ESG실천을 위한 한-라오스 저탄소 녹색성장 분야 법정책교류협력방안 연구 (A Study on the Legal Exchange and Cooperation between Korea and Laos in the Green Growth Field of Low Carbon)

국문초록

본 연구는 현재 활발하게 논의되고 있는 한국과 라오스의 교류협력 중 ESG 실천과 관련된 라오스의 저탄소 녹색성장 분야 시장 동향 및 관련 법령과 정책 및 주요 행정조직에 대한 분석을 통해 한국의 법정책을 라오스와 협력하기 위한 방안을 목적으로 한다. 라오스는 동남아시아에 위치하여 중국, 베트남, 캄보디아 및 태국과 미얀마와 국경을 공유하며 메콩강을 중심으로 주요 사업이 진행중이다. 라오스의 산업구조는 1차 농업, 축산업 등의 사업이 전체 GDP에서 차지하는 비율이 31%로 매우 높다. 최근 라오스는 이러한 기존의 산업구조를 개편하기 위하여, 경제특구의 지정 및 운영을 통해 해외자본과 해외기술의 도입을 통해 산업구조를 중화학공업 및 서비스산업으로 발전시키려고 노력중이다.
그 결과 경제특구의 개발 및 지원을 중심으로 산업화를 진행한 결과 라오스의 경제는 성장하였으나 동시에 농촌인의 도시 이주로 인한 도시인구의 급격한 증가 및 환경오염이 나타나 도시지역을 중심으로 대기오염, 수질오염, 토양오염, 폐기물의 증가와 같은 부작용이 등장하게 되었다. 라오스는 이러한 문제를 해결하기 위해, 2017년을 기준으로 각종 환경 관련 국제협약(파리협약 및 도쿄의정서 등) 및 국제기준에 따른 국가 환경 기준에 관한 규정을 채택하였다. 동시에 환경법의 개정을 통해, 국가환경전략에 근거하여 중앙 및 지역수준에서 환경보호 및 자원순환 정책을 진행하며, 구체적으로 그 대상은 토양과 수질 오염, 오염관리를 위한 기술의 도입과 폐기물 관리 등에 있어서, 오염관리 원칙과 방법을 법률 차원에서 규정하였다.
라오스는 정책적 차원에서 한국과 지속적으로 교류하면서, 한국의 ESG정책을 참고하고 있으며, 구체적으로 2020년부터 교육과 인식에 대한 국가전략과 천연자원 및 환경 분야의 5개년 계획을 실행하였고, 추가적으로 연장하고 있다. 또한, 가장 중요한 조치 중 하나는 모든 분야에서 환경보호를 주류화하는 것이며, 현재 라오스 사회경제 상황에 적합한 정책을 실행중이다. 라오스가 법률과 정책 등의 개정에도 불구하고 환경보호는 강화되었고, 여전히 관련 분야와의 조정, 기술, 자금 지원 등 해결해야 할 문제들이 남아있는 상황이다. 특히 자원순환과 관련하여 주요 행정조직의 개편 및 각종 법률과 정책의 시행을 위한 부처간의 협력과 업무조율도 진행하고 있다. 그러나 아직까지 법률과 정책적인 측면에서 자원순환경제 및 지속가능한 발전이라는 측면에서 국제사회와의 협력 및 주요 국가와의 법제 및 기술제휴가 이제 막 진행중인 단계이다. 향후 라오스의 자원순환시장의 발전 및 진행을 위해서 주요 국가와 협력은 중요한 과제이다.
본 연구는 향후 한국-라오스 양국간에 진행되고 있는 법정책교륙협력에 이바지하고자 ESG실천을 위한 라오스의 환경 관련 법제 및 자원순환정책에 대한 전반적인 내용을 검토하고, 이와 관련하여 한국의 법률과 정책적 경험을 토대로 향후 라오스에 적합한 지속가능한 발전을 위한 법령과 정책의 개선이 도움이 될 수 있기 위하여 현재 라오스의 자원순환시장의 현황과 주요 법령과 정책 및 행정조직개편에 대한 내용을 본 연구에 주요 내용으로 한다.

Abstract

This study is to collaborate with Laos on Korea's legal policy through analysis of market trends, related laws, policies, and major administrative organizations in the low-carbon green growth sector in Laos related to ESG practice among exchange and cooperation between Korea and Laos, which is currently being actively discussed. Laos is located in Southeast Asia, shares borders with China, Vietnam, Cambodia, Thailand, and Myanmar, and major projects are underway centering on the Mekong River. The industrial structure of Laos is very high with projects such as primary agriculture and livestock accounting for 31% of the total GDP. Recently, Laos is trying to develop its industrial structure into a heavy and chemical industry and service industry by introducing foreign capital and overseas technologies through the designation and operation of special economic zones.
As a result of industrialization centered on the development and support of special economic zones, Laos' economy grew, but at the same time, urban population increased rapidly and environmental pollution occurred due to urban migration, resulting in side effects such as air pollution, water pollution, soil pollution, and increased waste in urban areas. In order to solve this problem, Laos adopted various international agreements related to the environment (such as the Paris Convention and the Tokyo Protocol) and regulations on national environmental standards according to international standards as of 2017. At the same time, through the revision of the environmental law, environmental protection and resource circulation policies are carried out at the central and local level based on the national environmental strategy, and specifically, the principles and methods of pollution management were stipulated at the legal level in soil and water pollution, the introduction of technology for pollution management, and waste management.
Laos continues to interact with Korea at the policy level and refers to Korea's ESG policy. Specifically, since 2020, it has implemented a national strategy for education and awareness, as well as a five-year plan in the fields of natural resources and the environment, and has been further extended. One of the most important measures is to maintain environmental protection in all fields, and policies appropriate to Laos' socio-economic situation are currently being implemented. Laos has strengthened its environmental protection despite amendments to laws and policies, and there are still problems to be solved, such as coordination with related fields, technology, and funding. In particular, cooperation and work coordination between ministries are underway to reorganize major administrative organizations and implement various laws and policies in relation to resource circulation. However, cooperation with the international community and legal and technological alliances with major countries are still in progress in terms of the resource circulation economy and sustainable development in terms of laws and policies. Cooperation with major countries is an important task for the development and progress of Laos' resource circulation market in the future.
