로스쿨 학생들이 바라보는 바람직한 법사회학 강의의 구조 －현상학적 질적 연구방법에 의한 도출－ (The Preferred Structure of the Class of Sociology of Law among Law School Students －Using Phenomenological Qualitative Method－)

초록

본고는 로스쿨제도 하에서 법사회학 강의가 어떻게 이루어져야 하는가라는 문제의식의 연장에서, 로스쿨 학생들이 바라보는 바람직한 법사회학 강의의 구조가 무엇인지를 파악해보려는 시도이다. 교육이 반드시 학생들의 요구에만 입각해서 이루어지는 것은 아니지만 적어도 그것을 도외시 하는 것은 바람직하지 않기 때문에 이러한 연구는 로스쿨에서 법사회학 강의를 설계하려는 교수들에게 일정한 시사점을 줄 수 있다고 본다.
본고에서 채택한 연구방법은 현상학적 질적 연구이다. 즉, 학생들이 법사회학과 관련하여 가진 체험에 관한 조사결과를 일차적인 자료로 하여 이로부터 학생들이 생각하는 바람직한 법사회학 강의의 구조를 도출하는 방식을 채택했다. 도출된 결론은 다시 학생들에게 회람하여 검증하는 과정을 거쳤다.
연구결과 학생들 사이에는 법사회학 강의의 지향점, 교육방법 등에서 바람직한 법사회학 강의에 관한 일관되고 단일한 구조가 존재함을 확인할 수 있었다. 연구결과에 의하면, 학생들은 토론을 통해서 한국사회의 법현상에 관한 비판적 이해를 제고하는 것이야 말로 바람직한 법사회학 강의의 핵심이라고 보았다. 이러한 연구결과는 로스쿨 학생들이 직업적 관심에 매몰되어 실용적 지식만 추구할 뿐 추상적․비판적 법 이해에는 그다지 관심이 없을 것이라는 여러 예측과는 큰 괴리를 보인다.
이상의 연구결과를 섣불리 일반화하기는 힘들겠지만, 그럼에도 불구하고 법사회학 강의를 설계하고 개선하는 데에 상당한 시사점을 줄 것으로 기대한다.

영어초록

With in mind the current issues on the right ways to teach sociology of law(SL) in law school, this article tries to show the structure of SL class which is preferred by law school students. This research was intended to provide the SL professors with some implications in deciding what and how to teach in SL classes, though admitting that not every SL class should succumb to the students’ needs.
The methodology adopted in the research is so-called ‘phenomenological qualitative research’, which pursues the structure of phenomenon by grounding on and transcending from the obviousness of the life-world. I began my research with collecting raw materials through surveys and interviews with 14 law school students, and then from the materials I drew out meanings, sorted them into the theme categories and finally made an exhaustive description of the preferred structure of SL class. The exhaustive description was sent back to all the participants(interviewees) so that they could comment on and verify the contents.
This article finds that there exists a common structure of SL class which is preferred by law school students, especially in terms of the objective and the method of SL classes.
According to the research, students want to reach a theoretical or critical understanding of law through discussions among themselves in SL class, rather than to enhance technical knowledges or law-related practical skills. They want the professor of SL to remain as a facilitator of the discussions. The findings of this research are somewhat surprising because most professors, including myself, expected that law school students are so concerned about passing bar examination and future jobs as not to be interested in the theoretical understanding of the law and society.
While it may be difficult to presume that all the law school students agree with the findings of this qualitative research, still it should be recognised as a matter of fact that there exists a common understanding on the recommendable structure of SL class among many law school students. The findings should not simply be ignored in organizing lectures on SL, which means that a lot of changes in current syllabuses of SL in law school are inevitable.
