국제장애인권리협약 국내비준에 따른 장애여성정책의 발전방안에 관한 연구 : 관련법 내용분석을 중심으로 (A study on ways to develop policy toward women with disabilities according to the ratification of the international convention on the rights of persons with disabilities in Korea : based on institutio)

초록

본 연구는 장애여성의 정책적 보편성과 특수성(다중적 차별 포함)에 기반하여 국제장애인권리협약과 관련 국내법들에 대한 독립적 가치와 관련성 하에서의 의의를 제도분석차원에서 접근하여 분석함으로써 장애여성정책 정립의 시사점을 얻고자 하였다. 이에 장애여성정책과 관련한 장애인관련법과 여성관련법 모두를 함께 분석하였는데, 이중 직접적인 관련성을 갖는 제도로 각각 6개를 선별하여 분석하고, 국제장애인권리협약은 협약 내 장애여성관련 조항 9개 영역, 20개 조항을 중심으로 전체적인 맥락과 타 협약 혹은 국내법과의 관련성 하에서 분석하였다. 이에 국제장애인권리협약의 국내비준을 국내법에 대한 수동적 영향과 반응적 접근이라는 차원보다는 장애여성정책정립의 기준 혹은 준거로의 설정과 선응적 접근이라는 차원에서 발전방안에 대해 논의를 하였다. 결론적으로, 국제장애인권리협약의 전문 및 일반규칙, 분야별 영역에서 담아내고 있는 인권패러다임, 사회관계적 모델(사회적 장애개념 포함), 성인지적 관점과 생애주기적 접근을 국내법 정립의 기본 규범적 가치로 설정하고, 주요 영역에 대해 실천과제를 제시하였는데, 건강권과 관련해서는 적절한 비용에 의한 최고의 서비스보장을 위해 건강보험 보장성의 강화, 전문의료전달체계의 구축 등을, 가정과 관련해서는 장애여성의 재생산권과 장애아의 생명권을 보호하기 위한 모자보건법 개정과 폭력 등의 취약성 보호를 위한 가정폭력방지법의 개정을, 고용과 관련해서는 노동 전 과정의 노동공급정책에서의 성별특성의 강화 등을 포함한 장애인고용촉진법과 남녀고용평등법의 개선을, 교육과 관련해서는 기회평등 이상의 적극적 조치를 위한 특수교육법의 개정을 각각 제시하였다.

영어초록

This study aimed at making suggestions for the establishment of the policy for women with disabilities by approaching, through an institutional analysis, the separate value and significance of the International Convention on the Rights of Persons with Disabilities and related Korean laws on the basis of the universalism and specialism (including multiple discriminations) of the policy toward women with disability. To this end, all of the disabled-related laws and women-related laws in relation to the policy towards women with disabilities were analyzed. Of those laws, six the disabled-related laws and six women-related laws in direction relation to the policy towards women with disabilities were selected and analyzed. In addition, based on 20 provisions of nine disabled women-related sections of the International Convention on the Rights of Persons with Disabilities, the overall context of the convention and its relation to other conventions and Korean laws were analyzed. The study discussed the ratification of the International Convention on the Rights of Persons with Disabilities in Korea through the setting of standards for the establishment of the policy toward women with disabilities and proactive approach, instead of the passive effect of the international convent on domestic laws and reactive approach. In conclusion, the study set the followings as fundamental normative value for the establishment of related domestic law, and then presented the tasks for each section: the preamble and general principles of the International Convention on the Rights of Persons with Disabilities, human rights paradigm, social relationship model (including social disability) and gender perspective․life span approach covered in its each section. With regard to health rights, the enhancement of health insurance coverage and the establishment of the specialized health delivery system were suggested to secure appropriately-priced high quality health care services. In addition, the amendment of the Mother and Child Health Law for the protection of disabled women's reproductive rights and disabled children's rights to life, and the amendment of the Domestic Violence Prevention Law for the protection of the disabled vulnerable to domestic violence and other domestic problems were suggested with regard to disabled people's family life. Furthermore, the amendments of Employment Promotion for the disabled Law and the Equal Employment Opportunity Law including the enhancement of gender features in the labor supply policy of the entire labor process were proposed with respect to the employment, and the amendment of the Special Education Law for person with Disabilities for the guarantee of aggressive education measures for the disabled beyond equal opportunity were suggested with regard to education.
