초록

갱생보호의 대상자는 형사처분 또는 보호처분을 받은 자로서 자립갱생을 위한 숙식제공, 여비지급, 생업도구와 생업조성금품의 지급 또는 대여, 직업훈련 및 취업알선 등 보호의 필요성이 인정되는 사람이다. 출소자의 성공적인 사회복귀는 매년 범죄로 인해 지출되는 사회적 비용을 절감하는 동시에 사회 안정과 통합에 기여한다. 따라서 출소자의 사회적 적응을 돕는 일은 재범을 방지하고 사회안전망을 구축하는데 일조하는 것으로 매우 중요한 과제이다. 일찍이 유럽 등 선진 외국에서는 갱생분야의 중요성을 인식하고 다양한 연구를 수행하여, 이를 실무에 반영하고 있다. 현재 영국이나 캐나다는 보호관찰 및 갱생보호 분야에 많은 국가적 지원을 아끼지 않고 있다. 영국에서는 교화사업 투자자에게 출소 후 재범이 줄면 원금에 13%의 이자를 더해 지급하며 범죄가 줄어들지 않으면 한 푼도 지급하지 않는다. 범죄자 ‘맞춤형 사회복귀 서비스’를 활용하며 예산부족은 사회성과 연계채권(SIB)에 의존한다. 출소자의 바람직한 사회복귀를 위해서는 갱생보호에 대한 민간의 참여와 관심이 확대되어야 하며 출소자 사회복귀 프로그램에 별도의 투자방안을 모색하여야 할 시점이다. 국‧내외 갱생보호제를 비교‧분석한 결과, 특히 가족지원사업 등은 출소자의 재범률을 낮출 수 있는 측면에서 강점이 있다. 정부의 적극적이고 추가적인 지원이 필요하다고 하겠다. 향후 이와 관련된 외국의 모범사례를 참조한 연구 결과가 출소자들의 처우 및 관리에 바람직한 지침이 되길 바란다. 나아가 그들이 우리 사회의 건강한 구성원으로 되돌아가는 데에 도움이 되기를 기원한다. 정책방향으로는 단행법률의 정비 및 전담부서의 설치 등으로 범죄자 재범방지대책을 수립하기 위한 논의를 활성화시킴으로써 우리의 법무보호복지수준이 선진국 수준으로 나아가는데 일조할 수 있을 것으로 본다.

영어초록

The successful rehabilitation of ex-offenders each year, will be able to reduce the social costs to be paid to crime. At the same time, I want to contribute to the integration and social stability. Therefore, in addition to ex-offenders themselves, offenders rehabilitation services to support the social adjustment of reintegration subjects, is an important issue when viewed from the context of society as a whole. We have taken steps that are associated with effective treatment program in the community for re-integration process. we will find an ensuring method for the effectiveness of operating a more successful treatment and affiliated programs for the process of the reintegration within society. It is a comparative study on the protection of rehabilitation on the important research method. During each step, the implementation of proper diagnosis and treatment related to environmental factors outside and internal psychological factors, and shall cooperate in the step between all especially. Importantly, the interactive cooperation among corrections, probation and rehabilitation staff should be intensified but more fundamental solution will depends on the overall integration toward the National Correction & Protection Service. In addition, with the goal of efforts to restore this, react to long-term psychotherapy positive, to provide vocational training practical for rehabilitation, providing a wide range of contact with the family, you must be running at the same time from their early stages of imprisonment. The support business and family, there is advantage in terms which can lower the recidivism rate of offenders. I said that is a proactive government, the need additional support. On the basis of foreign precedent, we suggested that Korea Correctional Service, the department of Crime Protection and Korea Rehabilitation Agency should be working together for the project. Especially after they return to society should provide stable employment. Human and material resources should be supported so as to ensure. Rehabilitation projects by the private sector and the expansion of protection for the development of rehabilitation system is a significant improvement. We expect to propose a significant support of government dimension of private rehabilitation corporation and korea rehabilitation agency in the future.
