중국조선족의 이주와 관련된 중국국적법의 현행 과제 (Emigration of Chinese Korean and Status Quo of China’s Nationality Law)

초록

국적은 국가가 자국민을 정하고 자국민에게 권리와 의무를 부여하는 법적 근거가 되기 때문에 많은 국가들에서는 국제사회의 발전과 변화에 따라, 그리고 자국의 수요와 권익을 위해 국적법을 제정⋅개정하고 있다.
이민은 국적과 밀접한 관련성을 갖고 있으며 국적법과 충돌을 일으킬 수 있다. 중국조선족은 이주 민족이다. 그들의 이주는 일찍 국적의 적극적인 충돌을 발생시키면서 청나라 국적법의 제정에 큰 영향을 주었다. 동서냉전을 배경으로 제정된 중국의 현행국적법은 제정 시 타협을 하였으나 그 규정과 내용들이 간결하여 글로벌 시대의 요구와는 거리가 있는 것으로 보인다.
제2차 세계대전이 결속되면서 국적 문제는 국적권에 대한 제한으로부터 보호로 전이되었고 발전되어 왔다. 세계의 중심이 유럽에서부터, 다시 아시아로 이전되기 시작하면서 그 중심이 동아시아에 있다는 설도 있고 중국에 있다는 설도 있다. 국제사회에서 중국의 위상이 높아지면서 세계의 중심이 동아시아든 중국이든 아시아로 움직여 오기 시작하면 중국국적은 세인들의 관심을 모으게 될 것이고, 따라서 중국으로 향한 이민, 그리고 이민으로 생기는 국적충돌은 불가피 할 것이다. 여기에서 중국의 현행국적법이 문제로 제기될 수 있다.
자국민의 이익과 자국의 권익을 보호하는 것은 국적법의 목적이고 국적법 개정의 최종목적으로 되면서 국적법의 가치는 국가의 주권 보장과 국민의 인권 보장에 있다고 할 수 있다. 국제사회의 변화와 함께 중국에서도 이제 곧 나타날 이민과 역이민에 대비하여 빠른 시일 내에 국제공법과 국제사법, 그리고 자국민의 이익과 자국의 권익, 나아가서는 중국의 위상에 수응되는 국적법으로 개정할 것이 필요할 것으로 사료된다.

영어초록

Nationality is a Legal basis that one country selected its own national and granted national rights and obligations. Therefore, with the development and changes of international society, in order to maintain rights and interests, a lot of countries enacted and amended nationality law.
Emigration and nationality are closely linked, which clashed with the nationality law. Chinese Korean is an emigration nationality. The positive conflict whose emigration arose ever made a significant influence on the Nationality Law of Qing Government. China’s Nationality Law was enacted under the ground of the Cold War. Its provisions and contents are too simple, and have a certain distance with the requirement of the global era.
After the end of World War Ⅱ, the nationality problem has been developed from the restrictions to the protection of nationality rights. Now a days, the center of the world gradually shifted from Europe to Asia. The transformation has two types. One is to Asia, and the other is to China. No matter that the center of the world transferred to Europe or Asia, with the improvement of China’s position and prestige in the international community, China’s nationality has gotten the attention of the international community. Subsequently, the emigration will cause the positive conflict of nationality.
Protecting the national interests and state’s rights and interests is the purpose of the nationality law, and is also the ultimate purpose of amending the nationality law. The value of the nationality law reflects the guarantee of state’s sovereignty and national human rights. With the changes of international society, it is necessary for China to amend the existing Nationality Law. The amendment should be in favor of international public law and international private law, its national interests and its rights and interests, and in particular China’s prestige and future.
