수사기관 내사의 문제점과법적통제에 관한 연구 (A Study on the Investigative Agency’s Internal Investigation and Legal Regulation)

초록

내사는 수사기관이 피내사자의 범죄혐의 유․무를 확인하기 위하여 행하는 범죄인지(입건) 전의 은밀한 조사활동을 말한다. 내사와 수사의 구별은 실질설과 형식설이 있으나 피내사자의 인권보장과 내사의 정당성을 확보의 측면에서 보면 실질설이 타당하다. 내사와 수사의 구별은 내사의 법적통제, 피내사자의 인권보호와 방어권 보장, 통상 수사의 적법성과 정당성의 확보, 수사방법의 구별을 위해서도 필요하다. 현행 내사의 문제점으로는 내사의 법적근거가 분명하지 않고, 내사절차에서 피내사자에 대한 인권침해의 가능성이 항상 존재하며 내사에 대한 법적통제 및 수사기관의 내사에 대한 인식의 부족을 그 문제점으로 지적할 수 있다. 내사의 법적통제 방안으로는 수사기관의 내사에 대한 인식의 대전환, 내사절차에서 객관의무․공정성․상당성․비례성을 철저히 준수하고, 내사절차에서도 형사소송법의 지도 이념을 충실히 구현하여야 한다. 그리고 내사에 대한 법적근거를 명확히 마련하여야 한다.
경찰내사의 법적통제를 위해서는 내사로 포장될 우려가 있는 입건 이전의 실질적인 수사행위에 대한 검사의 수사지휘권의 발동이 반드시 가능하여야 하며, 시행령 제18조의 보완과 합리적 운용으로 경찰내사에 대한 법적통제가 실질적으로 가능하여야 한다. 검찰내사도 검찰스스로 내부통제를 강화하고, 내부 사무감사와 국회의 국정감사 및 국정조사권에 의한 사후 검증의 철저화를 기하여야 한다. 그리고 언론매체에 의한 간접적인 통제에 의한 감시자의 역할과 법원에 의한 사후 검증과 법적통제의 충실한 역할도 필요하다. 무엇보다도 수사기관 스스로가 피내사자에 대한 인권보호에 만전을 기하려는 인식의 변화와 학계의 내사에 대한 적극적인 관심과 활발한 연구로 이론적 토대를 튼튼히 하는 것이 요구된다고 할 것이다.

영어초록

Internal investigation refers to an investigative activity confidentially executed by investigative agency prior to the crime awareness (book) for checking investigatee’s criminal charges. Classification between internal investigation and investigation is divided into substance theory and legal form, but from the aspects of securing investigatee‘s human rights and justification of internal investigation, substance theory is more likely to be appropriate. Classification between internal investigation and investigation is essential for legal regulation of internal investigation, protection of investigatee‘s human rights and guarantee of defensive right, secure of legitimacy and justification of routine investigation as well as classification of investigative method. Problems of current internal investigation are that the legal basis for internal investigation in unclear, possibility of the infringement of investigatee‘s human rights is still in existence in the course of internal investigation process, internal investigation is lacking in legal regulation and investigative agency lacks a sense of internal investigation. Measures of legal regulation for internal investigation include change of investigative agency‘s perception toward internal investigation, exhaustive observation of objective obligation, fairness, reciprocality and proportionality and faithful realization of instructive philosophy of the Criminal Procedure Code in the course of internal investigation process. And legal basis for internal investigation must be clearly prepared as well.
For legal regulation on the internal investigation by police, exercise of the prosecutors‘ right of command on the investigation must be possible in respect of substantive investigation which is possible to be decorated as an internal investigation ahead of the book and legal regulation on the internal investigation by policy must be substantially possible through supplementation of Article 18 of the enforcement ordinance and its rational operation. And the prosecution must strengthen the internal control on its own internal investigation by oneself and pay close attention to the internal administrative audit, inspect of the government offices and thorough implementation of post censorship by the power to investigate government administration. In addition, role of surveillant by indirect control by the media source, post censorship by the court as well as faithful role of legal regulation are also required. More than anything else, investigative agency must take efforts to change its perception to protect investigatee’s human rights and academic circles are also required to strengthen the theoretical basis with positive interest and active researches on internal investigation.
