초록

소비자거래는 교섭력의 격차, 정보의 비대칭성 등 특성을 가지고 있으므로 계약의 일방 당사자로서의 소비자에 대한 특별한 보호가 요청된다. 국제소비자계약에서 이와 같은 보호는 많은 경우 특칙의 매개를 거쳐 국제재판관할의 판단과 준거법의 지정 단계에서 이루어 진다. 이것이 국제사법상 소비자보호의 문제이다. 한국은 일찍이 2001년 국제사법을 제정하면서 제27조에 소비자계약의 국제재판관할 특칙과 준거법 특칙을 동시에 도입하였다. 그러나 특칙이 존재함에도 불구하고 이를 원용한 판례가 상대적으로 많지 않고 이론적인 연구도 여전히 필요하다. 특히 인터넷거래의 비약적인 발전으로 국제소비자계약분쟁이 증가추세를 보이고 있는 상황에서, 해외직구의 대국인 한국은 자국 소비자의 합법적인 권익을 수호하기 위하여 특칙의 정치한 해석론을 정비할 필요가 있다.
2022년 7월 5일부터 개정 국제사법의 시행을 앞두고 있는 현시점에서는 개정법의 변경사항까지 아울러 개정 전 국제사법이 남긴 과제를 해결할 필요가 있다. 개정 국제사법은 개정 전 국제사법 제27조를 분리하여 제42조와 제47조에 각각 소비자계약의 국제재판관할 특칙과 준거법 특칙을 두고 조항의 적용범위 및 일부 용어를 수정하였다. 본 논문은 소비자계약의 특칙인 위 두 조문의 문언을 중심으로 한국 국제사법상 소비자계약 특칙의 해석론을 전개하는바, 구체적인 논의의 순서는 아래와 같다. 우선 개정법 제42조를 중심으로 소비자계약의 국제재판관할 특칙의 해석론을 탐구하고(Ⅱ), 다음으로 개정법 제47조를 중심으로 소비자계약의 준거법 특칙의 해석론을 탐구한 후(Ⅲ), 이어 양자의 관계를 어떻게 파악할 지에 대한 간단한 논의를 하고(Ⅳ), 마지막으로 논문에서 논의한 내용을 전반적으로 개관함과 아울러 추가적인 연구가 필요한 과제와 구체적인 방향을 제시한다(Ⅴ).

영어초록

A consumer as a party to a contract should be specially protected because of some of the characteristics such as the significant imbalance in terms of bargaining power between business operators and consumers, and the vulnerability of consumers. Such protection is often realized at the stage of determining international adjudicatory jurisdiction and governing law through the application of special provisions. It is named consumer protection under Private International Law. South Korea had introduced a special provision in Article 27 of the Private International Law Act, which was enacted in 2001. However, the cases which applied Article 27 are limited and theoretical studies are still needed. In particular, at a time when international consumer contract disputes are on the rise due to the rapid development of internet transactions, South Korea, a large country with cross-border shopping, needs more research about the correct interpretation of the consumer-protection provision in the Private International Law Act to protect its consumers.
As the Amended Private International Law Act(hereinafter, “Amended Act”) is going to take effect from July 5, 2022, it is necessary to solve the tasks left by the current law in the context of the “Amended Act”. The Amended Act separates Article 27 of the old Private International Law Act and moved the jurisdiction rules of consumer contract to Article 42, conflict-of-law rules to Article 47 of the Amended Act, respectively. This paper discusses the interpretation of special rules of consumer contracts under the Amended Korean Private International Law Act, focusing on the text of Articles 42 and 47. The paper is discussed as follows. Section II explores the interpretation of the jurisdiction rules of a consumer contract. Section Ⅲ explores the interpretation of the conflict-of-law rules of a consumer contract. Section Ⅳ analyzes the interactions between the jurisdiction rules and the conflict-of-law rules of a consumer contract. Section Ⅴ summarizes the overall discussion above and suggests topics that should be discussed deeper in future research.
