미국의 클라우드 법정책에 대응한 시사점 검토 (Review of implications in response to the US cloud legal policy)

초록

전체 경제에서 데이터경제가 점하는 비중이 늘고 있다. 오늘날 주요 거대기업들은 데이터 또는 IT기업들이다. 그리고 미국의 데이터 또는 IT기업들이다. 그 중에서 클라우드 컴퓨팅은 그 Tech Giants 들에게 더욱 중요한 분야로 부각되고 있다. 클라우드 컴퓨팅은 Tech Giants들이 더 수익을 얻고 더 큰 기업이 되도록 할 분야로 취급받고 있다. 클라우드 컴퓨팅의 의미는 유휴 컴퓨팅 자원을 활용하자는 단순한 개념에서 출발한다. 전지구적 규모의 기업활동을 전개하는 오늘날 Tech Giants 들은, 단순한 개념을 모든 것을 뒷받침하는 기업활동으로 변모시켰다. 이는 앞으로 국가들의 진로와 기술 패권의 움직임과도 밀접하다는 뜻이다. 최근 3년간 코비드19 팬데믹으로 인하여 재택근무의 확대 등으로 클라우드 컴퓨팅 수요를 더 키워왔다. 반대로 Russo-Ukrainian War 등으로 말미암아 Tech Giants들이 일부 후퇴하고, 자원 에너지 기업들이 약진하는 현상도 있었다.
미국 정부는 클라우드 산업이 형성될 때부터 정책적으로 지원을 펼쳐 왔다. 또 다른 법정책적 이슈로서는 2020년 미국 대통령 선거가 있다. 이 선거에서 한 선거 주자는 Big Tech 들에게 철저한 경쟁법 적용을 하여야 한다고 주장하였다. 이러한 주장은 현 바이든 행정부에서도 이어져서, 반독점법을 활발하게 운영할 것이라고 천명하였다. 그리고 반독점을 주장해온 학자들이 주요 경쟁정책 당국에 임명되기도 하였다. 아직 큰 변화는 없지만, 우리는 이를 주목할 필요가 있다. 또 다른 주요 법정책적 이슈는 미국의 CLOUD Act가, 미국 IT Big Tech들이 보유한 역외 서버에 저장된 Data에 마국의 사법적 권한이 미칠 수 있다고 선언한 것이다. 반면 이 법률은, 미국이 아닌 나라가 미국 Tech기업들이 보유한 정보를 요구할 때에는 매우 제한적으로 허용함을 밝히고 있다. 다시 말해 개인정보 국외 이전에 대한, 행정협정이 가능한 국가의 기준을 밝히고 있다. 사이버범죄협약 당사국이나 그 협약에 부합하는 적절한 법률들을 제정한 나라들이라든가, 법치주의와 차별금지원칙을 존중한다든가 하는 다양한 기준들을 세우고 있다.
그 밖에 고려할 법정책적 요소로서는, 개인정보의 역외 이전과 다른 나라들과의 법제도의 충돌에 대한 것이 있다. 첫째는 EU의 개인정보 역외이전에 대한 Data 교류 대상 국가 기준을 고려할 필요가 있다. 둘째 인접한 그리고 교역량이 많은 나라들인 일본과 중국의 개인정보 취급에 대한 기준을 고려할 필요가 있다. 위와 관련된 대책으로서는 글로벌 스탠다드에 부합하는 법정책을 수립하도록 고려하는 것이 필요하다. 다음으로는 IT 산업을 주요 Big Tech기업들이 장악하고 있다. 그러므로 어떤 플랫폼 산업화 하는 경향이 있다. 이에 대응한 법정책을 고려하여야 한다. 마지막으로 초국적 기업을 등장시키는 Data 경제가 도래하고 있다. 충분한 고려가 필요하다. 더불어 Data 경제는 일정부분 안보 또는 국가 존립의 문제와도 이슈를 연계시켜 고려할 필요가 있다. 위에 열거한 모든 사항들은 하나 하나가 모두 매우 큰 주제이므로 충분히 검토되어야 한다.

영어초록

The share of the data economy in the overall economy is increasing. Today’s major giants are data or IT companies. And American data or IT companies. Among them, cloud computing is emerging as a more important field for the Tech Giants. Cloud computing is being treated as an area where tech giants will become more profitable and larger companies. The meaning of cloud computing starts from the simple concept of utilizing idle computing resources. Today’s Tech Giants, who conduct business on a global scale, have transformed a simple concept into a business that underpins everything. This means that it is closely related to the future path of countries and the movement of technological hegemony. Over the past three years, the demand for cloud computing has increased due to the expansion of telecommuting due to the Covid-19 pandemic. Conversely, some Tech Giants retreated due to the Russo-Ukrainian War, and there was a phenomenon in which resource and energy companies made a leap forward.
The US government has been providing political support since the cloud industry was formed. Another legal and policy issue is the 2020 US presidential election. In this election, one voter argued that Big Tech should apply strict competition laws. This argument continued in the current Biden administration, and it was declared that the antitrust laws would be actively implemented. And scholars who have advocated for antitrust have been appointed to major competition policy authorities. There are no major changes yet, but we need to pay attention to this. Another major legal and policy issue is that the US CLOUD Act declares that the US state’s judicial authority can extend to data stored on offshore servers owned by US IT Big Techs. On the other hand, this law states that countries other than the US allow very limited access to information held by US tech companies. In other words, it discloses the standards of countries where administrative agreements are possible for overseas transfer of personal information. Parties to the Cybercrime Convention or countries that have enacted appropriate laws in line with the Convention are setting various standards, such as respecting the rule of law and the principle of non-discrimination.
Other legal and policy factors to consider include the cross-border transfer of personal information and the conflict of legal systems with other countries. First, it is necessary to consider the EU data exchange target country standards for offshore transfer of personal information. Second, it is necessary to consider the standards for handling personal information in neighboring and high-traffic countries such as Japan and China. As a countermeasure related to the above, it is necessary to consider establishing a legal policy that conforms to global standards. Next, the IT industry is dominated by major Big Tech companies. Therefore, any platform tends to industrialize. Legal policies in response to this should be considered. Finally, the data economy is emerging, with transnational corporations appearing. sufficient consideration is required. In addition, the data economy needs to be considered in connection with issues of security or national existence to some extent. All of the items listed above should be thoroughly reviewed as each one is a very large topic.
