국민참여재판의 시행상의 문제점과 개선방안 (The problem and Improvement Plan in Enforcement of Citizen Participation Trials)

초록

국민참여재판은 국민이 재판주체로 직접 참여함으로써 사법에 있어서 국민주권주의와 참여민주주의를 실현하고, 사법의 민주적 정당성과 투명성을 제고함으로써 ‘국민’으로부터 신뢰받는 사법제도를 확립하려는데 그 목적이 있다. 그러나 국민참여재판은 여러 가지 시행상의 문제점이 나타나고 있어 아직 완벽한 제도로서의 정착은 요원하다.
그 시행상의 문제점으로는 낮은 접수율과 높은 철회･배제율, 피고인의 부정적 인식과 소극적 태도, 배심원의 평결과 권고적 효력, 배심원의 법률적 지식과 양형판단, 3심제도와의 충돌과 높은 항소율, 감성위주의 재판 가능성, 소송절차의 번잡상과 홍보부족 등이 지적된다. 따라서 이를 개선하기 위한 방안으로는 국선변호인을 통한 피고인의 지원강화, 피고인들의 인식전환을 위한 법원과 정부의 적극적인 홍보, 참여재판 대상사건의 범위 확대, 배심원 구성의 다양성 확보, 국민의 적극적인 참여와 재판 이해도 제고 등이 필요하다.
이를 통하여 피고인들은 국민참여재판에 대해 가지고 있었던 막연한 의구심도 해소될 것이고, 그 신청 또한 더욱 활발해질 것으로 기대된다. 법조 측에서도 더욱 높은 차원의 국민을 위한 법조로서의 역할을 담당할 수 있고 보다 나은 사법서비스를 제공할 수 있게 될 것이다. 따라서 국민참여재판이 실질적으로 ‘국민’중심으로 운영될 수 있도록 그리고 그 시행상의 문제점의 개선을 통해 조속히 착근될 수 있도록 지속적인 관심과 적극적인 참여가 필요하다.

The Citizen Participation Trials the citizen directness participates with a justice subject with to be to administration of justice, comes true the popular sovereignty and participatory democracy, raises the democratic justifiability and transparency of administration of justice and with from ‘citizens’ establishes the justice system which is trusted there is the goal. But the Citizen Participation Trials the various problem in enforcement are appearing and still the fixation with from a perfect system is remote.
With low-end receipt ratio and a high withdrawal and exclusion ratio, the recognition which the defendant is negative and passive attitude, verdict and advice effect of jury, legal knowledge and assessment judgment of jury, collision with three core systems and high appeal ratio, the justice possibility which is sensitivity, a troublesomeness and publicity shortage of legal procedure etc. are indicated with the problem in enforcement.
Consequently about the support reinforcement of the defendant who leads the court-appointed lawyer, an active publicity of the court and the government for the recognition conversion of the defendants, scope magnification of participation justice objective case, variety security of jury composition, the active participation and understanding raising of justice ets. are necessary with improvement plan.
From this cause, the defendants about Citizen Participation Trials also the misgivings which is vague is having being solved and the application also are expected with the fact that will become more actively. Legal profession side tries there to be will be able to take charge of the role of the themselves for the nation of a higher dimension will be able to provide the judicial service which recovers. Therefore the Citizen Participation Trials could be operated substantially in `national' centers in order and improvement of problem in enforcement to lead and as soon as possible take root in order to be, which the continuous interest and active participation is necessary.
