초록

AI로 대표되는 4차 산업혁명이 도래하면서, 인간의 소외문제가 재등장하게 되었다. 4차 산업혁명도래에 따라 지식재산권은 다시 한번 인간존중의 이념을 새겨볼 필요가 있다. 1차 산업혁명후 공장의 기계화는 인간을 공장으로부터 퇴출시켜 생존을 위협하였다. 공장에서 퇴출된 노동자들은 러다이트 운동으로 기계화에 대하여 저항을 했다. 뿐만 아니라 1850년대 이후에는 특허독점의 폐해로 인하여 특허폐지운동도 발생했다.
지식재산권은 인간존중을 그 이념적 바탕으로 한다. 재산권과 지식재산권의 자연법적 바탕을 제공한 존 로크는 필머의 왕권신수설에 반대하여 전제왕조와 로마카톨릭으로부터 인간 해방을 위한 자연법적 재산권을 주장했다. 뿐만 아니라, 실용주의가 주장하는 최대다수의 최대행복도 최종적으로는 인간의 행복을 위해 지식재산권을 인정한 것이다.
AI는 인간노동을 대체하게 되어 노동자의 실업이 증가하게 될 것이고, AI를 소유한 자는 부자가 되겠지만, AI를 소유하지 못한 자, 특히, 노동자 계층은 빈곤하게 될 것이다. 스티븐 호킹 박사의 지적을 다시 한번 새겨본다. “만일 기계가 우리가 필요한 것 모두를 생산한다면, 그 생산물을 어떻게 분배하는 가에 따라 그 결과가 좌우될 것이다. 만일 기계생산물의 부를 공유한다면, 모두는 부유한 삶을 살 수 있거나, 기계소유자들이 부의 분배에 대하여 성공적으로 로비를 한다면, 많은 사람들이 재난적 가난에 처하게 될 것이다. 아직까지 결과는, 기술주도 불평등이 증가하면서 후자의 쪽으로 기울어지는 것 같다.” 지식재산제도, 특히 특허제도는 노동자의 가난을 가속화시킬 수 있다. 따라서 4차 산업혁명시대에는 지식재산제도, 특히 특허제도에 대한 재검토가 필요하다. 현재 고려해볼 수 있는 제도는 AI기술의 개방과 공유제, 강제실시제도나 수용, 그리고 개별적인 정책으로서 AI에 대한 세금과 최저임금의 인상이다. 필요하다면, AI 등에 대해서는 폐지를 포함하여 특허제도의 재검토도 필요하다.

영어초록

With the coming of the 4th Industrial Revolution mainly represented by the Artificial Intelligence(hereinafter “AI”), an issue of human alienation is re-appearing. At this moment, however, we should reconsider the respect for man's life and dignity. After the 1st Industrial Revolution, the mechanized factories expelled the human from the factories and threatened the human survival. The expelled laborers made protesting against the use of machinery and destroyed machines now called as the Luddite Movement. In addition, after 1850s, due to the harmful effect of the patent system, the abolition of patent occurred in some countries.
Rationals of the intellectual property have been based on the respect of human. John Locke, who provides rationals of the natural law bases of the property rights as well as the intellectual property rights, claims the natural law of property rights against the theory of Robert Filmer’s Patriarchy to emancipate human from the absolute authority of the king and the Roman Catholic. The Pragmatism claiming “the greatest happiness of the greatest number” provides the rationals of intellectual property for the happiness of human at the final as well.
The AI will substitute the human labor and cause enormous job losses. The AI owner will be wealthy but no AI owner especially the laborers will be poor. Stephen Hawking points out the result of the AI mechanization saying “if machines produce everything we need, the outcome will depend on how things are distributed. Everyone can enjoy a life of luxurious leisure if the machine-produced wealth is shared, or most people can end up miserably poor if the machine-owners successfully lobby against wealth redistribution. So far, the trend seems to be toward the second option, with technology driving ever-increasing inequality.” The intellectual property system especially the patent system will accelerate the poverty of laborer. Therefore, the intellectual property system especially the patent system will be reexamined at the 4th Industrial Revolution era. At this time, the opening of the AI technology to the public and the making of the commons of the technology, the compulsory licensing and public taking of the technology, and as a specific policy for laborer, the AI tax and increasing minimum wage would be proposed. If necessary, as to the AI as an example, the patent system can be adjusted including abolishment.
