉴얼 보완, 형사소송법 제106조 제3항 단서의 헌법 합치적 해석과 적용을 들 수 있다. 수사기관은 디지털 증거 압수수색에서 법치국가의 원리와 적법절차의 이념과 비례성과 상당성을 준수함과 동시에 선별적 압수수색으로 이러한 문제점을 극복하여야 한다. 또한 디지털 증거의 수집과 관련한 제도적인 보완책도 뒤따라야 할 것이다.

영어초록

Search and confiscation of digital evidence and analysis of evidence are core procedure in digital crime investigation. Contrary to ordinary search and confiscation, the search and confiscation of digital evidence requires expertise in search and confiscation and analysis of evidence because of its unique characteristics. Although regulations on the search and confiscation of digital evidence has been stipulated in the Clause 3, Article 106 of Criminal Procedure Code, issues caused from the vagueness in specification and scope of objects for search and confiscation are not being solved. Investigative agency has a strong tendency of focusing on the efficiency of investigation as it considers the confiscation of reproduced articles and printouts as exceptions while considering the confiscation of information storage device as the main principle.
The issue with the search and confiscation of digital evidence is that excessive search and confiscation is conducted due to the vagueness in the specification and scope of objects of search and confiscation. Accordingly, it could excessively violate the self-determination right of personal information. In regards to the improvement of the search and confiscation of digital evidence, there is a need for correct understanding by investigative agency on the search and confiscation of digital evidence, along with serious efforts to maintain the integrity of evidence and adherence of proportionality and relativity during search and confiscation procedure. In addition, it is necessary to strengthen training & education and systematic cultivation of investigation officers specializing in digital evidence, supplement manual for the search and confiscation and analysis of digital evidence, and constitutional interpretation and application of the clue of Clause 3, Article 106 of Criminal Procedure Code. During the search and confiscation of digital evidence, investigative agency needs to adhere to the principle of constitutional state and the ideology of legal procedure and proportionality and relativity, as well as conduct search and confiscation selectively to overcome such issues. In addition, institutional measure related to the collection of digital evidence should also follow.
