초록

친자관계는 자연적인 혈연관계를 바탕으로 성립되기 때문에 법률상의 친자관계를 진실한 혈연관계에 부합시키는 것이 헌법이 보장하고 있는 혼인과 가족제도의 원칙이다. 한편 사회적으로 이혼 및 재혼이 크게 증가하였고 의학적으로 영아사망률이 크게 감소하였으며 법률적으로 여성의 재혼금지기간이 폐지되어 혼인 종료 후 3백일 이내에 출생한 자(子)가 ‘부(夫)의 친자일 개연성’은 상당히 감소하게 되었다. 그리고 최근의 DNA 검사 기술의 진보는 상당하여 저렴하게 신체에 대한 침습(侵襲)을 하지 않고서도 거의 100%의 확률로 생물학상의 친자관계를 판정할 수 있게 되었다.
혈연관계를 객관적으로 손쉽게 확인할 수 있는 정립된 과학적인 방법이 존재함에도 그에 따른 결과를 무시한 채 현실과 달리 친생추정의 효력이 미치도록 하는 것은 가족법의 근본원리인 혈연진실주의를 지나치게 희생하는 것으로서 부당하다. 또한 이는 ‘친자관계의 신속한 확정’이라는 형식적 측면만을 부각한 채 ‘친자관계를 진실에 부합시키고자 하는 당사자의 의사’라는 실질적 측면을 도회시하는 결과만을 낳게 되는 것이다. 한편 법률상 친자관계가 진실한 혈연관계와 일치하지 않는다는 사실을 알게 된 후에는 부(夫)와 자 사이에 정서적 유대감이 형성되거나 유지되기 어려울 것이다. 이러한 상황에서 친생추정의 법리가 가정의 평화나 자의 복리에 유용하다는 주장은 설득력이 떨어진다.
따라서 유전자 검사 등 과학적인 방법에 의하여 부(夫)의 자가 아니라는 점이 객관적이고 명백하게 증명된 경우에는 친생추정의 효력이 미치지 않는다고 봄이 친생추정제도의 취지 및 사회현실에 비추어 타당할 것이다.

영어초록

Parent-child relationship comes into existence on the basis of natural blood relationship and therefore, conformity of parent-child relationship on law to true blood relationship is the principle of marriage and family institution guaranteed by the constitution. Socially, divorce and remarriage have much increased; medically, infant mortality rate has greatly decrease; and, legally, period of the prohibition of women's remarriage was abolished and so, probability that a child born within 300 days after marriage termination would be a biological child of husband is considerably reduced. And, recent DNA testing technology is much developed so that it becomes possible to judge a biological parent-child relationship at low cost with almost 100% probability without bodily invasion.
Even though there is an established scientific method to easily and objectively check blood relationship, it is unreasonable to disregard the result but to make effect of presumption of paternity different from reality to be valid because it too much sacrifices verismo by blood, the fundamental principle of the Family Law. In addition, it highlights only formal aspect of 'prompt confirmation of parent-child relationship' and it brings about the outcome to ignore actual aspect of “party's intention to conform parent-child relationship to truth”. Meantime, it is difficult for husband and the child to form or maintain emotional connectedness after they become to know that legal parent-child relationship does not comply with true blood relationship. Under such situation, the assertion that legal principle of paternity presumption is useful for domestic peace or child's welfare is unpersuasive.
Therefore, considering intention of paternity presumption system and social reality, it is reasonable to believe that effect of paternity presumption is not valid if it is objectively and clearly proved that a child is not the child of husband by a scientific method such as genetic testing.
