관세법상 수입신고의 법리 - 판례의 문제점과 개선 방향 (A Study on Legal Principles of Import Declaration under the Customs Act - Problems in Court Decisions and Suggestions for Improvement)

초록

관세법상의 수입신고는‘수리가 필요하다고 명시’되어 있으므로 행정기본법상의‘수리가 필요한 신고’이다. 법원 판례와 관세 관련 특별 행정심판에서는 수입신고가 사실행위라고 판결·결정하고 있는데, 이에 따르면 수입신고는 행정절차법에서 규정하고 있는‘자기 완결적 신고’에 해당한다. 관세법 규정과판례의 수입신고에 대한 법적 성격에 대한 해석이 일치하지 않는다. 이러한 문제점을 해결하기 위해서는관세법령을 개정하고 판례가 변경되어야 할 것으로 보인다.
관세청의 심사와 조세심판원 심판에서 수입신고 수리를 사실행위로 보는 이유는 신뢰 보호 원칙을 인정하고 싶지 않기 때문으로 보인다. 수입신고에 대한 처분성을 부인하여 수입신고 수리가 신뢰 보호의 요건인 공적 견해 표명이라는 것을 부인하고, 신고수리 과정에서 발견하지 못한 오류에 대한 책임을 수입신고자에 돌리고 있다. 그러나 수입신고 심사 미진에서 비롯한 문제는 관세법 제38조의3 제6항(경정처분)을활용하거나 수입신고서를 포함한 관세법령에 명시적인 규정을 두어 수입신고 수리 후에 품목분류, 과세가격 산정, 기타 사유가 있을 때는 경정처분 또는 부과고지 처분을 할 수 있음을 명시적으로 규정하여 해결할 수 있을 것으로 보인다.

영어초록

According to the Customs Act, import declaration is‘declaration in need of acceptance’, so they are‘declaration depending on acceptance’ under the General Act On Public Administration. Court precedents and customs-related special administrative adjudication have ruled and determined that the import declaration is a factual act. And the import declaration falls under the‘self-completed declaration(report)’ stipulated in the Administrative Procedure Act. The interpretation of the legal nature of import declarations in customs laws and precedents does not match. In order to solve these problems, it seems that the customs laws should be revised or precedents changed.
The reason why the Customs Service and the Tax Tribunal view the acceptance of import declarations as factual acts seems to be because they do not want to recognize the principle of protection trust. By denying the dispositional nature of the import declaration, it is possible to deny that the acceptance of the import declaration is an expression of public opinion, which is a requirement for trust protection, and to blame the import declaration for errors not discovered in the process of accepting the declaration.
However, for problems arising from the failure to review import declarations, Article 38-3 Paragraph 6 (Corrective Disposition) of the Customs Act can be used. In addition, it seems to be possible to solve the problem by explicitly stipulating that a rectification disposition or a disposition of a notice of imposition may be taken if there is an error in classification, calculation of the taxable value, or other reasons after the acceptance of the import declaration.
