자치경찰제 도입의 법적 쟁점과 과제 (Legal Issues and Problems in the Introduction of the Korean Autonomous Police System)

초록

한국에서 자치경찰제를 부분적으로 도입한지도 13년이 지났다. 한국에서의 자치경찰제는 대한민국 헌법의 지방자치 이념에 다가서는 의미가 있고, 지방행정과 치안행정의 연계성을 강화하고, 자치분권과 지역특성에 적합한 치안서비스 제공으로 주민의 삶의 질을 높이는 종합행정의 완성이라는 법적・제도적 의의가 있다.
이 연구에서는 자치경찰제의 본격적인 도입에 앞서 자치경찰제 수용을 위한 지방정부의 여건을 살펴보고, 자치분권과 지방자치를 위한 제 법률 및 자치경찰제를 위한 법률안을 검토하고자 한다. 그리하여 동 법률안의 심의과정에서 반드시 논의될 필요가 있다고 판단되는 몇 가지 법적 쟁점을 도출한 후, 우리나라의 여건에 보다 적합한 자치경찰제 도입에 필요한 발전적 제언과 정책적 시사점을 모색하고자 하였다.
정부안은 자치경찰의 사무범위와 관련하여 제주자치경찰의 사무 분배 외에 생활안전, 여성청소년, 교통, 지역경비, 일정부분의 수사 등이 포함되어 있다는 점에서 제주자치경찰보다는 다양한 사무를 자치경찰이 담당하도록 하고 있다. 하지만 일부에서 지적하는 바와 같이 실효적 자치경찰제를 실시하여야 실질적인 자치행정과 자치치안이 가능할 것이라는 측면에서 국회의 논의과정에서는 반드시 고려되어야 할 몇 가지 사항을 쟁점별로 논의하였다. 이 연구는 지방분권법상의 사무배분의 원칙에 의거하여 국가경찰 사무와 자치경찰 사무의 배분 기준 등이 적절한지, 본질적인 자치경찰을 구현할 수 있도록 충분한 경찰업무가 이관되는지, 기타 조직과 인사 등 국가경찰과 자치경찰의 사무 배분의 전제가 되는 사항을 중심으로 자치경찰제 도입의 법적 쟁점과 과제를 검토하고 합리적 대안을 제시하였다.

영어초록

It has been 13 years since Korea partially introduced the autonomous police system. The autonomous police system in Korea is meaningful in approaching the local autonomy ideology of the Republic of Korea's Constitution, and the legal and institutional significance of completing a comprehensive administration that strengthens the link between local administration and policing administration, and improves the quality of life of residents by providing security services suitable for autonomy and regional characteristics.
In this study, we will examine the conditions of local governments to accept the autonomous police system before the full-fledged introduction of the autonomous police system, and review the laws for the autonomous and local autonomy system. Thus, after drawing up some legal issues that are deemed necessary to be discussed during the deliberation process of the bill, the government sought to find the necessary development suggestions and policy implications for the introduction of a autonomous police system more suitable to the conditions of the country.
Regarding the scope of the police's office, the government autonomous police system plan calls for the police to take charge of a variety of affairs rather than Jeju police, given that they include living safety, women and youth, transportation, regional security and a certain amount of investigation, in addition to the division of the office by the Jeju Provincial Police Agency. However, as some pointed out, several points that must be considered in the process of the National Assembly were discussed on a case-by- case basis, in the sense that effective self-governing and self-governing measures would be possible only when an effective autonomous police system is implemented. Based on the principle of division of office under the Local Autonomy Act, this study examined the legal issues and problems of introducing the autonomous police system were reviewed and rational alternatives were proposed, focusing on whether the criteria for allocation of national police offices and autonomous police offices are appropriate, whether sufficient police work is transferred to implement essential autonomous police, and other matters that are the premise of the division of the national police and autonomous police departments, such as organizations and personnel.
