초록

채무자회생ㆍ파산제도는 재정적 어려움으로 인하여 파탄에 직면하고 있는 개인채무자로서 장래 계속적으로 또는 반복하여 수입을 얻을 가능성이 있는 자에 대하여 채권자 등 이해관계인의 법률관계를 조정함으로써 채무자의 효율적 회생과 채권자의 이익을 도모하기 위하여 마련된 절차이다.
통합도산절차는 재정적 파탄상태에 있는 채무자에 대한 청산 또는 회생을 통하여 금융거래질서를 회복하고 나아가 시장경제질서가 원활히 기능하도록 하는 중요한 의미를 갖는 제도이다. 과중한 채무를 부담하고 있는 개인 채무자가 채무자 회생절차를 거쳐서 원활하게 회생되도록 하는 것은 그 개인의 인간다운 삶이나 행복추구권의 실현을 위해서는 물론 나아가 국가 경제의 안정ㆍ발전을 위해서도 매우 중요하다.
「채무자 회생 및 파산에 관한 법률」(2005. 3. 31. 법률 제7428호)이 제정되고 그 이듬해 시행된 이후 약 15년 정도의 기간이 경과되어 개인회생ㆍ파산제도에 대한 개선방안에 대한 개별적인 연구결과가 국내는 물론 일본, 미국 등 외국에서도 관련 연구결과가 상당히 축적되어 있다. 이러한 연구결과와 채무자회생ㆍ파산제도에 대한 국내의 논의 등을 검토하여 현행 채무자회생ㆍ파산절차의 개선방안을 마련할 필요성이 있다.
현재 시행되고 있는 개인회생절차는 나름대로의 역할과 기능을 하고 있으나, 몇 가지 제도적으로 개선할 사항이 있다. 첫째, 주택담보대출채권의 개인회생절차 편입에 의한 개인주거의 안정을 위한 제도개선이 있어야 한다. 둘째, 가용소득투입의 원칙 관련 개선방안을 마련하여야 한다. 셋째, 최저변제액제공의 원칙 관련 개선방안을 마련하여야 한다.
이러한 제도적 개선을 통하여 개인 과중채무자에게 개인회생절차상의 편의를 제공하는 한편, 개인 과중채무자가 인간다운 삶의 수준을 유지하면서 신속하게 회생절차를 마칠 수 있도록 국가가 지원하는 것이 필요하다.

영어초록

The debtor rehabilitation and bankruptcy system is an effective rehabilitation of the debtor and the creditors' legal relations by adjusting the legal relations of interested parties, such as creditors, for individual debtors who are facing bankruptcy due to financial difficulties and who are likely to obtain income continuously or repeatedly in the future. This is a procedure designed to promote profit.
The integrated bankruptcy procedure is a system that has an important meaning in restoring the financial transaction order through liquidation or rehabilitation of debtors who are in financial bankruptcy and furthermore, allowing the market economic order to function smoothly. It is very important to ensure that individual debtors, who are burdened with heavy debts, are smoothly rehabilitated through the debtor rehabilitation procedure, not only for the realization of the individual's human life and the right to pursue happiness, but also for the stability and development of the national economy.
About 15 years have elapsed since the 「Debt Rehabilitation and Bankruptcy Act」 (Act No. 7428 on March 31, 2005) was enacted and enforced the following year. Research results have been accumulated considerably in foreign countries such as Japan and the United States. There is a need to come up with measures to improve current debtor rehabilitation and bankruptcy procedures by reviewing these research results and domestic discussions on the debtor rehabilitation/bankruptcy system.
The individual rehabilitation procedures currently in place have their own roles and functions, but there are some institutional improvements to be made. First, there should be an improvement in the system for the stability of individual housing by incorporating the mortgage loan bond into the individual rehabilitation procedure. Second, improvement measures related to the principle of input of available income must be prepared. Third, improvement measures related to the principle of providing the minimum amount of repayment must be prepared.
It is necessary to provide the convenience of individual rehabilitation procedures to individual overburdened debtors through such institutional improvement, while providing support from the state so that individual overburdened debtors can quickly complete the rehabilitation process while maintaining a human-like standard of life.
