미얀마 군부의 로힝자족 탄압과 대응방안 (The Oppression of the Rohingya people by the Myanmar's Military and its Countermeasures)

초록

이 글의 목적은 ‘제도로서의 군부’에 의해 자행되고 있는 로힝자족에 대한 탄압 사태 고찰을 통하여 어느 정도 인권 침해를 초래하였는지와 이에 대한 진상규명과 책임자에 대한 처벌, 그리고 국제사회 및 국내의 대응방안을 도출하는 것이다. 로힝자족 탄압의 원인에는 영국의 식민유산이 남긴 역사적 앙금과 다수의 불교도국가에 이슬람을 믿는 로힝자족 간의 갈등이 중요하게 작용하고 있다. 미얀마 내에서 벌어진 로힝자족 탄압 문제를 조사해온 유엔 진상조사단은 2018년 8월 27일 보고서에서 미얀마군부가 인종 청소 의도를 갖고 대량학살과 집단 성폭행을 저질렀다고 밝혔다. 조사단은 또 미얀마군의 민 아웅 흘라잉 총사령관과 다른 다섯 명의 장성을 국제법에 따라 중범죄 혐의로 법정에 세워야 한다고 촉구했고, 군부가 로힝자족 주택에 불을 지르고, 어린 아이들을 불길에 던지거나 여성들을 성폭행하는 등의 각종 범죄가 기록된 군부의 유혈탄압 내용을 정리한 보고서를 2019년 8월 10일 냈다. 이와 같은 유엔의 노력으로 국제 여론은 크게 동요되었고, 2019년 11월 서아프리카 무슬림 국가인 감비아가 이슬람 협력기구를 대신해 미얀마를 집단학살 범죄의 예방과 처벌에 관한 협약을 위반한 혐의로 국제형사재판소(ICC)에 제소하였다. 하지만 미얀마의 정치적 방향은 정해진 것으로 보이며 정부, 군부, 그리고 거의 전 국민이 로힝자족 사태에 대해서는 단결되어 있다. 이를 뒷받침하듯이 2019년 11일 미얀마의 실권자인 아웅산 수지 국가 고문이 무슬림 소수 민족 로힝자족 집단학살 협의를 받은 미얀마 군부를 변호하기 위해 네덜란드 헤이그 국제형사재판소에서 열린 ‘로힝자 집단학살’ 재판에 서서 미얀마 군부의 학살 혐의를 부인했다. 아무리 국제사회가 로힝자 문제를 해결하기 위해 노력한다 해도 갈등 행위 주체인 미얀마 정부와 군부의 자발적 해결 의지가 없다면 문제를 해결할 수 없다. 따라서 미얀마 정부는 소수 민족에 대한 열린 마음을 가지고 로힝자족을 미얀마의 국민 일원으로 받아들일 수 있도록 로힝자족의 평화 해결을 위해 노력해야 한다. 따라서 미얀마 정부는 로힝자 사태가 더 악화하지 않도록 국제기구와의 협력을 강화해야 하고 군부와 타협을 통하여 로힝자 위기를 원만히 해결해 나가야 한다. 다음은 군부의 완전한 병영 복귀와 민간 우위의 원칙 확립이다. 현재 상황에서 군부는 정치권에서 철수하고 스스로 병영으로 복귀하지 않는 이상 민간정부에 의한 군부 통제는 불가능하므로 이를 해결하기 위해서는 헌법 개정이나 군부가 정치에 개입할 여지를 완전히 소멸시키는 조건이 마련되어야 한다. 인권 문제가 지속해서 발생할 경우에는 국제사회의 강력한 경제적 제재조치와 인도적 군사적 개입을 고려해 볼 필요가 있다.

영어초록

The purpose of this study is to examine how much human rights violations were committed by the military as a system through exploring the violence against Rohingya to reveal the truth, punish those in charge, and induce the countermeasures of international and domestic societies. As causes of the oppression against the Rohingya people, the conflicts between numerous Buddhist counties and Rohingya which believes in Islamic religion as well as historical deposits left as the British colonial heritage play a significant role. The UN Verification Mission in Myanmar which has been investigating the oppression against Rohingya people, reported in an August 27, 2018 reported that the military army committed genocide and mass rape with the intention of racial cleansing. The UN Verification Mission in Myanmar urged military commander Min Aung Hlaing and other five commanders-in-chief of Myanmar's military to be brought to the court for the charges on felony offenses under the international law. It also recorded and published the report that the military set fire to the houses of Rohingya, threw young children into the fire, and committed a wide range of crimes such as the military's bloodshed including sexual assault on women in Aug. 10, 2019. The international public opinion was greatly shaken with the efforts of the UN and the Gambia, a West African Muslim nation, requested to the International Criminal Court (ICC) to seek the jurisdiction over the charges of the infringement for the Convention on the Prevention and Punishment of Genocide Crimes in Myanmar on behalf of the Islamic Cooperation Organization in Nov. 2019. Myanmar's political direction, however, appears to be fixed, and almost all of the people as well as the government and the military across the entire nation are united in their view of Rohingya people. In support of this, Aung San Suu Kyi, a state advisor of Myanmar and power-holder denied the charges of military massacre for Rohingya at a trial, held at the International Criminal Court in The Hague, Netherlands on 11 May 2019, in defense of the Myanmar military. No matter how the international community tries to solve the Rohingya problem, it cannot be resolved without the will of the Myanmar government and the military, which is the subject of the conflict. Therefore, the Myanmar government should strive to resolve the peace of Rohingya people with an open mind towards minorities. Accordingly, the government of Myanmar should strengthen cooperation with international organizations so that the Rohingya crisis will not get worse and find an amicable settlement through the compromise with the military to resolve the Rohingya crisis. The next thing to be required is the complete return of the military and the establishment of the principle of putting the civil society on the priority. Under the current circumstances, the control to the military by the civilian government is not possible unless the military withdraws itself from the politics and returns to the barracks on its own. To resolve this, conditions that completely eliminates the military's involvement in politics should be provided or the constitutional amendment should be made. If human rights issues continue to arise, it is necessary to consider strong economic sanctions and humanitarian military intervention in the international community.
