민사집행법 10년, 그 회고와 전망 총론·부동산집행 (Ten years after Enforcement of Civil Execution Act, Retrospect and Prospect - General Provisions, Execution against Immovables)

초록

이 글은 민사집행법 시행 10년에 즈음하여 현재 실무의 입장에 서서 2002년 민사집행법 제정(개정)의 주요내용과 지난 10년간에 있었던 주요 대법원 판결들을 중심으로 지난 10년을 되돌아보고 그와 관련된 문제점과 향후 전망을 필자의 주관적인 시각에 입각하여 간략하게 살펴본 것이다. 즉, 민사집행법 제정(개정) 과정에 새로 도입되거나 개편된 재산명시절차, 사법보좌관제도 등 제도들의 운영현황과 문제점, 임차인 우선매수청구권 제도를 도입한 임대주택법 등 관련 법령의 개정내용과 그 운용현황, 입법예고된 유치권제도 개선(안) 등 관련 개정법률(안) 등의 내용, 유치권 경매가 소멸주의를 법정매각조건으로 한다고 한 대법원 2011. 6. 15.자 2010마1059 결정을 비롯한 주요 대법원판결들과 그 영향 등의 순서로 개략적으로 살펴본 것이다.
지난 10년 동안 민사본안사건이 2008년을 정점으로 오히려 약간 감소 추세를 보이고 있는데 반하여, 민사집행사건은 전체 민사사건에서 차지하는 비중이나 사건수에 있어서 꾸준한 증가세를 보이고 있다(민사집행사건 안에서는 부동산경매사건의 정체와 채권집행사건의 대폭증가 현상이 나타나고 있다). 민사본안사건에서의 민사집행 관련 쟁점의 중요성도 점증하고 있다는 것이 중론이다.
그러나 앞에 놓인 과제들의 해결은 쉽지만은 않은 상황이다. 실무적으로 민사집행은 여전히 전근대적이고 후진적이라는 비판을 면하지 못하고 있고, 입법론적인 측면에서의 비판도 여전하다. 여기에다가 최근에는 민사집행에 관한 연구와 교육의 부재도 큰 문제로 부각되고 있다. 업무가 이관되면서 판사들 중 민사집행에 관심을 가지는 경우가 아주 드물어진 반면, 사법보좌관들의 연구성과가 만족스럽지만은 못한 것이 현실이고, 로스쿨은 민사집행 교육을 거의 하지 못하고 있기 때문이다.

This article is a brief and subjective examination upon the 10th anniversary of the enforcement of the Civil Execution Act, reflecting on the problems and prospects of the last 10 years by focusing on the main contents of the enactment (amendment) of the Civil Execution Act on 2002 and major Supreme Court Decisions in the last 10 years from the subjective perspective of an author. To summarize, this is an overview examination on the current state of affairs and problems of newly introduced or reorganized systems such as the procedure, etc. for specification of property or the judicial officer system; the contents and current state of affairs of the Rental Housing Act, which introduced the lessee's preferential purchase claim right, and also related laws; improvement proposals concerning the liens system, etc., which are expected to be enacted, as well as its related laws; and major Supreme Court Decisions and its influences, such as Supreme Court Decision 2010Ma1059, June 15, 2011, which declared that the extinction principle is the court sale condition for an auction under liens.
During the past 10 years, the number of civil principal cases have been actually decreasing since its peak on 2008, while civil execution cases have been steadily increasing in terms of its portion within all civil cases, as well as in the number of cases (stagnation in real estate auction cases and drastic increases in credit execution cases are notable phenomenons in civil execution cases). The consensus is that the importance of issues related to civil judgment execution in civil principal cases has been steadily increasing.
However, it seems difficult to resolve the above tasks under the current situation. Civil execution is still criticized for being outdated and backward, and is also criticized from the perspective of legislative theory. And recently, the lack of research and education on civil execution is being highlighted as a major problem. This is because judges interested in civil execution have become extremely rare due to transfer of duty, while researches by judicial officers are insufficient, and law schools are nearly incapable of educating civil execution.
