「국가표준기본법」 상 국가표준체계의 균형있는 발전을 위한 법정책적 개선방안 (A Study on the Legal Policy-based Improvement Plan for the National Standards System of the “Framework Act on National Standards)

초록

한국은 1980년 헌법에 표준제도 확립을 선언한 이래, 1999년 「국가표준기본법」을 제정하여 국가차원에서 국가표준체계 혹은 국가품질인프라를 확립하여 운영하고 있다. 국가표준체계를 확립하고 운영함에 있어서 중요한 요소 세 가지는 표준화(standardization), 측정학(metrology), 적합성평가(conformity assessment)라 할 수 있다. 측정학은 표준화 또는 적합성평가를 위한 과학기술적 근거를 제공하며, 표준화는 제품 및 시스템의 품질 요건을 기술기준을 포함한 성문표준 등으로 문서화하는 것을 일컫는다. 마지막으로 적합성평가는 위의 두 가지 요소를 바탕으로 시험, 검사 등을 통한 기술적 요건을 확인하는 활동을 말한다.
「국가표준기본법」은 1999년 제정 이후, 국내외 환경 변화에 따라 일부개정 수준으로 정비되긴 하였으나, 국가표준체계를 구성하는 세 가지 요소를 중심으로 기본법을 고찰해 본 적은 없었다. 따라서 이 연구에서는 국제기구 및 해외 측정표준기관 사례를 토대로 국가품질인프라를 향상시키기 위한 법정책적 개선방안을 제시하고자 한다.
첫째, 국가품질인프라를 구성하는 표준화, 측정학, 적합성평가 3가지 요소가 각각 제도로서 운영될 수 있도록 「국가표준기본법」 체계를 정비하는 것이 필요하겠다. 둘째, 국가의 품질 향상 관점으로의 표준관련 업무의 거버넌스 및 법령체계 정비가 요구된다. 셋째, 국가표준심의회의 역할을 확대하고 위상을 강화하는 것이 필요하겠으며, 마지막으로, 적합성평가 제도의 분권화를 통하여 빠르게 변화하는 환경에 발빠르게 대처하는 노력이 필요하겠다.

영어초록

Korea enacted the “Framework Act on National Standards” in 1999 to have the nation establish and operate a national standards system, also referred to as a national quality infrastructure. Three key elements for the establishment and operation of a national standards system are standardization, metrology, and conformity assessment. Metrology provides the scientific and technical basis for standardization and conformity assessment, and standardization refers to the documentation of the quality requirements of products and systems through the means of written standards that include technical standards. Lastly, conformity assessment refers to the task of confirming technical requirements through tests and evaluations based on the two aforementioned elements.
Whereas the “Framework Act on National Standards” has been revised to a certain degree since its enactment in 1999 due to changes in both domestic and overseas circumstances, it has yet to be considered based on the three elements of a national standards system. Therefore, this study aims to propose a legal policy-based improvement plan for the improvement of the national quality infrastructure based on cases of international organizations and overseas metrology institutes.
First, the structure of the “Framework Act on National Standards” should be improved to ensure that the three elements of the national quality infrastructure, standardization, metrology, and conformity assessment, are operated as separate systems. Second, the governance and legal structure of standards-related duties should be improved from the perspective of national quality improvement. Third, the National Standards Deliberative Committee should have its role expanded and status raised. Lastly, the decentralization of the conformity assessment system should be pursued to be able to swiftly adjust to the rapidly changing environment.
