특허법상 공지예외적용에 관한 연구 (A Study on Grace Period for Patents)

초록

본래의 특허제도에는 선발명주의와 선출원주의가 있다. 선발명주의가 가장 이상적인 제도임에도 불구하고 대부분의 국가들은 제도의 운영이나 특허분쟁 등의 이유로 선출원주의를 취하고 있다. 하지만 선출원주의를 취하고 있는 국가에서는 특허출원 전에 발명을 공개한 자를 보호하기 위하여 특허법에 공지예외적용제도를 규정하고 있다. 우리나라에서 공지예외적용을 받기 위해서는, 발명이 최초로 공지된 날로부터 12월 이내에 특허출원이 되어야 하고, 특허출원인은 그 특허출원서에 취지를 기재하고 또 증명서류를 특허출원일로부터 30일 이내에 제출하여야 하는 것이 원칙이다.
지팡이 아이스크림 사건에서, 특허권자는 특허출원을 할 때에 공지예외적용절차를 밟지 않았기 때문에 결국 그 특허권은 특허출원 전 발명의 공개로 인하여 신규성 및 진보성 위반으로 무효가 되었다. 이러한 절차가 발명자 보호에 부적절하다는 견해에 따라, 보정할 수 있는 기간 또는 특허결정 또는 특허거절결정에 대한 취소심결의 등본을 송달받은 날부터 3월 이내의 기간에 공지예외적용을 받으려는 취지를 적은 서류와 이를 증명할 수 있는 서류를 제출하면 공지예외적용을 받을 수 있도록 특허법이 개정되었다.
하지만 개정된 특허법도 특허권자에게 실질적으로 도움이 되지는 못한다. 그 이유는 발명자가 공지예외적용제도를 잘 알지 못하기도 하고 또 개정 특허법이 비효율적이기 때문이다. 그러므로 본 논문은 미국처럼 이러한 절차가 필요 없도록 하든지, 아니면 디자인보호법에 있는 “신규성상실의 예외”에서처럼 무효심판에 대한 답변서를 제출할 수 있는 기간에도 그 취지 및 증명서류를 제출할 수 있도록 법률 개정을 제안한다.
또한 공지예외적용제도는 국가마다 기간이나 절차 등에서 차이가 있기 때문에 이러한 제도를 잘 알지 못하는 발명자들이 피해를 받을 수 있다. 따라서 본 논문은 우리나라 발명자들이 다른 국가에서 권리를 행사하는데 도움이 될 수 있도록 다른 국가의 공지예외적용제도를 소개하고자 한다.

영어초록

In the original patent system, there is a first-to file rule and a first-to invent rule. Despite a first-to invent rule being the most ideal system, most countries are taking a first-to file rule because of the management or the dispute of the patent. And in order to protect those who disclosed the invention before the patent application, the Korean Patent Law has a Grace Period. In order to receive such Grace Period, the patent application must be filed within 12 months from the date that the invention was published and a patent applicant shall file a patent application to that effect and submit documents evidencing the relevant facts to the Commissioner of the Korean Intellectual Property Office within 30 days from the filing date of the patent application.
In this case of a cane ice cream, a patentee having the patent right related to cane ice cream did not follow the related procedure at the time of filing a patent and at last the patent right was invalided. But this is against the intention of the patent system granting rights in exchange for disclosure. Therefore, in accordance with the view that such a system is insufficient for the protection of the inventor, the Korean Patent Law was revised so that if a patent applicant submit the effect and documents evidencing the relevant facts within (1) the period during which amendment is permitted or (2) a period of not more than three months from the date when the certified copy of a written decision to grant a patent or the certified copy of a written judgment to revoke the decision to reject a patent application is served, the patent application can be receive the Grace Period.
However, this revised patent law does not really help patentees. This is because the inventors do not actually know the system and the revised patent law is ineffective. Therefore, this study suggests the system not to prescribe the time when the procedure should be followed like the United States or to follow the procedure at the time when the patentee submits a written reply to a petition for an administrative patent trial like the Design Protection Act.
In addition, this study also aims to introduce the foreign system related to the Grace Period so that the inventors do not cause unjustifiable damage because they do not actually know the Grace Period system which differs from country to country.
