플랫폼 노동 종사자 지원 조례 제정 현황과 내용 분석* (Abstract Analysis of the Status and Content of the Enactment of Ordinaces supporting Platform Workers)

초록

본 연구는 전국 21개 지방자치단체에서 제정된 『플랫폼 노동 종사자 지원 조례』의 제정 현황과 조례 내용을 조례분석모형으로 비교 분석하여 개선 조례를 제안하는데 목적이 있다. 조항 존재 분석으로 조례는 목적, 정의, 적용 대상, 단체장의 책무, 실태조사, 지원사업, 계획의 수립, 협의회·위원회에 관한 내용 등으로 구성된 것을 확인하였다. 구체적으로 규범적 체계에는 자치단체에 따라 지원계획 수립에 차이가 있고, 임의조항과 노력조항으로 책임소재와 실효성 확보의 보장이 불분명한 조항이 존재한다. 실효성 체계에서는 플랫폼 노동 종사자의 지원과 보호를 위해 전담부서와 위원회의 구성 및 운영 조항의 수정과 추가가 요구된다. 분석결과를 바탕으로 첫째, 단체장의 책무조항은 강행 조항으로 상향되어야 하고 둘째, 위원회의 역할 강화를 위한 조항의 추가가 필요하다. 셋째 플랫폼 노동 종사자 대표가 위원회의 구성원으로 참여하여 당사자의 의사가 반영되어야 하고, 마지막으로 조례와 지원계획이 부합하는지를 지속적으로 모니터링할 수 있는 제도가 필요하다는 정책적 함의를 도출하였다.

영어초록

This study is to propose an improvement ordinace by comparing and analyzing the enactment status and contents of the compared and analyzed the enactment status and contents of the 『Platform Worker Support Ordinance』 enacted by 21 local governments nationwide using an ordinance analysis model. Through analysis of the existence of provisions, it was confirmed that the composition of the ordinance includes purpose, definition, application target, responsibilities of the head of the organization, actual situation survey, support project, establishment of plan, council/committee, etc. As for the normative system, it was confirmed that there are differences in the establishment of support plans depending on the local government, and that there are provisions where responsibility and effectiveness are unclear due to arbitrary and effort provisions. In the effectiveness system, it was confirmed that modifications and additions to the composition and operation provisions of dedicated departments and committees were necessary to support and protect platform workers. In order to secure the effectiveness of the ordinance based on the analysis results, the responsibility clause of the head of a local government should be upgraded to a mandatory clause. Second, it is necessary to add an additional clause to strengthen the role of the council and committee. Third, workers’ representatives must participate as members of the council and committee to reflect the parties’ intention. Lastly, policy implications were drawn that a continuous monitoring system is needed to ensure that the ordinance and support plan are in compliance.
