저당권의 효력이 미치는 차임채권 등에 대한 저당권 실행방법 - 대법원ﾠ2016.7.27.ﾠ선고ﾠ2015다230020ﾠ판결 - (Method of Foreclosure against the Claim for Rent on which the Mortgage has an Effect)

초록

저당권실행에 따른 압류 후의 차임채권에 저당권의 효력이 미치지만(민법 제359조) 차임채권에는 압류의 효력이 미치지 않으므로, 저당권자는 저당부동산과 함께 경매절차에서 차임채권을 환가하거나 수취하여 피담보채권에 충당할 수 없다. 따라서 저당권의 효력이 미치는 차임채권 등에 대한 저당권의 실행은 저당권의 효력이 존속하는 동안에 민사집행법 제273조에 따른 채권집행의 방법으로 저당부동산에 대한 경매절차와 별개로 이루어질 수 있을 뿐이라는 대상판결의 태도는 타당하다. 또한 보증금을 수수한 당사자의 진정한 의사는 임대차에 따른 모든 채무를 담보하기 위한 것이므로, 저당권자가 차임채권 등에 대하여 별개로 저당권을 실행하지 않은 경우나 별개로 실행된 채권집행절차에서 임차인이 차임을 지급하지 않은 경우에는 연체차임 등을 보증금에서 당연히 공제하는 것이 당사자의 의사와 거래관념에 부합한다. 한편 민법 제359조가 저당부동산의 담보가치를 충실하게 확보하여 피담보채권의 변제에 만전을 기함으로써 저당권자를 보호하려는데 그 직접적인 목적이 있는 점을 비추어 보면, 입법적으로 담보권실행에 의한 경매절차가 개시되어 저당부동산이 압류된 경우에는 경매개시결정을 임차인에게 송달하여야 하고, 이때 차임채권에 압류의 효력이 미친다는 규정과 함께 압류시부터 저당부동산이 매각될 때까지의 차임채권이 저당권자에게 이전된다는 규정을 신설할 필요가 있다고 할 것이다.

영어초록

Although the mortgage has an effect on the claim for rent after seizure by the foreclosure (Article 359 of the Civil Act), the seizure has no effect on the claim for rent. Thus, a mortgagee cannot realize or collect the claim for rent in an auction procedure together with the mortgaged real property to cover the secured claim. Therefore, the attitude of the Supreme Court 2015da230020 decision rendered on July 27, 2016 is reasonable, stating that the foreclosure against the claim for rent on which the mortgage has an effect can only be executed separately from auction procedure against the secured real property in a way of claim execution in accordance with the Article 273 of the Civil Execution Act while the effect of mortgage exists. In addition, since true intention of the party who has provided the deposit is for securing all debts arising from the lease, the rightful deduction of rent in arrear from the deposit conforms to the indention of the party and the transaction practices in the case that a mortgagee fails to foreclosure separately against the claim for rent or in the case that a lessee fails to pay the rent in the claim execution procedure conducted separately. In the meantime, considering the fact that the direct purpose of Article 359 of the Civil Act lies in protecting the mortgagee by fully ensuring the repayment of the secured claim through a faithful securement of security value of the secured real property, it may be considered as necessary legislatively to newly enact a clause stipulating that in case the auction procedure is initiated by the foreclosure and the secured real property is seized, the decision of auction initiation shall be served to the lessee, and at this time the seizure shall have an effect on the claim for rent, and also a clause stipulating that the claim for rent shall be transferred to the mortgagee for the period from the time of seizure to the time when the secured real property is sold.
