지방의회 자치입법권의 문제점과 개선방안 (A Study on the Problems and Improvement of Local Council Legislative Rights)

초록

지방의회가 지난 32년간 지역 주민의 복리증진과 지역 발전을 위해 주민들 곁에서 생활정치를 구현하고 주민의 대표기관으로서 지방자치단체에 대한 견제와 감시 기능을 수행해 왔음은 주지의 사실이다. 하지만 지방자치단체의 기관분립형 구조에서 지방의회와 집행기관 간에는 견제와 균형의 원리가 구현되어야 마땅하나 현행 지방자치단체는 강(强) 집행부 약(弱) 의회형 구조임을 부인할 수 없는 체제이다. 아울러 중앙정부의 과도한 개입과 집행기관에 비해 조직과 권한이 취약해 지방의회가 집행기관에 대한 견제와 감시를 수행하는 데 일정한 한계가 있다.
따라서 지방의회가 집행기관과의 관계에서 상호 대등한 관계를 형성하고 그 위상을 제고하여 주민자치를 이루기 위해서는 우선 지방의회의 ‘자치입법권’ 강화가 무엇보다 필요하다. 하지만 전부 개정된 지방자치법은 명목상 ‘인사권’ 독립에 그쳤을 뿐 인사권과 더불어 가장 중요한 ‘조직구성권’과 ‘예산편성권’은 지방의회에 포함되어 있지 않아 독립된 기관으로서 기능과 역할을 제대로 수행하는 데 한계가 있다. 또한 지방자치 행정권의 자치권 확립에 관한 논의는 많이 이루어지고 있으나 지방의회의 자치권과 자치입법권에 대한 논의는 상대적으로 경시되고 있다. 이러하듯 지방의회 본연의 역할에 한계가 있으니 이러한 상황 속에서 자치입법권 강화를 위한 방안을 다각도로 고민해 보아야 하므로, 본고에서는 지방의회 입법과정의 문제점과 이에 대한 개선방안을 중심으로 일별하고자 한다.
입법과정의 문제점으로 첫째, 헌법과 지방자치법 등 관련 법령상의 한계, 둘째, 지방의회 내 입법지원기구(조직)의 취약, 셋째, 입법지원인력 등의 한계, 넷째, 주민소통(참여)창구의 부족 등을 제시할 수 있다.
당해 문제점을 개선하기 위해서는 첫째, 조례와 국가법령의 충돌에 대해 지방자치의 실질적 확대와 보장의 관점에서 관련 법령의 정비와 둘째, 조직적 차원에서 지방의회 내 입법지원기구 설치확대, 셋째 기관대립형 구조를 전제할 경우 지방의회를 지원하는 법제전문인력의 충원강화, 넷째, 조례입법 질적 개선을 위한 관련 제도의 도입 등을 실현해야 한다. 이러한 일련의 지방자치에 대한 투자 개선을 단행한다면 종국적으로 자치입법권의 강화로 귀결되어 풀뿌리 민주주의 근간인 지방자치 실현을 우리는 기대할 수 있을 것이다.

영어초록

It is a well-known fact that local councils have implemented living politics near residents and performed checks and monitoring functions on local governments as representative organizations of residents for the past 32 years to improve the welfare of local residents and regional development. In the institutional-separated structure of local governments, the principle of checks and balances should be implemented between local councils and enforcement agencies, but the current local government cannot deny that it is a weak parliamentary structure. In addition, the central government's excessive intervention and weak organizations and authority compared to enforcement agencies have certain limitations in conducting checks and monitoring of enforcement agencies by local councils.
Therefore, in order for local councils to form mutually equal relationships with enforcement agencies and enhance their status to achieve resident autonomy, it is first necessary to strengthen the ‘autonomous legislative power’ of local councils. However, the revised Local Autonomy Act has only nominal “personnel rights” independence, and the most important “organizational composition rights” and “budgeting rights” are not included in local councils, so there is a limit to properly performing functions and roles as an independent institution. In addition, there are many discussions on the establishment of autonomy of local governments, but discussions on autonomy and autonomous legislative rights of local councils are relatively neglected. Since there is a limit to the original role of the local council, it is necessary to consider various ways to strengthen autonomous legislative power in this situation, so this paper will focus on the problems of the local council's legislative process and improvement measures.
As problems in the legislative process, first, related legal limitations such as the Constitution and Local Autonomy Act, second, weakness of legislative support organizations (organizations) in local councils, third, limitations of legislative support personnel, etc., and fourth, lack of resident communication (participation) channels can be suggested.
In order to improve this problem, first, from the perspective of actual expansion and guarantee of local autonomy, second, the establishment of legislative support organizations in local councils should be expanded at an organizational level, and fourth, the introduction of related systems to improve the quality of local legislation. If we improve investment in this series of local autonomy, we can expect to realize local autonomy, which is the basis of grassroots democracy, as it will eventually result in strengthening autonomous legislative rights.
