초록

그간 세입 중 지방채에 대해서는 발행이 자제될수록 긍정적인 것으로 받아들여져 왔고, 지방채의 순기능을 활성화하기 위한 방안에 대해서는 상대적으로 관심이 부족하였던 것으로 사료된다. 재정적 건전성을 해치지 않는 범위 내에서 지방채를 보다 적극적으로 활용한다면 재원의 한정성을 극복하고 주민복리를 극대화할 수 있다는 인식하에서 본 논문은 지방채 발행에 대한 총액한도제와 승인·협의절차를 중심으로 지방자치단체의 자율성을 제약하는 요인들을 파악하고 그에 대한 개선방안을 마련하고자 하였다.
지방채 발행 총액한도제와 승인·협의절차의 문제점으로는 첫째, 지방자치단체의 자율성을 확대하기 위해 한도액 산정주체를 행정안전부장관에서 지방자치단체의 장으로 변경한 것이나, 그 취지를 달성하였다고 보기에는 어려움이 있다. 둘째, 자치사무를 수행하기 위해 지방채를 발행하는 사안에 대해 합목적성을 통제하는 것은 자치재정권을 심각하게 제약하는 사례라고 볼 수밖에 없다. 셋째, 협의절차를 도입한 것도 지방자치단체의 자율성을 제고하기 위한 것이나 그 실효성을 담보할 수 없다. 넷째, 투자심사와 승인·협의절차를 통해 자치사무를 중복적으로 통제하고 있다. 다섯째, 지방채 발행에 대한 특례의 경우 그 합리성 등에 대한 재고가 필요하다. 여섯째, 지방자치단체조합에 대해 지나치게 광범위한 통제가 이루어지고 있으며, 통제기준도 명확하게 제시되고 있지 않다.
이에 대한 개선방안으로는 첫째, 한도액 산정 시 지방자치단체의 자율성을 보장할 수 있는 방안을 별도로 강구할 필요가 있다. 둘째, 한도액 초과 발행에 대한 승인절차는 폐지하고 협의절차만을 존속시키되, 협의절차는 비구속적 협의로 변경할 필요가 있다. 셋째, 지방채 발행계획 수립기준은 내용개선이 필요하다. 넷째, 행정안전부는 총사업비 중 지방채가 포함된 투자심사 대상사업에 대해서는 투자심사와 승인·협의절차를 일원화하는 특례를 마련하는 방안을 고려할 필요가 있다. 다섯째, 지방자치단체조합에 대해서도 중앙정부가 지방자치단체와 동일한 범위에서 관여하도록 하고, 관여시 적용되는 기준 또한 명확히 정할 필요가 있다. 여섯째, 장기적으로는 지방자치단체의 내부적인 통제를 강화함으로써 지방채 발행에 대해 신중을 기하도록 하고, 중앙정부는 지방자치단체의 재정운영 결과에 따라 사후적인 통제만 가할 필요가 있다.

영어초록

Until now, local bonds have been accepted as positive as issuance has been refrained, and I think there has been a relative lack of interest in ways to revitalize the net function of local bonds. Recognizing that more active use of local bonds to the extent that it does not harm financial soundness can overcome financial shortages and maximize residents' welfare, this study sought to identify factors that restrict local governments' autonomy, focusing on the total amount limit system and approval and consultation process for issuing local bonds.
The problem with the total amount limit system and approval and consultation process is that, first, the subject of calculating the limit has been changed from the Minister of Public Administration and Security to the head of a local government, but it is difficult to say that the purpose has been achieved. Second, controlling the purposiveness of issuing local bonds to carry out autonomous affairs seems to be an example of seriously restricting autonomous financial rights. Third, the introduction of the consultation process is also intended to improve the autonomy of local governments, but its effectiveness cannot be guaranteed. Fourth, autonomous affairs are controlled in duplicate through investment review and approval (consultation) process. Fifth, in the case of special cases for the issuance of local bonds, it is necessary to review its rationality and others. Sixth, too extensive control is being carried out on the unions of local governments, and control standards are not clearly presented.
As a way to improve the previous problems, first, it is necessary to prepare a separate plan to guarantee the autonomy of local governments in calculating the limit. Second, it is necessary to abolish the approval process, maintain only the consultation process, and change the consultation process to a non-binding consultation. Third, the standards for establishing a local bond issuance plan need to be improved. Fourth, the Ministry of Public Administration and Security needs to consider a plan to unify investment review, approval(consultation) process for projects subject to investment review, including local bonds, among the total project costs. Fifth, it is necessary to ensure that the central government is involved within the same scope as local governments, and to clearly set the standards applied to involvement. Sixth, in the long term, local governments need to be cautious about issuing local government bonds by strengthening their internal control, and the central government only needs to apply follow-up control according to the financial management results of local governments.
