징벌적 손해배상제도에 관한 국내 입법의 현황과 문제점 (Current Status and Problems of Domestic Legislation on the Punitive Damages)

기업의 고의적 불법행위나 불공정거래가 만연해지면서 징벌배상제도는 국민들의 규범적 지지를 받고, 여러 특별법으로 그 영역을 확장하고 있다. 이제는 제도 도입 여부에 관한 논쟁을 뛰어 넘어, 현행 입법형식은 타당한지, 손해배상법과 체계적 정합성을 갖추기 위한 방법은 무엇인지, 일반화된 3배 배상의 근거는 적정한지에 대한 보다 구체적이고 진전된 논의가 필요한 때이다. 징벌배상규정은 이른바 실손해액에 일정한 승수를 곱한 배액배상의 형식을 취하고 있다. 상한이 없는 징벌배상제도가 초래한 부작용을 되새겨 본다면, 현행 법률이 채택한 법정손해배상제도는 고유한 의미의 징벌배상제도에 비해 약한 제재효와 억지효를 갖는 반면, 전보배상의 한계를 극복할 수 있는 대안이 될 수 있다는 점에서 매력적이다.
문제는 3배 배상의 적정성 여부에 있다. 혹자는 입법과정에서 직관적으로 결정된 결과물이라고 평가하지만, 미국 징벌배상액의 평균 배수나 국제적인 입법동향에 비추어 보면 실효적인 입법으로 평가할 만하다. 배수를 확대해야 할 특별입법이 필요한지는 신중을 기해 판단해야 할 문제이지만, 그 가능성을 차단할 필요는 없다고 본다. 다만 상한을 폐지하는 것은 손해배상법의 안정성을 크게 해칠 우려가 있어 수용하기 어렵다고 판단된다.

영어초록

With the increase in corporate misconduct and unfair trade, punitive damages have gained normative support from the public and are reflected in several special laws. Now is the time for more advanced discussions on whether the current legal form is valid, how to establish a systemic consistency with the law, and whether the grounds for the generalized three-fold compensation are appropriate. The regulation on punitive damages takes the form of multiple compensation by multiplying a certain number of multiplier to the so-called actual damages. In retrospect, the side effects of the punitive compensation system without an upper limit, the statutory damages system adopted by the current law has adverse effects on sanctions and deterrence, while it can be an alternative to overcome limitations in compensatory damages.
The question is whether the triple compensation is appropriate. Some say that this is an intuitive result of the legislation process. However, considering the average amount of punitive damages in the U.S. or international legislative trends, it can be assessed as effective legislation. It is a matter of careful consideration to determine whether a special legislation is needed to expand drainage, but the possibility need not be ruled out. However, it is hard to accept that abolishing the upper limit would undermine the stability of the damage compensation law.
It is a matter of legislative policy whether the relevant regulations should be placed as general clause in the tort law in the event of a large increase in the scope of punitive compensation schemes or as individual clause under the legislative injunction as they are. Whereas general clause are flexible, there is a risk of excessive intervention in the analytical materials, which could compromise the stability of the impairment compensation system. Regulations currently distributed in the special law seem to have a lot in common with their requirements or effects, so it is possible to integrate them into one special law. The current form of legislation is expected to evolve into a unified special law and eventually become independent of the general provisions of civil law.
