보호관찰관의 지지와 준수사항 위반과의 관계 - 전자감독 대상자를 중심으로 - (Association between Supportive Relationship of Probationers-Officers and Violation of Probation Conditions - Focusing on Offenders under Electronic Monitoring -)

초록

2022년 법무부는 전자장치부착법의 일부 개정 법률안에서 스토킹 행위자에 대한 전자장치 부착집행을 예고했다. 흉악범에 대한 처벌강화와 보복범죄 피해 두려움에 대한 국민들의 입법 요구가 나날이 증가해왔는바, 전자장치부착법은 2008년 9월부터 2022년까지 수많은 개정을 거치며 그 대상과 범위를 확대해왔다. 이와 관련하여 이 연구에서는 보호관찰 담당직원의 지지가 전자감독 대상자의 준수사항 위반을 감소시키는 역할을 할 수 있는지 검증해보고자 했다. 또, 이를 통해 보호관찰 실무자들이 국민들의 요구인 안전한 사회를 만들어나가기 위해서 어떠한 역할을 해야 하는지 고민해보고자 했다. 즉, 이 연구의 가설은 “대상자-보호관찰관 지지적 관계→준수사항 위반”이라고 하겠다.
이 연구에서는 2013년 ‘성폭력 범죄자 전자감독제도 운영 실태조사’를 2차 데이터로 활용, 저항이론(defiance theory)에 근거하여 전자감독 대상자들의 전자장치의 훼손과 보호관찰 준수사항의 위반 요인을 살펴보았다. 선행연구 검토 후, 종속변수로는 보호관찰 준수사항 위반과 전자장치 효용 유지 의무 사항 위반, 독립변수로는 보호관찰관의 지지, 통제변수로는 연령과 학력, 범죄경력, 전자장치 부착 기간을 설정하여 각 영향력을 분석하였다.
로지스틱 회귀분석 결과, 연구모형에서 종속변수인 보호관찰 준수사항 위반에는 담당 보호관찰관의 지지가 아닌 전자장치 부착기간과 대상자의 과거 범죄경력이 통계적으로 유의미한 영향을 주는 것으로 나타났다. 이는 담당 보호관찰관의 온정적 태도나 지지가 전자감독 대상자가 준수사항을 지키는 것에 있어 중대한 영향을 미치지 않는다는 것을 보여주는 결과이다. 범죄자가 준수사항을 잘 따르게 하는 것에는 담당자의 무조건적인 지지나 온정적 태도만 필요한 것이 아니고, 범죄자가 감수해야 하는 처벌의 정도(전자장치 부착기간 등)와 과거 범죄 처벌의 경험(범죄경력)을 살펴 “개별화된 처우” 속에서 대상자-보호관찰관 관계가 수립되어야 마땅하다. 따라서 전자감독이 국민안전이라는 입법 취지에 맞게끔 작동하기 위해서는 향후 범죄자의 개별특성과 양형내용, 그리고 관련 저항요인(defiance factors)을 고려한 적절한 담당 보호관찰관-범죄자 관계수립과 엄정한 감독, 집중 지도전략이 필요하다고 하겠다. 전자감독 영역에서의 새로운 보호관찰 방법으로 향후 범죄자 사례관리 차원에서 보호관찰관의 원호, 지원업무가 중점이 되는 지지적관계 수립활동과 범죄자에 대한 엄격한 법집행 차원의 관리, 감독업무가 효율적으로 분리되기를 기대한다.

영어초록

This study aims at investigating the relationships between supportive attitude of probation officers toward criminals and the revocation of probation. In particular, the current study focuses on identifying crucial factors that are associated with the violations of probation conditions under electronic monitoring. It is significant to find out the key factors that might reduce the numbers of violation of EM conditions in order to prevent recidivism in South Korea. In 2022, Korean Ministry of Justice announced the additional implementation of electronic anklets device program on offenders who committed stalking with a partial revision of the Electronic Monitoring Device Attachment Act. There have been wide controversial criticism toward the expansion of the Electronic Monitoring Device Attachment Act from September 2008, which the law was uninitiated. In this regard, this study attempts to examine what factors can increase the effectiveness of the EM with the consideration of supportive attitude of officers in terms of reduction of violations of probation conditions under electronic monitoring. In addition, the present study highlights the association between the role of probation officers and the level of probation revocation.
"Survey of the Operational Realities of Electronic Monitoring on Sex-offenders in 2013" was used as analyses data sets. Besides, this study relied on Sherman's Defiance theory(1993) to examine the relationships between the attitude of probation officers and violation of probationers under EM. After reviewing previous studies, related factors were analyzed by assigning key dependent variables such as violation of probation conditions and violation of electronic monitoring requirement. In addition, this study utilized independent variable as supportive attitude of probation officers. Furthermore, as control variables, age, educational background, criminal experience, and period of attachment to electronic devices were used in the model.
Logistic regression analysis result demonstrated that EM attachment period and previous criminal history of offenders had a significant impact on increasing the violation of probation conditions. Regression analysis showed that probationer-officer relationship was not statistically significant factors that might decrease the number of violation of condition when other variables were controlled. These results showed that the compassionate attitude of the probation officer was not a significant factor for obtaining better compliance of offenders under EM. Further policy implications will be discussed.
