근대 일본의 통치라는 신체성: 메이지 헌법의 구성과 바디폴리틱(Body Politic) (Body Politic and Governmentality in Modern Japan: Constructing Meiji Constitution and Metaphor of Body)

초록

이 논문은 근대 국가를 상상, 재현, 구상하는데 메이지 헌법, 군인칙유, 교육칙어에서 나타나는 국가-신체 은유를 살펴본다. 이를 통해 근대 서구의 국가론과 어떻게 연결되는지, 이것이 전통적 논의 속에서 어떻게 굴절되는지를 신체정치의 측면에서 보고자 한다. [헌법의해]라는 텍스트는 이토 히로부미의 명을 받아 이노우에 코와시가 작성한 헌법에 대한 주석으로, 여러 바디폴리틱적 요소들이 표현되고 있다. 가령 한 나라의 토지를 일개인의 신체와 같다고 표현하며 근대적 경계를 확정하려는 태도나, 천황을 머리로 비유하며 사람의 몸에 사지가 있지만 정신의 경락이 머리로 돌아가는 것과 같다는 논리로 주권의 유일함을 강조하기도 한다. 이러한 천황과 인민의 관계를 나타내는 신체적 사유는 군인칙유와 교육칙어를 통해서도 확장된다.
하지만 서구의 국가유기체설이 군주의 역할을 강조하기 위한 것이 아니라, 국가 그 자체를 인격화하기 위한 것임을 감안하면 이들 텍스트에서 보이는 바디폴리틱에 대한 논의들은 전근대적 사유의 연속처럼 보인다. 그러나 명령으로 인한 복종의 신체성이 강조되는 동시에, 사적 지배의 논리를 거부하는 근대적 통치 개념 역시 도입하고 있다. 메이지 헌법 1조의 ‘통치’라는 개념에 대한 설명에서 보듯이 이는 근대적 통치 개념과 전통적인 다스림의 개념을 교묘하게 섞고 있는 것이었다. 이러한 관점에서 보자면 머리가 사지를 다스린다고 할 때 이는 단순히 명령-복종의 지배관계에만 놓인 것이 아니라, 다스림의 전통적인 신체적 의미와 이어진다. 이는 서양의 유기체설에 대한 불충분한 이해라던가, 중세적 유기체설을 받아들인 것이라기보다 서로 다른 신체관 혹은 세계관을 가진 장소에서 근대와 전통 사상이 접합되면서 생기는 굴절의 양상의 측면을 보이는 것이다.

영어초록

In previous studies, it is estimated that there is no theory of state in Eastern political thought. On the other hand, it is said that the logic of the West was transplanted into modern East Asia to constitute the nation state without any transformation. However, this paper examines state-body metaphor that appears in Meiji Constitution, Imperial Rescript on Education and Imperial Rescript to Soldiers and Sailors to show how they imagined, represented, and constituted the state and the governmentality. By doing so, I want to show how 19th Western organicism was translated modern Japan to make ‘nation state’.
The text ‘Kenpogige’(Commentaries on the constitution of the empire of Japan) is written by Inoue Kowashi under Ito Hirobumi’s direction and commented on each article of the Meiji Constitution. It shows the sole principle of sovereignty, which expresses that the land of a country is the same as the individual's body to confirm the modern boundary. And modern governmentality was shown in the metaphor that the emperor is the head and people are the limb of human body. This kind of metaphor also extends through ‘Kyouikuchokugo’(Imperial Rescript on Education) and ‘Gunjinchokuyu’(Imperial Rescript to Soldiers and Sailors). This shows that the concept of body politic as a command system becomes clearer.
This seems to be a continuation of the premodern thought, given that the Western state organism theory is not to emphasize the role of the monarch but to personify the state itself. However, it can not be confined to the logic that emphasizes the transcendence of the emperor. This can be seen from the concept of ‘Sirasu’(to govern/to know)’ of Article 1 of the Meiji Constitution. ‘Sirasu’ meant knowing the object with the mind in the sense that it was not the domination of power or power but the domination of the mind through the virtue of the monarch. It was a combination of modern ruling concepts and traditional ruling concepts. In that sense, this was not an insufficient understanding of the western organism theory, but rather a reflection of the notion of body that occurs when modern and traditional ideas are joined in places with different notion of body.
